By way of background, Defender Security Company DBA Protect YourHome is an Indiana corporation that specializes in selling residential alarmsystems. We have been an ADT authorized dealer since 1998 that sells andinstalls ADT monitored security systems. Once the security system is installed,the contract is then purchased, billed, serviced and maintained by ADT. I have researched this accountand found that the customer called in the first time on 2/11/15 and wasinformed that she would need to speak to ADT Corp to change/remove the pulsefeature and lower her MMR (monthly monitoring rate). Ms. [redacted] refused to allow out customer careagent to transfer her. She called lateron 2/11/15 and was transferred to ADT Corp to schedule the removal of the pulsefeature. She asked for a copy of hercontract to be emailed and mailed to her home, I show that those requests wereput in on 2/11/15. I show that thecontract was emailed to the customer on 2/12/15, please make sure and checkyour spam and junk folders if you have not received it. I show that another agent in the customerloyalty department attempted to contact Ms. [redacted] on 2/12/15 and 2/13/15with no answer either time. We havespoken to ADT Billing and they verified that the monitoring rate has not beenlowered to date but all the customer needs to do is call them at 800-369-0996opt. 1. By way of background, Defenders, Inc. dba Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. In summation of the complaint, Mr. [redacted] states he attempted to cancel within the three days but instead was offered a resolution. He states the resolution was not honored and he had to pay almost $900 to cancel his services. After cancellation, he is receiving collection calls for an equipment charge of $451.11. Ideally, he would like to officially cut ties with Protect Your Home including a release from this past due balance. Mr. [redacted] contacted Protect Your Home on April 25, 2016 in regards to an ADT monitored alarm system. He was to get a free basic equipment package with the promotion. He paid $105.29 for the installation and scheduled the installation for April 30, 2016.The technician offered additional equipment beyond the basic package that would better protect the residence. The customer agreed to these additional services and agreed to make two payments of $422.74. The customer was offered a system downgrade when it was brought to our attention that they did not want the upgraded services. The downgrade was scheduled May 7, 2016. Based on the equipment removed, the customer was to receive a refund of $451.11 for the second payment and a refund of $317.99 toward the first payment. The total amount refunded to Mr. [redacted] was $769.1. Although Mr. [redacted] was refunded the second installment, he disputed that charge with his credit company. Because of the dispute, he was refunded by both Protect Your Home and the credit card company. He was receiving collections call to pay us back for what he was refunded by Protect Your Home since the credit card company already took care of it. Mr. [redacted] was thoroughly explained the past due balance and he advised that he would look into it and mail a check for the balance due. Protect Your Home never received a payment, so the account is now being forwarded to an outside collections agency. I apologize if Mr. [redacted] was inconvenienced during this process, but I appreciate the opportunity to address his concerns and help come to a resolution. DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. Mr. [redacted] alleges the fire and motion system from the previous system was never hooked up. Our records show Ms. [redacted] installed the system with a wireless system which I have attached what we installed as wireless system back in December. Our records do not reflect we took over Ms. [redacted] prior system. Mr. [redacted] called in and spoke to our technical support team in regards to the account advising his motion and smoke never worked. He requested us to come out and take care of the service. Our agent advised we are responsible to come out to service since we only handle service appointments so many months after installation. Our representative did speak to ADT CORP monitoring center in regards to the account and was advised their security advisor told customer it would cost to have his equipment fixed. They advise us the customer refused to pay for service. ADT representative did advise us that it was not our responsibility to service Ms. [redacted] account. ADT records reflect Mr. [redacted] did speak to ADT corp escalation department regarding the same issues and Mr. [redacted] was advised that they would install smoke and motion for them at no charge. ADT representative also offered 2 month credit on the account which Mr. [redacted] did accept. After reviewing the account out records indicate that Ms. [redacted]contacted our customer care department stating that she told the installationadvisor to put a sensor on one of the two windows on the 1st floor of herresidence. Ms. [redacted] mentioned that shehad a break in at the residence around May 1,, 2015 and some items werestolen. Ms. [redacted] requested that a security