We only began to go through the related paperwork and realized today was the deadline for addressing this complaintWe did receive a communication from Ditech’s Customer Service Department dated August 4, regarding our account with them. The letter was slightly confusing because it stated they would not collect any more from us until this matter was resolved. But it ended with a statement that this was from a debt collector and it was an attempt to collect a debt. I have attached a photo of this letter for your reviewWe received a copy of the packet and cover letter you received dated August 10, 2016. We understand the explanation on the coversheet of that packet for those dates listed. However, we are wondering where the remainder of the payment amounts have gone. They are not in in the UAF account waiting to be applied to the next full payment. If my understanding of their explanation about the Unapplied Funds Account is correct shouldn’t the balance be in that account until another full payment can be made? My wife and I are having difficulty understanding where the remainder of this money has gone to and are contacting our Credit Union to assist us with reading the packet entries in hopes of making sense of thisI am requesting an extension of some sort to provide additional time to get a clearer understanding of this information Sincerely, *** ***

That is our issue, they cannot find the account number that was a Green Tree number so have been unwilling to sign a lienwaiver so the title can be transferred to another party.We should not have to resubmit, we have submitted everything that was asked of us previously, they are wasting our time. I am rejecting this response because: #We did execute a modification on our home through the ( HAMP ) Program #When our mortgage was transferred in June from Residential Credit Solutions to DITECH we HADN'T been late making our mortgage payments to Residential Credit, If so there WOULDN'T have been a HAMP incentive credit given to our principal account to DITECH. #DITECH made our account delinquent by all of the misrepresentation from the customer care representatives that we had spoken with during this ordeal, that has now stopped us from receiving the yearly incentiveDITECH has beat around the bush on this matter since it first occurred in October DITECH will not take the initial blame for this mishap, nor will they fix the problem as for our yearly incentive through the HAMP programI'm on disability since and my husband is a ARMY VETMy husband was laid off work in October 2016, but we were still able to make our mortgage payments as scheduled with my income and his unemployment paymentsOnce we were told about the reallocation of the money in the account going towards the November and December mortgage payments, we decided to payoff medical bills that we had, because according to the customer care representatives the November and December mortgage payments would be made using the reallocation money in the account. DITECH has only made the account our fault for being behindIn the statement they sent to the Revdex.com, they are still stating our account is delinquent, but not because of them, because of us! We do understand now that the money that was suppose to be reallocated is for Principal only, but we were told that in January According to DITECH'S mortgage payments, an account isn't delinquent until AFTER the 17th of the month, they had us delinquent for December, January and February, how! Please be advised the escrow accounts are analyzed once a year, to reconcile payments made to escrow against any increases and/or decreases in disbursement made from escrow for private mortgage insurance (PMI), homeowner's insurance and/or property taxesAccounts may be subject to one or more of these types of itemsMs***'s escrow is set up for taxes onlyAt the time of the analysis, any surplus or shortage and/or deficiency are addressed
The analysis is completed by taking into account the total amount of the projected disbursements expected over the next months, and spreading them over months to determine the "base" escrow amountThe projected disbursements are based on the cost of the previous year's disbursementsA cushion of two months of the "base" escrow amount is allowed to be retained pursuant to your Mortgage documents and/or State lawA cushion is retained to allow for possible increases in actual disbursements over the projected amount and is an actual part of the required escrowA shortage occurs when the projected balance is less than the required balance, but not in the negativeA deficiency occurs when the escrow reaches a negative balance

I am aware of the negative balance owed and as indicated, I will happily pay the negative/shortage for past year's taxes paid on my behalfI just do not desire Greentree to pay my taxes in December, hence the reason for trying to get this taken care of nowAs this option to settle the negative balance in order to cancel the escrow was not offered in Greentree's response, I would like them to provide me with the opportunity to pay the balance owed and reassure me that upon making the payment that it will be applied to the said balance and not towards the principal payments like they've done in the pastAgain, if escrow is not a requirement and as long as I do not have a negative balance then I would like to cancel itI look forward to Greentree providing me with the necessary information and steps to get this negative balance paid and my escrow account cancelledAlso, the individuals at the numbers provided have not been responsive to me as I've attempted to work with them to resolve this matter in the past

Green Tree does not own nor did we originate the above referenced loan; we merely service it for a third partyRecords reflect the both Mrand Mrs*** signed the Note and Mortgage at originationHowever, CitiMortgage removed Mr***s name from the account prior to the transfer of servicing and Green Tree has not received a copy of the death certificate informing us of his passing
Court documents reflect that a Chapter bankruptcy was filed on August 30, and the debt was discharged without reaffirmation on January 24, Although the debt was discharged in the bankruptcy and Ms***'s no longer had an obligation to pay the debt, the lien on the property survives dischargeIn order to enforce the lien foreclosure must be initiated
Before foreclosure can be initiated, Green Tree is required to provide all borrowers with certain noticesAs such, notices were addressed to Mr***, although he is deceased, per state/federal regulationsAs of today, the account is not in a foreclosure statusGreen Tree received and reviewed the deed-in-lieu of foreclosure and the request was denied because there is a second lien on the property
Green Tree is not attempting any act to collect or recover the discharged debt but may contact Ms*** to determine her intensionsPursuant to her request, Green Tree has ceased all outbound telephone communication

I am rejecting this response because: I understand that Ditech may have never charged a fee to participate in their biweekly ACH payment program but the mortgage company that I originally dealt with this loan did charge a fee and I have only entered into a mortgage agreement with your company only by the fact that you purchased my mortgage from another company. You agreed to the terms of the original agreement on my loan when you purchased my mortgage and have continued this collection process for years until now. This is an unfair collection process that you continued to abide with the original loan agreement of bimonthly payments until this time
I am rejecting this response because:
I have been in contact with ditech many times and have kept record of all the communications My first complaint comes that every time I call,I get a different person and I have to explain the situation in detail and wait for the representative to read my file on the computer screen I asked for one person to be assigned to my case and that was denied Second, I keep being told to fax information but the fax number never works so I end up spending money for my paperwork to be sent via tracking mail I have spent a year on this case and ditech has no proof that they own this account, I did not even know they were on my house title until I went to sell! Since then, I have lost the sale of the home and can't sell now because ditech is unwilling to help resolve this issue between them and Bank of America Ditech says they own the loan but they are not proving that they have the paperwork to show that they do yet they want Bank of America to provide more proof....what is more than a copy of the payoff check for this loan? It is as if me and my house are hostage and they will not release it nor provide me the proof that this loan belongs to them and not Bank of America who has given me more proof than ditech.Please help!
