I purchased a used Toyota 2006 transmission from Quality Used Transmission for $1025.00 on May 24, 2016 invoice # [redacted]. I received the transmission. Due to some financial constrain, I did not install...

the transmission until 8/2/2016. The Transmission was not good. My vehicle did not move after the transmission was installed.I called for a replacement or refund and was told to submit the labor and parts receipt from the garage that did the installation. I submitted it. When I called to follow up on my reimbursement, I was informed that because I did not install the transmission within 10 days, they are not responsible.
 
I paid $469.00 to install the transmission.
 
They refused to refund me the part and laber is stated in the order below of $1494.00.

It is very self-evident
that this business does not care about its customers. I did call numerous times
as they stated, however I did not call anyone names. I may have said a few
things to a man that were not nice, but I did not call him names. I was
frustrated that this customer service supervisor did not care to help me at
all. After he hung up on me, I called back to figure out what I could do,
seeing as the customer service supervisor would not let me cancel. I remember
him stating, “Well, I hope you have fun with the wrong engine and that
everything works out. Good bye”. And then he hung up.
Also, whoever responded
to this barely remembers what happened. The first time I called and told him I
ordered the wrong engine, he told me about the extra fee to switch to the right
engine. Yes, I was upset. That’s when I told him I did not have a lot of money.
He said call back when you figure out what you want to do so I said okay. I
called my mother and talked to her about it. She recommended I speak with a
supervisor. When I called back I got the same man who apparently was the
customer service supervisor. I put him down saying that I could not believe he
was the supervisor considering he did not answer my questions or help me
whatsoever. He said some joking remarks about how he was the supervisor of all
supervisors. Then I told him I wanted to cancel, he asked me why. And I said
because you guys are screwing me over on this. And he said how we are screwing
you over when you were the one who ordered the wrong part. I said I understand
I ordered the wrong part but I already paid $1,375.00 for an engine. I can’t
spend more money on this, I barely had enough for the engine. This is when he
began to say good luck with the wrong engine. As he was saying this I was
telling him he worked in customer service and is supposed to be helping me but
he hung up. He did not even give me the option of canceling my order.
I called back and told
the young man who directs customer calls that I wanted to cancel my order. He transferred
me and I spoke with a different gentleman who helped me switch engines. He did
not give me a hassle like the earlier man. Although he did not explain the
process and what to expect after I asked him to change my engine. He did
explain that if I canceled my order that I would have to pay a fee of $300 or
so. I laughed for a bit and decided to just let them change engines because I
knew either way this business was going to take something from me whether I
liked it or not. 
The way they wrote their response,
you can tell they barely remember what happened and that they made some stuff
up. They make it sound as if I stayed on the phone after the altercation,
calmed down, and then switched my engine. But that is not what happened at all.
Also, I believe this company has recordings of the calls and knows that what
they said in this response is not what happened.
Since this altercation
occurred I have read countless reviews of this business. I have not read one
positive review. All have been very negative, complaining of similar problems
or worse. Many claim this business just grabs old used engines from auto
wreckers and redistributes them to consumers at high prices, taking advantage
of hard working people all around.
This business may feel
like they have the power because they sell the product, but the
customer/consumer has the power. We decide if your business is worthy of our
money, time, and respect. And I, as well as many countless others, have decided
you are not worthy of any of that. You spit on your customers constantly. You
have no respect. You sit here and lie through your teeth to get by. People see
you for who you are. And others will too. I am not worried about that at all.
And I know this business will not last much longer with the type of people they
employ.
I would ask that there
could at least be safeguards put in place so that others do not have to go
through what I did. This company should check all VIN numbers that they receive
to ensure it is the right engine/transmission before it is shipped out. They
take that information when you order a part, they should check it to ensure it
is correct and the parts will fit.
I am not seeking
compensation. I think the writer misunderstood what I was going for. They chose
to go on the defensive side and make things up to ensure there is no punishment
or loss on their end. That’s not even what I’m trying to receive from this
business by contacting them. So I will be more direct. I am seeking an apology.
I don’t believe I will receive one, but I will try. I wish they could admit
they did not help me one bit. I wanted to call back and apologize to this man
because I felt bad for putting him down and acting as if his profession or
opinion was not worth anything. But I knew nothing good would come of it. But
now that I have a direct contact with the organization, I apologize for putting
you down sir. I apologize for acting as if you did not matter. You are not
worthless. You work a job, and you go home to your family (if you have one)
like many others. You pay taxes, you have bills, and you have responsibilities.
I understand you did not want to deal with an upset customer. I’m sure you get
that a lot.

everything was done according to contract.

If that is what Mr. [redacted] wants to do, we can talk to the person he has been emailing back and forth, and then we will make arrangements.

