Signed snow plowing contract with shoveling in November of 2018. Have had to constantly follow up to get services when it snows two or more inches. In fact on October 31st 2019 no one showed up. Most recently it snowed on January 17th and as of today in the morning, my driveway had not been plowed. I eached out to owner and was assured twice it would be done by Saturday the 18th and it was not.

Business states issue has been resolved.

I hired them to install a pool in April of 2019. There was a start date of June 10th. They never got the pool installed. Now I’m sitting here with a partial dug hole and no pool. They are not returning my calls and have a sizable down payment that I would like back.

We hired Zimmers Landscape for our pool and fence installation, concrete work, and lawn grading/landscaping. The project completion dates listed on our contract are May 20, 2019 through August 30, 2019. The only contracted item completed as of 10/22/19 is the front driveway/sidewalk (which is only a small portion of the concrete work). None of the other services in our contract have been completed, and the contractor's excuses provided for non-completion by the contract finish date include weather, equipment breakdowns, sinus infections, food poising, childcare issues, other jobs, etc. The only work completed (driveway/front sidewalk) needed to be torn out and re-poured due to a fight that broke out among Zimmers employees during the concrete pouring process. The broken out concrete still remains in a 20' x 10' pile in our front yard. There has also been partial excavation work started on our pool installation (which is at a standstill), which leaves our yard in unsafe conditions for our family.

Hi. As we where doing the drive way and front walk we did have workers get in to a tif. As for the work that is done and not done.

the drive is done. Front walk is done. The big hold up to the back yard. The back yard had 33 full dump truck loads to bring the grade up 3-4 feet. We bulldozed the back yard and front yard. The back would need to settle for a patio to go in. In the front yard there was 40 full dump truck loads that we bull dozed and graded out like the back. All of this work was done on 2 full weekends. This work was not part of any of the original contracting we rented a bulldozer two weekends in a row and never got reimbursed for any of that as it was added on we paid the bill for the rental of the equipment which was $5,600.00 and then there is still labor on that. There will need to be time for all of the grading to settle.

Revdex.com:

I have reviewed the response made by the business in reference to complaint ID, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

In Mr. October 23, 2019 response, he did not address the real issue that he hasn't completed the contracted work, and that he has discontinued showing up to our home as well as responding to our pleas to finish the contracted work. He simply commented, "We bulldozed the back and front yard," and "All this work was done over 2 full weekends," and then he goes on to state, "This work was not part of any original contracting we rented a bulldozer two weekends in a row and never got reimbursed for any of that as it was added on we paid the bill for the rental of the equipment which was $5,600 and then there is still labor on that". The facts are that on April 18, 2019, a contract was executed between Scott, myself and Zimmers Landscaping which identified the following tasks and completion dates:

May 20, 2019: Installation of concrete driveway and front walk

May 31, 2019: Installation of stamped concrete patio

May 31, 2019: Installation of retaining walls

June 21, 2019: Installation of the pool

June 21, 2019: Installation of Fencing

August 30, 2019: Completion of grading/seeding/straw matting

August 30, 2019: Installation of plants, trees, and mulch

The only work completed to-date (10/28/19) has been the completion of the concrete driveway and front walk. Zimmers has yet to address the fact that the front walk is faulty (it pitches toward the home's foundation), which causes potential water damage to the foundation of our home. The terms of the Contract state "50% of the total price is required on date of signing contract. A final payment must be paid within same day of all services completed." The total cost of the Contract was $55,000. We paid Zimmers Landscaping $27,500 (Check #212) on April 18, 2019 per the terms of the Contract. Also per the terms of the Contract, no additional payment is due until all services are completed. ***'s Revdex.com response that he wasn't reimbursed for renting a bulldozer is completely irrelevant, as 1.) No payment is due until all work is completed; and 2.) a central principle of construction contracts is that when a contractor commits to complete work in exchange for payment of a firm, fixed price, the contractor controls its means and methods. In other words, Zimmers Landscaping committed to completing the grading of the front yard, side yards, back yard, two sides of the driveway and leveling the berm; so if they decided to rent equipment as opposed to using their own equipment, that is at their sole discretion and a means and methods decision that has no bearing on the payment terms of the Contract.

