I purchased a used car that functioned at the time of purchase, upon leqaving I had 4 mechanical issues the next day. The car still ran but when I took it to the repair shop that the dealer informed me they partner with they did not fix the issue with the struts that was causing excessive clicking when rotating the steering wheel. I contacted them about the issue to get it corrected and they refused. They told me to contact multiple phone numbers and they would definitely help fix the issue but but they only promised me a callback two separate times and never did. Ultimately they told me that it would cost $300 and This all has happened in a time span of 7 days. I acquired the car on 08/11/2017

Purchased a 2003 *** from Cactus Jacks Auto in 3/2017. Veh had a broken gas gauge, window and headlight. Cactus Jacks said that they would have the repairs done once I signed the contract to purchase the vehicle. I tried taking the vehicle to their mechanic and was denied 6 times for repairs. Once veh was accepted, mechanic told me they changed the light bulb in the headlight and tested the gas gauge and that it worked. I explained that the gas tank had half a tank of gas and was showing empty. I was told I had to drive down to their office and take the veh to a gas station and fill up the tank and bring it back, which I did, and the gauge still showed empty. I was told that they trust their technicians and that they said there was nothing wrong with the gauge, but if I wanted to pay $300 they would investigate more. I told them I was not paying as Cactus Jacks promised repairs with purchase of the vehicle. I was given a paper that stated the light bulb was changed and the gas gauge was tested, this paper did not have any diagnostics or record of any testing done. The light bulb was never replaced, the gas gauge is still broken, the window is still broken. I contacted Cactus Jacks and told them that I would not have signed the contract or purchased the vehicle without these repairs being done and that they needed to help me. Cactus Jacks told me to deal directly with the mechanic and that there was nothing they could do. They told me that my contract was with *** and not with them. I reminded them that they sold me the car and made the promises while I signed the contract, they are telling me they have no responsibility for making me those promises for repairs. I even have a written IOU from them that states they will repair the vehicle. I am filing a separate complaint against the mechanic for lying about services rendered, and refusal to comply with Cactus Jacks promises of repairs. I am taking the veh to another shop for testing

Ms. purchased the vehicle on 3/11/2017. The vehicle was brought in on 4/04/2017 for an oil change. She was not experiencing any issues with the vehicle at that time and no other concerns were mentioned. On 7/14 the vehicle was brought in with these concerns: Check transmission, check gas gauge, check front left headlight, check A/C blowing hot. Based on the road test the transmission was operating properly at that time. No trouble codes for the transmission were found and no slipping was felt during the test. The vehicle was brought nearly empty of fuel. Once fuel was added the gas gauge was reading. The front headlight bulb was replaced. The charging port was found to have a leak. The port was replaced and the system was re-charged. The A/C was now working as designed. Attached are the two work orders for the vehicle.

The vehicle was in the customers possession for 4 months prior to being brought in for any repairs. We do have a 12-month 12,000 warranty for the vehicles that every customer receives. The warranty does have a Deducible of $299. The $300 that Ms. was referring to is the deductible for the warranty repairs. Ms. was not charged for any of the work done to the vehicle in July. If she has additional concerns we are willing to look at the vehicle to see if any repairs would be covered under the warranty agreement. However, any warranty related repairs would be subject to a $299 deductible.

When I test drove it I pointed out that the gas gauge was not working, the rear left window and the headlight. Cactus Jacks told me that they would cover the repairs after I purchased the vehicle. All of these issues were promised to me by Cactus Jacks. When the vehicle was taken in for an oil change in April, it was brought up to the mechanic that we needed to have the gas gauge and window looked at, but were told we would have to leave the vehicle for a week in order for it to be looked at and repaired, so we only had the oil changed. I did try and schedule at least 4 other appointments from March to June, but was told every time that I would need to leave the vehicle for a week, which I was not able to do. Once I purchased my second vehicle I took the Escalade in and told them they had 2 weeks to get all of the work done. When the vehicle was taken in there was half a tank of gas in it. I have a video of when my Fiancé drove down to the mechanic, took the Escalade to the gas station and filled the tank, took the vehicle back to the mechanic and showed them that the gauge still showed empty. When he showed the manager, on video, that the gauge was still showing empty, they told us that we would have to pay the deductible to have it repaired. I can provide the video showing that the gas gauge did not move once the take was filled, I also have the video of filling the gas tank with $40 worth of gas. This is unacceptable. I would not have purchased the vehicle had they not made the promises to get the vehicle's gas gauge repaired. I am asking that Cactus Jacks make the repairs that were promised, Gas gauge repaired, left rear window repaired, light replaced. I am willing to pay the deductible for the other issues that have now come about, because those issues were not known at the time of purchase. I feel that this is a breach of contract as I would not have purchased the vehicle without the repair of the gas gauge.

Attached are the Warranty documents that Ms. was given at the time of the purchase. It clearly discloses the Deductible for the warranty and goes over covered items and non covered items. Ms. states she "wants the things that were promised" attached is also a copy of the "WE OWE" The only thing stated in this document at the time of sale was the passenger rear window. The document states we do not offer verbal promises and the document is only valid 30 days from the date it was issued. The warranty would apply after that.

We are willing to repair the window even though the time has elapsed. Any other warranty work will still be subject to the Deductible.

Attached is also a work order of what the three items that Ms. is referring to would cost without the warranty.

I went to this location to purchase a vehicle on May 31, 2017 on the day I went in to put a $500 down payment when I went to drive off with a vehicle of a *** 2007 the car would not turn on and I had to receive a jumpstart from the salesman and for me if the battery does not work please come back in for a new battery the next day June 1, 2017 the battery did work June 2, 2017 I want to turn the car on for work and it would not turn on I was then 35 minutes late to work having to receive a jump from my insurance company I've been called the cactus Jack location on Bell spoke with the representative who said come in on your lunch and get a new battery I went in on my lunch at 12 PM where they in for me no one is in office right now they are currently at lunch and will return later on you need to come back when you get off I got off of work at 3:30 got to the location at 3:56 where I was informed the mechanics have gone home for the day and all batteries are locked upand would not be able to provide me with a new battery. I was told I could go and purchase a battery and I would receive repayment for the battery unfortunately I do not have the funds to go purchase a new one just putting $500 down payment on this vehicle. My boyfriend provide me with the money to go purchase a new battery when I put in the new battery the check engine light came on I went to *** to get the check engine light looked at I was told it was for a transmission circuit I then called the cactus Jack location to ask when I could come in he said money you can just drop it off I was given no information when I would get my vehicle return to me or what was going to be done with my vehicle. I called Monday left the finance manager a voicemail explaining I did not receive a new battery and that I would like to just return the vehicle and receive my down payment back. Adrian and Paul on Camel Back are great. They are fast and friendly and very outgoing. People literally walked in and and encountered with them for a brief moment and they made a sale just because of their hospitality.

I went into Cactus Jack's to buy a car they sold me a car that had transmission problems as soon as I drove off the lot I told them I did not want the car and I told them that I wanted to exchange it for something else that was not broken they denied to do the exchange and they did not to try to work with me

It is possible that the loan is actually being serviced by our sister store. If that is the case this will have to be referred to them.