If I had received the exact engine I ordered, the engine that a SW Engines representative called me about, confirming what I needed, what the bill of lading and my quote reads,  I would have all the parts and there would be no conflict of interest. The engine I have received, looks like it came out of a 1992 Ford pick-up with air-in-the-manifold hook ups, not a 1996 Ford pick-up with air-in-the-head hook ups, as all the print shows. I also have not received any mileage conformation or particular truck information this engine came out of. I don't have a massive salvage yard to get the parts needed to make any of the alterations. I was able to find a different 1992 wire harness for the SW engine. (Needed for the different variations of sensors between a 1992 Ford engine with air-in-the-manifold hook ups and a 1996 Ford engine with air-in-the-head hook ups) I need the EGR tube, that goes from the backside of the EGR valve to the manifold.(Needed for the conversion of a 1992 Ford engine with air-in-the-manifold hook ups to a 1996 Ford engine with air-in-the-head hook ups) I also need a schematic diagram of where, how and what to correctly connect the smog control pollution device from my original 1996  air-in-the-head engine to the 1992 air-in-the-manifold SW engine . If my 1996 components will not easily convert over, I will need the corresponding parts to do so.  I'm not sure in what states it is illegal for this apparatus not to be in operational condition, but I plan on traveling with this truck.
I'm tired of being buffaloed, put on hold, for an extended wait and the only option is to leave a message, that no one ever returns. I was told by SW Engine reps, if it bothered me that bad, to put my 1996 head on the 1992 engine so it would hook up correctly, to plug off the EGR tubes, to change out the exhaust manifolds and to live with the check engine light always on. If I send the engine back I have to pay shipping both ways and a 25% restock fee, why should I have to loose $500.00, because of their error. For the amount of money I spent, I should not have to change or modify anything on the SW Engine to make it work in my truck. I feel that SW Engines should either 1. Send me the parts needed to make their 1992 engine work for me, at no charge for parts or S & H to me, 2. Send the correct 1996 4.9 air-in-the-head 70,000 mile engine I paid for, that was quoted to me, and they pay the S & H charge to return their engine, 3. Or a full refund of my money and they pay the S & H charge to return their engine I did not order. 
SW Engines says they sell 4 to 5 of these engines daily, and I'm the only one who has ever complained. It might be their first and only mistake, but they should own it, not me. My truck is off the frame restoration, I don't want to band aid and bubble gum it together. If it is so simple to change over, SW Engines should not have any objection in assisting me in resolving this problem with any one of the above mentioned options..

We already came to an agreement with Mr. [redacted], and the agreement was for him to make both transmissions available for pick up and then we will pick them up and refund him. So far we only have received one transmission back.

I’m writing in response you letter regarding a Mr. [redacted]. He had purchased an engine from us back on August 6, 2014 for a 2004 Land Rover Discovery an we sent it to him in a timely manner. He had then called us on November 5, 2014 to report that he ha...

blown the head gaskets. We normally do not cover any gaskets but we were going to help him out, all he had to do is get an estimate from a shop to do the head gaskets and we would give him credit back on to his card for that. Mr. [redacted] elected not to do it that way, he wanted a new engine, so we told him to pull that engine out and we would exchange it. That is what we did and now he is all taken care of. His extended parts and labor guarantee was never activated by Mr. [redacted] so unfortunately the labor part of the warranty was denied. On February 19, 2015 Mr. [redacted] had called in to notify us that the engine started knocking and then had seized up. We are wondering if Mr. [redacted] is driving around with a clogged radiator or some other problem since he keeps blowing up all of these engines we send him. He also never provided any type of verification from a shop proof he had installed a new radiator or heat tab pictures to us at anytime. We now have sent him a 3rd engine last week, and we are waiting to get our engines back so they can be inspected for abuse and improper installation.

What expense? you got all your money back from your credit card company.

Used Engine Warranty
A Satisfied Customer is our Number 1 Goal
The engine warranty covers block, heads, and all internals. Bolt-on accessories, wiring and sensors are not warranted.
We are not responsible for improper installation and or labor charges.
Warranty will void if the part is used for racing, operated without proper fluids, or a melted heat tab.
New thermostat and timing belt (if applicable) must be installed.
All returned parts or cancelled orders are subject to a 25% handling and restocking fees plus customer assumes all shipping costs.
In the event that the buyer defaults in the terms of payment, the buyer agrees to reimburse SWE for all costs and attorney fees it incurs in collection action.
Mis-ordered or mis- diagnosed parts are non-refundable.
We do not assume towing, shipping, transportation, and car rental cost.
Usual delivery time is about 7-14 working days but due to some unusual circumstances please allow additional time.
All residential deliveries incur a $75 shipping charge, unless agreed to otherwise.
Extended warranty will be activated upon notification of installation of part.
Engine or transmission must be installed within 30 days of delivery OR ALL WARRANTIES WILL VOIDED.
Exchanges or Store credits only after the part has been in customer posession for more than 30 days.
Although SWE makes every effort to make the part look as nice as possible before it ships no warranty or guarantee is made towards the appearance of that part.
Make sure to inspect all parts before signing for them on delivery.
The stated mileage is not guaranteed and is correct to the best of our knowledge.
We do not warranty oil leaks/damage on engines or transmissions due to non replaced seals, gaskets or filters.
Transmission cooler lines must be flushed or warranty will be void.
OEM auto parts are interchangeable with multiple years, makes and models which means the same part is an exact fit for multiple makes and models as determined by OEM standards. We guarantee the part we sell to fit your vehicle.
All deposits are non-refundable.
Any engine and transmission returned not in the same assembled condition as it was received will not be refunded under any circumstances.
Transmission external sensors and switches are not covered by warranty.
Transmissions are tested, visually inspected and cleaned.
Standard engine warranty is 180 day parts only. Standard transmission warranty is 90 day parts only.

