On 4/14/16, a Subaru Outback was advertised for sale on *** It indicated in the ad that everything on the car worked I came to find out during the test drive that 1) the fog lights didn't work at all, not even the light on the switch 2) The sunroof didn't work properly, the back part slid open but the front part would not pop up 3) The passenger heated seat didn't work nor did the light on the switch come on I offered a lower price for the car and let them know that they falsely indicated that everything worked, and they declined They said they are A+ rated with Revdex.com, however look at their reviews on ***, many more in my same boat
Customer has been sent two different units plus parts, these parts have been tested prior to shipping to ensure their performance*** has been approved for a replacement for a week now, our products come with a two year warranty for all customers with proof of purchase, customer cover shipping
to us and we to them
Let me know if you need any further information

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
[Provide details of why you are not satisfied with this resolution.]
I don't know why Benjamin Franklin would consider this matter settled, as if they did us a favor by leaving us in a messMy request was to actually talk with the owner about EVERYTHING that happenedBut clearly, that is not happening because the person I complained about, ***, answered the BB ComplaintNo accountability: RED FLAG
*** absolutely did not provide a down to the penny price,
and Benjamin Franklin Plumbing refused to He merely provided a bid of $to
replace the water heater, with an additional $for a vent, for a total of
$2370.00. I never once refused to pay
When *** insisted that we had to have the vent replaced, he refused to give
us an opportunity to get a second opinion on that portionIn fact, he said he
would not turn the heater on, and he would charge us for coming back out, as
well as the time waiting for the inspector @ $and hourI gave inHe
came back the next day, and did, what turned out to be, unnecessary work
*** *** repeatedly said in a minute second phone call that she is
not privy to the conversations between myself and the plumber on every phone
call, in which *** was rude and indifferentThis was a common theme with
***, who also works in the officeYet she has responded to this complaint
as if she was present
The plumber started this visit by cutting up a year old
hedge, insisting our water meter was UNDERNEATHI should have put him out
thenThe water meter was in the front yard*** is deceitful and untruthful , at best,
when she says this office provides a down to the penny estimate and that I didn't want to payWhat *** is conveniently leaving out is that I didn't hand over $on the spot that Sunday night because I wanted to wait for an inspection promised by the plumber the next working day (MONDAY), and I refused to sign a blank contract that said I was fully satisfiedI CALLED the following morning, not even hrs later to discuss the promised invoice and inspectionYet, in
the recorded phone call, she repeatedly says that they DONT break it down to
the penny, and that she doesn't know why the plumber *** would say thatAll
we merely wanted was an invoice with the water heater price, and time for an
inspectionFor Benjamin Franklin to not afford us that opportunity certainly
made them to appear to be thieves and shady, which turned out to be the caseCertainly
NOT a leader in the plumbing industry
I did have other plumbers come outEVERY SINGLE ONE said the same exact thing about the work that was done and not necessary, and how I was clearly overcharged
I chose a reputable plumber, and he come out the same day, who DID in
fact have absolutely NO PROBLEM creating an invoice, and the staff was awesome
It felt right, and we were %percent satisfiedMost importantly, this
company was very empathic. We discovered
that the work that Benjamin Franklin supposedly "took a loss on" was dangerous
They moved our water heater below the water line and into a holeThe vent they
installed was in fact the wrong sizeWe had to have that both error's
correctedBenjamin Franklin Plumbing also took out our vent, and when they so
called "returned" the vent, 3/4's of the pipe was missing, and we
never saw our original water heater againThey also drilled another hole in
the structure of our home that was also not needed, as the water could have
been drained from the bottom or the original holeThis was done without our
knowledgeNot only did we PAY IN FULL the reputable plumber that CORRECTED
what Benjamin Franklin Plumbing screwed up over days, *** made it crystal
clear that the owner of this location does not care how the customer is being
treatedIt is *** who in fact said to me, "we can come get everything
out and you can find another plumber." When I asked to speak with the owner, that is when she said the owner doesn't get involved
DO NOT be fooled by this veiled attempt to justify their
actions and this diatribe that they actually did us a favorBut REALLY REALLY
read between the linesNo reputable company would reply by attempting to throw
the homeowner under the bus, but they would simply apologize for the experience
and move on if they really thought the matter was solvedIt was not until I
filed this complaint, did we hear an askew apologyWe were absolutely NEVER
contacted by the owner, and I think that should speak volumesTo say the owner
hires people he “trusts” to act on his behalf, also speaks for itselfAs a veteran,
we all have someone to answer toBut, to have someone in the office that does
not have to answer to anyone but themselves should give anyone reading this an
idea of the “unprofessionalism" that ensues because there is no
accountability, and their actions are a clear reflection of the owners wishes, per
***s response that she is acting on his behalfThat is a red flag
Further, let the manner of their response really speak for
itself also, and pay attention to the person who wrote it***’s
condescending, and disconnect from the situation is spot on with the way she
talked to me on the phone
Finally, trust your instincts and your gut feelingAnytime
a tradesman WILL NOT give you an invoice of charges, and skates around
inspections: GET OUT!! When a company tells you "we are a franchise and do
not answer to corporateBut you can look the number up on the internet",
let them come and get their stuff and: CUT TIES!! When you are unsure of a
shady contract: DON’T SIGN IT When choosing
a plumber: DO YOUR RESEARCH!!