The fact of the matter is that Zimmers Landscaping was provided a down payment of $27,500 on April 18, 2019 (50% of the total Contract cost) to complete the landscaping and installation of our pool. They have Failed to complete all of the following contracted items, which were contracted to be finished to completion by August 30, 2019:

Installation of the concrete driveway and front walk to our satisfaction

Installation of the stamped concrete patio

Installation of the retaining walls

Installation of the pool

Installation of the fencing

Grading/seeding/straw matting

Installation of plants, trees, and mulch

The April 18, 2019 Contract lists the Drive and Front Walk to be a value of $14,000, which is the only work that has been completed to date. As a result, we requested repayment of $14,500, which is the difference between our down payment of $27,500 and the value of the Drive and Front Walk (even though the front walk will require being torn out and replaced), as well as the cost to have the 20' x 10' pile of broken concrete left by Zimmers Landscaping removed from our front yard. We continue to stand by this request.

We signed a contract with John to install a pool we bought from Allied Pools in West Allis. This contract was signed in May of 2018, as of August 2019 the pool is yet to be completed. John will constantly tell us we are on the schedule, yet no work ever happens. My biggest complaint with John is that he tells us whatever we want to hear, but never delivers on his word. How can you literally talk to us the night before, even the same day, state you will be out to work, tell us we are on the schedule and completely no show! This has happened multiple and multiple and multiple times. John is a con artist. Do not give this man any money! I come to find out not only did he take about $9800 from me and not deliver on the install, but about 6 other people. We are currently looking into "theft by contract." He's rude, cunning, full of lies and extremely unprofessional. My next stop is to contact the owner of Allied to ensure he is fully aware of the company that is representing them.

We hired *** in May of 2018 to install a pool we purchased through *** in West Allis. He began the installation back in August 2018 and the job still is not done. Its no where close. The pool is a current shell, the sides are bent and the walls are rusting and the bottom in now full of rocks and weeds. He promised us he would be back in the spring to finish the job, yet its now the end of July and he is nowhere to be found. You would think you would come out to survey the job, but I have yet to see him. My biggest issue with John is his commitment. He constantly says we are on the schedule yet constantly no shows. As of right now he is not accepting our calls, the job is long from being remotely finished and we are approaching fall with no work done on the pool since Oct 2018. He is horrible at communication, will tell you everything you want to hear and will never deliver! For a business owner, it blows my mind that you can tell someone the night before you will be there, only to never show and provide no communication! This has happened multiple times over the coarse of last summer, this summer and now with in the last 2 weeks. We were supposed to have our install this week, its dry, sunny and cool. He confirmed Monday, May 22nd he would be here but as of today, Thursday, July 25th he is yet to show. He took advantage of our family...we are out $9800!

Business states issue has been resolved.

My wife and I signed a contract with Zimmer Landscaping in June of 2018 for landscaping, grading, tree cutting and to install a driveway. To date, none of this work is complete and *** verbally states time frames which are never met. Now my city has given me 30 days to address all landscaping concerns or I will be fined on a daily basis. *** does not answer phone calls, has no way of contacting him other than by phone. He will not disclose his office location and already violated a written agreement that the work would be complete by June 1st 2019. He has not provided us with any documentation to guarantee completion

Business states they will reach out to the consumer to schedule a time to seed the grass, when it is not supposed to rain, as rain will wash the seed away.

On Sept 14, 2017 I signed a contract with John to do a complex retaining wall. We still had a chance to get it do before the winter season. But autumn passed, so did the following spring, summer, and the following fall, and now a second spring, we are into summer, and we have heard every excuse in the book. I agree with the first review, if I could give him a "0" I would because very little more then talk, promises, and excuses has been done!

