Thank you for the opportunity to respond to the complaint filed by *** *** *** regarding her account with Ditech Financial LLC (Ditech). We understand Ms***'s concernsPlease be assured that her correspondence has been reviewed with the appropriate department management and the
following response is provided.Records indicate that Ditech was contacted by Ms*** through an email on May 24, 2016, concerning the late fees billed to the accountA second email was received on June 14, 2016, in reference to the late feesUnfortunately, due to the current volume of requests we were not able to promptly respond to Ms***'s concernsWe apologize for any dissatisfaction this may have caused and offer the following response:Pursuant to the terms on Ms***'s signed loan agreement, the due date for the account is the 1st ofeach monthIf a payment is not received in full by the due date, the account will be past dueLate fees may be assessed for payments that are received more than after the due date.Ms***'s full monthly payment is $Records indicate that Ms*** has been remitting partial payments of $through an online bill pay serviceMs*** should be advised that her account type requires that only a full payment be applied to the next monthly payment due datePayments that are received in amounts different from the payment due are placed in unapplied funds ("UAF")If sufficient funds are available to apply a full payment, funds are applied to the next monthly payment due and any outstanding amounts such as finance charges, returned payment fees, late fees, escrow due, and acquired accrued interest, prior to the application of funds to the principal balanceThis form of payment posting is determined by the mortgage contract and the servicing protocols of the account. When payments are received without payment instructions they are systematically applied to the account per the above indicated payment hierarchyThis systematic application resulted in some of the payments remitted by Ms***'s electronic bill payment service being applied to the principal balance.Ditech makes every effort to credit payments as requestedPursuant to the correspondence received, a request to reallocate the amounts applied to Ms***'s principal balance was completed on July 11, and the account was flagged for special handling of future payments remittedShe may monitor the application of her payments on our website at www.ditech.com to ensure payments are not systematically applied to the account's principal balance or contact her account representative listed belowThe late fees assessed to the account as the result of this issue have been waivedMs*** may also be assured that negative credit reporting did not occur as a result of this issue. As of the date of this letter, Ms***'s account is due for the August 1, 2016, payment of $960.50.If Ms*** has any further questions, she should contact her account representative Alicia Mat ###-###-####, extension ***, or Christie Gat extension ***Our Customer Service Department is also available to answer any questions or concerns and can be reached at ###-###-####, Monday - Friday, 7:a.mto 8:p.mCT, and Saturday 7:a.mto 1:p.mCT.Sincerely,Shea ***Customer Service Correspondence Supervisorcc: *** *** ***, *** *** *** HIGHLAND, IN ***

Pursuant to Mr***'s current correspondence, a review of the account confirms that the account is contractually due for the April 15, 2016, payment due dateMr***'s regular monthly payment is $The last payment received, in the amount of $386.00, on August 15, 2016, was applied as follows:$to interest owed for the March 15, payment $to interest owed for the April 15, payment The payment was applied as indicated above because Mr***'s account is a simple interest accountSimple interest accrues on the outstanding principal balance on a per diem (daily) basisThe per diem finance charge is calculated by multiplying the rate (9.000% for this account) times the principal balance and then dividing the product by When payments are received, they are applied first to accrued finance charge and any remainder is applied to reduce the principal balance in accordance with the terms of the credit agreementWhen a payment is received prior to the due date, and less than days has expired between payments, less interest is owed and more of the payment is applied to principalConversely, when more than days expire before receipt of the next payment, more interest is owedPlease be advised payments are applied consecutively to the last subsequent monthly installment receivedThe enclosed payment history reflects when and how payments are applied to principal and interest on the accountPlease note that the months where no principal was applied, payments were generally more than days from the last payment made, or there was past due interest owedAny earned interest is satisfied prior to applying any portion of the payment to principalThis is the nature of a simple interest accountFor further reference related to the contractual application of payments Mr*** may review Section of the enclosed copy of his contractMr*** should also note, that billing statements reflect transactions that occur during a specific time periodTransactions that occur on the account after a billing statement is generated would be reflected on a subsequent billing statementHis last billing statement indicates that the following amounts are now due: $for the April 15, due date $for the May 15, due date $for the June 15, due date $for the July 15, due date $for the August 15, due date $for the September 15, due date $2,Total Payments Owed $Late Fees $2,Total DueIf Mr*** has any further questions, they may contact his account representatives Erica Wat ###-###-####, extension ***, or Juanita Sat extension ***Our Customer Service Department is also available to answer any questions or concerns and can be reached at ###-###-####, Monday -Friday, 7:a.mto 8:p.mCT, and Saturday 7:a.mto 1:p.mCTSincerely, Shea ***

I am rejecting this response because:
I do not want my personal information out there for people to see
I am rejecting this response because:It is my opinion that either ditech or Revdex.com is confused as to the issue at handI have sent the proof that this debt was resolved and for this company to feel that they have the right to keep reporting me to the bureaus because the debt was not resolved with them is ridiculousI do not understand how the Revdex.com can not resolve this issue, it is obvious that this company must feel that it is far and just to control someones future. If this issue can not be resolved I will have no other choice but to seek legal advise and let a attorney resolve this, with most likely a whole different outcome in my favor.*** ***

Pursuant to Mr*** correspondence, a review of his account confirms that on September 30, 2017, he was offered a temporary hardship forbearance, as the result of his property being located in a FEMA declared disaster area, that consists of the payment break period that starts on October 07, 2017, lasts for three (3) months, and ends on December 01, The special forbearance letter advised Mr*** that he should continue to make payments if he was able to during this period but no payments were requiredNo late fees or negative credit reporting were to occurThe forbearance letter specifically states that payments that are contractually due during the payment break period would remain due if not paid prior to the end of the payment break period and that moving the contractual payments due during the payment break period to the end of the loan would require a modification of the current loan termsIn response to Mr*** correspondence, which states that he was advised that the monthly payments due during the special forbearance period would be added to the end of the loan, Mr*** should be advised that a review of the account was completed and it has been determined that records do not support this claimWe apologize for any dissatisfaction this matter may caused Mr***If Mr*** has any further questions or concerns about the account, or if he wishes to purse mortgage payment assistance with Ditech, he should contact his account representatives