advisor come to her residence toadd additional equipment. Unfortunately,it is hard to determine what discussions took place during installation onFebruary 14, 2015 but attached is the breakdown of equipment installed inFebruary for your records. Ms. [redacted] did have service appointment on May 5,2015 from 11-3 PM and requested to have earlier appointment. Our customerservice agent did send an email to the security manager to see if we couldaccommodate Ms. [redacted]’s request for an earlier appointment. We receivednotification that our security advisor did show up on May 5, 2015 after 7 PM toupgrade her system. The technician installed two basic sensors and an additionalupgraded sensor that evening. Ms. [redacted] was experiencing trouble with thecameras and application that evening after the security advisor left. Ms. [redacted] contacted our customer servicedepartment the following day stating that she and the security advisor haddiscussed him coming out to the residence that evening to finish the upgrades.However, we did not have an appointment on the board to finish the upgrades forthat day so the customer service representative scheduled her service for theMay 11, 2015 but Ms. [redacted] was not satisfied with this appointment. Ms. [redacted]’s father called into our customer care departmentconcerning the issues with scheduling. Unfortunately, our local branch was notable to make the service appointment for the May 11, 2015 so she had to reschedulefor the May, 12, 2015. For the inconvenience we offered two $100.00 Visa giftcards and requested those to be immediate fulfilled with no further steps toobtain them. Our records indicate the visas had been mailed out on May 14, 2015directly to the address we have on file. Ms. [redacted] requested the cameras be removed on May 12thand we addressed her issue with the basement window. In effort to resolve thecomplaint, we have refunded what was paid for service on May 5 in the amount of$431.42. Dear Ms. [redacted], This letter is in response to the complaint no. [redacted] submitted by [redacted]. By way of background, Defenders, Inc. DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. In summary, Ms. [redacted] states that she has not yet received her refund for $105.93 and would like her funds returned. She states she would also like her fax located to restore her peace of mind because she believes Protect Your Home is trying to commit identity theft. Ms. [redacted] initially contacted Protect Your Home on March 18, 2016 in regards to an ADT monitored alarm system. It was not until February 13, 2017 when she called in to cancel her order. Her refund of $105.93 was submitted that day and she was refunded on February 27, 2017 at 10:03:30.657 AM. Ms. [redacted] contacted us on March 2, 2017 to follow-up on her refund. She was advised that it was refunded on 2/27/2017. She said she did not receive it although we assured it was paid out. The agent asked her to submit a copy of her next statement so we can see that the funds were not credited back to her. According to the fax, it only reflects transactions through February 27, 2017. The credit card company would not post the refund the same day we sent the funds. It can take them an average of two to three business days to process and make the funds available to her. This statement is not adequate. By now, she should see the funds applied. I have called her numerous times and have left voicemails. She has yet to return my calls. Unless she can provide a more current statement reflecting through March 10th, there is nothing further I can do to assist. I recommend that she call her credit card company to verify the funds were returned. I have included the fax cover sheet to prove that we received the fax. There was no attempt at identity theft. I apologize if she was inconvenienced during this process, but I appreciate the opportunity to address her concerns and help come to a resolution. DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. After review, the promotion you had received were for the $19.95 for the first 12 months. Defenders does issue a check of the difference between $19.95 and $36.99 for the first twelve months. That totals to $204.48 of a check that you will receive. The $108.16 shows as an authorized charge. That fee was the installation fee to bring a technician out to your home. All contracts are for 36 months any state that is outside of California. If you reside in California then the contract will stand for 24 months. I will issue out the $204.48 which you will receive within 30 days in form of a check. I do apologize for any inconvenience that this may cause. I want the contract null and void I was suppose to get an landline security system but they gave me a pulse. My nephew signed the contract and he is only 16 years old an adult was in the home at the time of instillation. I want the contract null and void because they did not put the right alarm system in my home and they let a minor sign the contract. I want the contract null and void because they did not give me the right alarm system that I spoke to them on the phone my reference number is 4305876 and the payment is wrong that was quoted to me.