We have every single phonecall, as well as camera sound and video that
never once shows, or do I say I am refusing to payHowever, these phonecalls
and video do in fact tell the truth, and how this company came in to our home
to "strongarm" and leave our home in a mess, how the plumber was
talking to me, how frustrated I was, how I questioned why I was signing a blank contract, how they added wording in to the spacing of a handwritten estimate to alter it, how the office staff further mistreated
usIt was a shameYou don’t have to take my word for it, just google the
reviews for Benjamin Franklin, and see for your selfDO NOT DO BUSINESS WITH
THIS COMPANY!!!

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that
this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
All they did was simply state the same exact thing that caused me to file the complaint in the first place, which is that they are trying to claim that the warranty does not apply to replacement productsI received a faulty replacement product that failedI understand that this is out of scope of the original year warrantyHowever, there is reasonable expectation on behalf of the consumer that a replacement product is intended to replace a faulty product and therefore be in working conditionThe replacement product they provided me was also faulty, and I feel that the company is not fulfilling their promise of quality products in good faith, when the replacement product they have given is also faulty and they offer no recourse in this situation for the consumer

To further clarify Mad Catz reply, I have received three consecutive units with various mechanical failuresTwo of the units, the original and the current one in question, exhibited one of the exact same mechanical failures right out of the boxTherefore I find their assertions of "testing the product prior to shipping to ensure their performance" to be somewhat dubiousGranted they have replaced the product twiceAnd on the first incident I was more than comfortable with paying the return shippingBut when that unit began exhibiting mechanical failures within a couple weeks of receipt, I called after that RMA was accepted and the gentleman I spoke to was kind enough to email me a return shipping label along with his apologies for my inconvenienceWith the failure of the second replacement unit, I once again called support, performed all the troubleshooting procedures, and was issued an RMAI immediately asked for a shipping label since they had issued one for the second RMAThe gentleman I was speaking with asserted that that would not be the case as it is not company policy to issue a return shipping label regardless of the circumstanceI directed his attention to the support ticket for the first failed replacement unit, and after finding the shipping label attached, once again asserted he did not have the authority to issue me a return shipping labelI then asked if he could transfer me to someone who had the authority to make such decisions and he declinedFor the sake of clarity, I originally paid $plus shipping for this unitI paid roughly $to ship back the first return from New York to California in its original packageThis cost is due to the oversize packaging necessary for an item this largeIf I were to have paid for all the returns, I would now be paying double for this itemBut more importantly, Mad Catz representatives are now claiming that their policy is, and always was "our products come with a two year warranty for all customers with proof of purchase, customer cover shipping to us and we to them." If that is the case, why was I issued one for the second return? The Mad Catz employee I spoke to at that time said it was due to the unusual circumstances of my case (2nd return within warranty period) and in acknowledgement of my inconvenienceWell what has changed? And more importantly, what exactly IS the policy regarding those unfortunate enough to receive multiple consecutive failed products? Because in my opinion, Mad Catz is now shifting the goalposts at whim. At the end of the day, all I want is a product that works reliably for, at the very least, the duration of the warrantyI have experienced three consecutive units with mechanical failures in monthsMad Catz has been demonstrably inconsistent with regards to making exceptions in their return policy, and have further set a precedent by issuing a shipping label for my second returnIn consideration of the fact that I have received three consecutive failed units, I have very no confidence I would receive a working unit if I paid for the return shippingTherefore I cannot justify that expense as the money may better be spent towards a competitors productIn conclusion, all I want is a product that worksI believe that as a consumer and a regular purchaser of their products, Mad Catz should be obligated to provide me with a working product for my moneyMad Catz has had two prior opportunities to make this right and were unsuccessfulTo expect me to have faith that they will be able to deliver, given my experience, is unacceptable.I have attached a copy of the return shipping label for the prior RMA