If I could give John and Zimmers Snow Removal a "0" star rating, I would. In November, I found out that my husband would be having neck surgery in December and wouldn't be able to shovel/snow blow this season and since I am pregnant and due in April, I am also not able to shovel/snow blow. I called John and he did a great job explaining how accurate his team was with predicting the snow with his high tech system and provided me with a lot of background knowledge of snow removal. After talking to several other companies, we decided to go with John. Before we signed the contract, we made sure that snow would be removed and the driveway would be salted if there was more than 1" of snow. The typical is 2", but since we shouldn't be shoveling, we paid more for the 1" removal service. We also confirmed that snow would be removed by 6am (even if it was still snowing - they don't wait for the snow to stop before starting) so that we could get to work and they would come back as needed until the snow stopped. We had our first big snowstorm (about 5") on Saturday, January 19. At 9am, I called Zimmers to let them know that no one had been out to clear the snow yet and was told the workers weren't sent out yet due to the high winds and heavy snowfall still happening but we were on the list and someone would be out. We went about our day playing in the snow with our 2 year old and doing her daily activities and at 4pm, I realized we still hadn't been plowed out. I called Zimmers and spoke directly with John and he was surprised no one had been out and told me that the crew already came back but he will handle it. At 6pm, I called again and spoke to John and he said he would be out to do it in a half hour. Finally at 7pm, he arrived and plowed/shoveled our driveway. I was impressed that he rang the bell and gave me the money for this service and said it was on him this time and it wouldn't happen again.
Cut to yesterday (Weds, January 23), and we got our next snow storm, at least 5 more inches by 7am. At 3am, my daughter woke me up and I noticed our neighbors service was plowing and I was impressed and figured the roads must not be awful so we shouldn't have a problem. At 7am when my husband needed to leave for work, our driveway wasn't plowed. I called and spoke with John. He said someone would be coming out and not to worry. At 9am, I called again and spoke to John, who was very rude. He said to me verbatim, "Don't you realize the snow just stopped? The roads are awful and the city isn't plowing yet." I let him know I was very disappointed since everything he told me when I signed the contract was a complete lie. I let him know that other services on my block were clearly out and plowing and was shocked he couldn't get his crew there. He told me that the next truck that was available, he would send to my house and that he came out at midnight to salt the driveway so the snow wouldn't stick. I let him know that's fine if there's only an inch of snow, but with 5+ inches, that won't help. He told me he could cancel my contract and issue a refund and I let him know that left me in a bind as I physically needed the service and most companies are probably filled at this point in the season. I let him know I'd call other places to see if they had any openings and let him know. Luckily, we got a service that could squeeze us in for a quick plow but no shoveling (they arrived 5 minutes after our call) and our neighbor snow blowed and shoveled the rest for us. At 1pm, I called and let John know that still no one was out at our place to plow so we would be cancelling our service and needed a full refund. He said the office would have the amount to me by EOD and I would receive a check within 7 business days. I still have not gotten the confirmed refund amount but I will make sure to stay on top of the refund.
I definitely do NOT recommend this company. They are rude, unprofessional and do not follow through.

I signed a seasonal contract with Zimmers Landscaping on the premise that I would get a $45 credit for each snow plow visit from the total fee. Per *** Zimmer, the remaining funds at the end of winter would be used for summer landscaping work.
I paid $775 total fee and received 6 snow plow visits (I had to call *** to get each one completed) resulting in an unused payment portion of $505. I had *** quote the landscaping work and scheduled it twice. The cost would not have used up all the credit I had left. Both times he was a no show and now he won’t accept or return my phone calls to reschedule or get an explanation.

Zimmers Landscaping Response • Oct 19, 2018

Hi this is *** from zimmerslandscaping. I did meet with *** at the beginning of 2017 snow season to provide him with a snow contract. I did tell him if there’s any money remaining from the contract that he can use it for the following snow season or for any kind of landscaping that he would like done. He did reach out to our firm to get pricing on bed edging. I believe his wife met with *** and at that point *** and his wife went through everything they were looking to have done. *** did schedule work two times that I seen on the scheduling board I was not aware of if the work was or was not completed. *** does no longer work for our firm but if *** want a refund of the money or the work done I would be happy to do either one he would want.

Thank you

*** Zimmer

On June 13, 2018 I contacted John telling him I was going to with his proposal. He told me he would have a contract to me by noon on the 14th. Noon came and went. On the 15th I called him and he told me e-mailed it to the wrong person and that he'd drop it off at my house that day (on the 15th). The 15th came and went. On the 18th he told me he didn't drop it off because of the rain and he didn't want it to get soggy (which made no sense to me as not sure what his plan was . . . was he going to leave in driveway?) He then told me he's leave it in my front door that day. The 18th came and went. I called him on the 19th asking him when I'm getting the contract and used the rain as an excuse again and that he'd e-mail it to me when he got back to the office that day (on the 19th) and he'd call me when he sent it. The 19th came and went, no phone call, no e-mail. If this is what it takes to get a contract in hand, what kind of service would I be receiving? Wait . . . I can answer that, I wouldn't get any service. The initial consultation / verbal proposal was impressive, but obviously extremely poor follow-through after that. I wouldn't give any star rating, however, I'm forced to in order to submit my review.