Dear Ms. [redacted], This letter is in response to the complaint # [redacted] by [redacted] By way of background, Defenders, Inc. DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. In summary, Ms. [redacted] states she is being pursued for a contract termination charge and cancellation of her alarm service agreement. She states that this is at no fault to her and that she had mailed in a payment in December. She states that if this is not properly addressed that she will notify the military, media, and pursue a lawsuit. Ms. [redacted] initially contacted Protect Your Home on September 20, 2016 in regards to an ADT monitored alarm system. She paid a $106.80 installation fee and she scheduled the installation for September 28, 2017. A contract was executed on September 28, 2016 and the installation as completed. Prior to the cancellation, Ms. [redacted] had made no payments for her monitoring services. Her account was cancelled on February 3, 2017 due to non-payment and was sent to an outside collections agency [redacted]. Protect Your Home received her first payment of $318.76 for the outstanding balance on February 7, 2017. At this point, it was too late. Her account was already cancelled. Those funds will be transferred to the collections agency towards her final balance. She is currently being held to the contract termination charges which equate to 75% of her balance of contract. These terms are explained in her monitoring agreement. I attempted to reach Ms. [redacted] in regards to her concerns. I would like to discuss with her how she feels this was not her fault. At this time, it appears she did not pay and that is why she was cancelled and sent to collections. I am still open to discussing this with her in case there is something I have missed. I was only able to leave her a voicemail and look forward to her response. After reviewing the account I show Ms. [redacted] did call in on recent flyer she received on August 1, 2016 due to recent breaks in her area. The promotion she received does offer 7 wireless Sensor Package Offer for $27.99 for the life of their contract (does not include Quality Service Plan), PLUS a $100 visa gift card for signing up with Protect Your Home AND a second key fob. During the call MS [redacted] did advise she did not have a landline package and our representative did recap the order and advised “Depending on the plan you select the monthly monitoring can range from $58.99 to $36.99 landline service as well as $27.99” Our records reflect Ms. [redacted] did opt to upgrade her service to pulse at a higher monthly monitoring rate $52.99. Since Ms. [redacted] did opt to upgrade and she did receive the warranty on the account rather than $27.99 without the warranty our office is willing to offer the difference of landline service with the QSP. $36.99 and the difference of $52.99 over the life of the contract. We have entered a refund of $576.00 to be refunded to the initial form of payment we have on the account. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. Summation of Complaint: Owner of complaint disputes signature on contract. Alleges technician allowed a minor child to sign the contract. Acknowledgement of Resolution: In regards to Complaint #[redacted], we have carefully reviewed the matter and bring forth the following recommendations. We have previously addressed this matter with the client. It is not our process to ID individuals who sign the contract. If a party is acting on the primary account holder’s behalf, then any dispute that originates, is between those parties engaged in “implied” consent. We will acknowledge the contract as valid under the legal pretense…that a party left to act on your behalf has consent to make decisions in whole and in part. This is inclusive of signing a legal contract. Client not being at the home, during time of signature cannot soundly confirm or negate who signed. From a legal standpoint, “intentional and knowing” acts of deception will not void a contract. Our service tech is not required to ask for idea and would not know a party’s age. Therefore, we will hold that the signature is valid and pursue from that stance. Client has now introduced (2/12) the theory that she is unable to afford the Pulse feature. If you are dissatisfied with your decision to choose Pulse after several months of service, then you can work via ADT Corporate for a resolute in downgrade as previously stated. Client was installed on 11/20/15, and their billing is managed by ADT Corporate. As we do not have the ability to amend MMRs, client would have to work speak with ADT Corporate. They can be reached at 800 369 0996 (opt 1-billing). We will no longer continue to address this moot point. The decision will stand. We apologize for any inconvenience this matter has contributed. This response is in complete contradiction to what I was told at the time of install. I was told by the installer's boss, Justin [redacted] ([redacted]), before proceeding with the install that I had 6 months to get out of my contract and the installer, Julius ([redacted]), will completely corroborate my story.Since having dealt with this company I've read the Yelp reviews for the authorized dealer in the area. Every single review claims the same despicable untruthful behavior. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. In summary, the consumer would like the sales call to be reviewed and honored. I reviewed the sales call from 8/28/17. The customer was not advised there would be no taxes on the monthly monitoring rate. Taxes were not discussed on the phone call. The contract is held by Defenders for the first 13 months of services, meaning if anything happens to the equipment within the first 13 months Defenders will send a technician out to address the issue at no cost.