Our warranty covers two years from date of purchaseHis original date of purchase 11/7/and was given a replacement a year ago.He is out of warranty
[redacted]. is an exceptional plumber. His response time over the weekend gave me the impression that he did not come to only replace my 15 year-old 45-gallon water heater. His recommendations were very positive and received very well. He went the extra mile in reducing the water pressure that affected my house, brought our plumbing codes to standards, replaced pipe connections involving gas and water. His perseverance and attention to detail was beyond reproach. Thomas W. 's trust and confidence convinced me to purchase a waterless water heater. My wife is very happy with the results of his hard work. Thank you for your professional service.
I called Benjamin Franklin to have someone come out and check the water coming from my shower. The hot water did not have a lot pressure. With in 25 minutes after I made the call [redacted]. arrived. He had on boot booties to keep dirt off my carpet and he proceeded to go to work. He was very courteous and professional. He took care of the problem and unclogged a slow drain I didn't know I had. This young man is outstanding.
Extremely prompt, professional and courteous service on a holiday.
Could not have asked anyone better.
Very prompt service. I called at noon and a service Technician was at my home by 3 PM. [redacted] did a great job! I would highly recommend Benjamin Franklin Plumbing.
We have spoken with Mrs. [redacted] regarding the issues she stated in this complaint. We have acknowledged the short comings of our technicians, had them fix the problems and apologized for the inconvenience. We know that our company is the leader in the plumbing industry and we strive...
to leave that impression on all of our customers. We are truly sorry that Mrs. [redacted] had such a terrible experience. We have also reviewed the invoice and it appears the technician has already given Mrs. [redacted] a discount of $748.00, but at this time we have only been paid $1100.00. There is still an unpaid balance of $2900.00. We do not represent ourselves as the cheapest plumber in town but we do represent ourselves with a service that far exceeds other plumbers. Mrs. [redacted] herself stated we were the only one who answered our phone and was capable of handling her problem, another plumber walked out on her. That is just one example of the service we provide, on time. We also have clean, presentable, back ground checked, drug tested, licensed technicians who are backed by a company that is licensed, insured and bonded. I have attached the invoice that was signed by Mrs. [redacted] excepting the amount and stating she was completely satisfied with the work, it states "I acknowledge satisfactory completion of the above described work and that the premises has been left in satisfactory condition. I understand that if my check does not clear, I am liable for the check and any charges from the bank. I agree to pay 1.75% per month for past due contracts (minimum charge $35). In the event that collection efforts are initiated against me, I shall pay for all associated fees at the posted rates as well as collection fees and reasonable attorney fees. I agree that the amount set forth in the space marked "Total Amount Due" is the total upfront price I have agreed to."
$110 was not to inspect our work but to clear the line beyond our work. The price should have been $825 but since she has spent so much with us we only charged the emergency fee.
Joseph Moore removed a non-functional Noritz Tankless Hot Water Heater and installed a new NAVIEN Tankless Hot Water Heater on Wednesday, November 16th,2016. My most welcome hot water was returned to me in less than 5 hours. Joseph thoroughly explained the new hotwater heater advantages over the old Noritz unit which was 8 years old. He was extremely polite and helpful in answering all my questions. A super nice guy!