my order and invoice # was [redacted] there is no warranty info to submit. my order was never completed by seller and I canceled the order 4 days after placing it but never got a full refund

The complainant did not officially cancel the order through the Online Cancellation System until 3.18.16.  Since the complainant waited well over the time frame of 24 hours to cancel the order with no restocking fee, we incurred the expense of processing the part to get ready for shipment....

As stated and agreed upon when placing an order in the Terms and Conditions of the sale on Line 3: “All returned parts or cancelled orders are subject to a 25% handling and restocking fees plus customer assumes all shipping costs.”  In this case we waived in shipping fees due to the order not be shipped yet.  Furthermore, the complainant initiated a chargeback attempt on 3.24.16 with the Credit Company used when placing an order.  Until this chargeback attempt is resolved we can discuss or come to any sort of agreement.

I recieved a e-mail from you folks in regards to the complaint I filed against SW Engines on 12/3/2015. I agreed thru the e-mail to let SW Engines contact me to make arrangements to refund my money if I dropped the dispute. Which I agreed to except them calling me to get my money reimbursed to me. When this [redacted] called me we talked about the issue of me not receiving my motor and me being reimbursed. I asked [redacted] to send me a e-mail acknowledging our conversation which he did (see attached e-mail). I called my credit card company to drop the dispute so I could be refunded to only find out that they were again coning me. If I was to drop this dispute thru my credit card company before being credited I would have no recourse. Which they are aware of this. SW Engines is using correspondence thru the Revdex.com to trick me into dropping not only my complaint with you guys, but to wreck any chance to get my money refunded thru Sears. Mr [redacted] had ordered a 4.3 engine for a 1994 Chevy pick up truck and it was sent in a timely manner. Chevy had 2 different style engines that year  and we unfortunately sent the wrong style engine. So we had picked up the wrong engine and sent him the correct engine. We did not know if Mr....

As the complainant has stated the Terms and Conditions of the Free Warranty state on Line 1: “Engine warranties are limited to manufacturing defects in the block, heads, pistons, crankshafts, camshafts, rockers, and oil...

We do not warranty any attached accessory parts, such as switches, sensors, cables, electronics, belts, hoses, water pumps, manifolds, wire harnesses, valve covers, brackets, flywheel etc.” It is also stated on line 15: “We do not warranty oil leaks/damage on engines or transmissions due to non-replaced seals, gaskets or filters.” We clearly do not warranty gaskets and should be inspected by the mechanic and replaced if deemed necessary with all of our engines. We believe the complainant is confused in thinking he ordered a rebuilt engine and not a used engine as we advertise, offer and supply.  No Used Engine supplier tears apart an engine and replaces gaskets and bolts as the complainant suggest we should do. This would be referred to as a rebuilt engine if this was the case which typically cost considerably more. We supply only used engines as clearly and prominently stated on our site and by our representatives when calling in.  We apologize if there was confusion on this order, but we do everything we can to ensure our customers are getting a used engine and what is involved with choosing this product.

The claim that they did not know where the engine went is not valid. I sent copies of bills of lading to [redacted] on 9/5/14, again to [redacted] on 9/17/14 and 1/11/15 followed by copies to [redacted] on 12/11/15 and he confirmed receiving the copies on 12/16/15 when I was told for the 6th time he had to research it and promised he would call me back. They have received these copies 5 times plus the ones I again sent you, yet no one has ever attempted to call back or make this right. This has been going on continuously for 21 months, and every time I do get a response it has been the same...send us proof so we can find where the engine went. It took me less than 2 minutes and a single phone call to Appleton Recycling to find out that the engine had been melted down for scrap. It was directed there from WebPro engines when I told them it was the wrong engine and that it needed returned for a refund. I had no knowledge of Appleton Recycling until 6/3/14 when it was delivered, and the pickup order was issued by WebPro on 6/11-14. In short, they have used me to pay for their mistake and refuse to admit it. I was offered a refund in June minus restocking fee (the engine was melted for scrap...not restocked) and shipping (They told me by phone a e-mail there would be no charges if it were the wrong engine before I purchased it).
