Our records indicate that payments were being returned by your financial insitution due to unable to locate account This is usually the result of a keying error when entering the account information via the E-Customer Service website On May 19, 2015, our representative assisted you with making the corrections to the bank account information online and no further payments have returned due to this error
Our records indicate that your account had fallen seriously delinquent due to your failure to make payments on the account On March 19, 2014, you requested the account be closed, and per your request, we closed the account on this date However, due to the severity of your delinquency, the account was written off as bad debt on March 31, The debt of $was then sold to UDH, and outside debt buyer, on April 29, We have no record of any payment being received prior to the sale of the debt Additionally, any payments received after April 29, 2014, would have been forwarded to the debt buyer CFC no longer owns this debt and cannot assist you with the balance owed to the current owner Please contact [redacted]
Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below There is nothing in this response to address the error was on their part, as I did not "key" the account number in, but used the stored information which has been used in the past to successfully process payments Any "keying" error at that point had to be on their end Nothing in this letter discusses the $fee I am being charged There is nothing in this response the reporting to the credit bureau and explicit acknowledgement that this will be corrected The balance listed does not take into account the security deposit I paid which should be deducted from said balance Also I find it extremely funny that the very same day they received this response, the money miraculously reappeared in my bank account Regards,
All statements have pages, regardless of whether they are mailed or viewed online the first shows all account activity for that billing cycle and the payment remittance slip The back of the first page reflects required disclosures regarding calculation of interest, as well as, billing disputes And the second page will include any account activity that could not fit on the first page, as well as, any account messages or "important News" in this section is where your Annual Fee message appeared Therefore, our response to this matter remains unchanged as your account was handled in accordance with the Terms & Conditions of your account Please contact Customer Service at [redacted] if you would like further information regarding your Terms & Conditions
Our records indicate that on July 30, a Supervior closed the account and reversed the remaining balance Your payment history has been updated to remove the negative reporting after payoff in February This update will report to your credit file when the account cycles on September 17,

With respect to your concern over the payment hold policy, the Availability of Credit and Payment Holds is identified in the Agreement and provides the following: Availability of Credit and Payment Holds Generally, payments are credited to your Account on the date they are received Depending on the payment amount and/or how long your Account has been opened, and if you have previously made a payment that was not to honored for any reason, such payment will not increase your credit availability until we are assured that the payment has not been dishonored This payment hold will take up to seven (7) days If you use a payment service provided by a third party to deliver your payment to us, that third party may charge you a fee for such service; such third party fees will not be billed to your Account Credit to your Account may be delayed up to five (5) days if payment is (a) not received at the Payment Address or (b) not accompanied by the payment coupon portion of your Monthly Billing Statement Delayed crediting may result in late fees and additional interest charges and fees being applied to your Card Regulation Z requires a creditor to credit a payment as of the date of receipt, except if a delay in crediting does not result in a chargeC.F.R§1026.10(a) “Date of receipt” is the date the payment reaches the creditor Payment by check is received when the creditor gets it, not when the funds are collected (CPB Official Staff Commentary §1026.10(a)(i) If a charge is not imposed, a creditor may establish reasonable payment requirements [redacted] Regulation Z does not require a creditor to post a payment to a consumer’s account on a particular date C.F.R§1026.10(b)(1)Nor does it not require the credit line to be available on the date of receipt Accordingly, a creditor may refuse to increase the available funds for a reasonable period after payment receipt to ensure that the payment will not be returned This is precisely what CFC did No fees or interest were charged Regulation Z permits this practice; the Agreement disclosed it

I am currently a card holder and recently, and inadvertently, missed a payment by a few days As a result of the holidays I merely forgot In most cases I would expect some type of phone call I began to receive phone calls from an number that was calling nearly times per day for consecutive days at random hours The times I did not pick up, there was no voicemail The times I did, at least 8, no one was on the phone I repeated “hello” several times and then the call just disconnected Believing it to be spam I was about to block the number from my phone I decided to google the number and after reading the large number of complaints similar to mine, I realized it was from Continental Finance That’s when it occurred to me that I was a few days late on my payment I immediately made the payment; no harm no foul to my credit report However, if I had not done that search there is a good chance I might have just forgot to make the payment and would have never known the calls which left no message when I answered, and just disconnected when I did, were from this company This practice is disgraceful and a cynical person would believe that it was intentional as a way to keep people late and collect late fees Whether intentional or not, the practice is a disgrace and frankly embarrassing There appears to be a problem with the dialer that needs to be addressed ASAP
Since we have found that the information on the applications match contact information you have provided to the Revdex.com, we find insufficient evidence to substantiate your allegation that these applications were submitted without your knowledge Therefore, if you wish to dispute the inquiries placed on you credit file due to the applications submitted, please provide a completed police report indicating that you have been the victim of Identity theft from someone who had personal knowledge of your contact information, including your email address in which you would have received contact by CFC regarding the applications submitted in your name The completed police report should be sent to CFC, PO Box 8099, Newark, DE and must include your desire to prosecute any individual(s) found responsible for the theft of your identity
As stated in our previous response, you have already received a refund of the late fee and your account is now current No further action is required as we find that your request was to have the fee waived and the account current, which has already occurred This situation has been resolved Additionally, not all calls are recorded
