Your Property Caregivers LLC (Mark K and Dustin W) remodeled our master bathroom in late 2017. Mark told my husband and I that we had a lifetime warranty. Just over one year later, we discovered water leaking below the shower wall. Mark and Dustin repeatedly told us they had no idea what was causing the leak. When we determined that it was, in fact, the shower, Mark continued to say he did not believe there was anything wrong with the shower. He refused to do any repairs or replacement unless we signed a new contract and he told us that we would have to pay him to do the repairs when HE determined that there was nothing wrong with the shower. We therefore had to hire new contractors to repair the shower and replace the water-damaged insulation and sheathing outside of the shower. The shower repair required complete demolition of the shower and rebuild with proper waterproofing. This cost us thousands of dollars and months of lost use of the shower.
In response to the claim against your property caregivers Ohio. We visited the house several times for *** and even sent out a plumbing company which we took care of the cost at that time it was determined by the plumber that the leak was not coming from the shower or bathtub from what he could see. On the evening of April 4 we had a phone conversation and and in the phone conversation we talked about what further steps can be made to check out what the problem could be I offered *** the option of us coming out and removing the siding and seeing if we can find a problem from there her exact response was let *** and I discussed it and we will get back to you. We never received a phone call letting us know what their determination was as far as using us. A warrantee is provided by the company that does the work I explain to *** in my email to her just like buying a car if somethings wrong with it you bring it back to the dealership and they are willing to fix the vehicle under any warranty. Any issues that they had or that had come up we have always been there to take care of them. I am going to enclose a copy of the email where I am offering to take care of the work after we had not Heard from them from April until late July. I told them it would be very foolish of me to pay *** Labor when we can certainly fix the problem I was not going to pay another company to do the work. I don’t know of any warrantee in existence with the company would pay somebody else to do repairs that they are willing to do in capable of doing. In my email I gave them that option. Also *** and *** never signed a contract with us I was still gracious enough and thought it was the right thing to do to offer them coverage on whatever needed to happen. Please see attached email where we are 100% willing to do the warranty work.
Also in regards to the statement from July 16, 2019 *** is talking about me saying that I would have to have them sign a new contract in my email there is no wording at all of a new contract. But I did state to them on the phone is that we were willing to do the work if it was determined that the issue had nothing to do with your property caregivers Ohio they would be responsible to pay us for the work to repair the shower after it was torn apart which is a very normal process if the problem was not caused by us. Once again in my email it is established prior to her agreeing to have *** do the work that we were willing and able to take care of the problem. The email was answered immediately to avoid any problems and to avoid this type of situation seeing as though we have never been reported to the Revdex.com and value our commitment to our customers. When I sent out the email on July 18 with a response we were willing again to honor our warrantee.
n closing I would like to point out Even by there complaint to the Revdex.com we took every phone call we answered every email we went to their house every time. We never at any point refuse service nor did we ever not take responsibility by their wording it says we were not sure where the problem was coming from but we’re willing to take care of the problem. They continue to talk about a contract the only thing I ever asked for was if in fact the problem was not close by us that we would be reimbursed for our time to repair whatever we had to take out. In my final email to *** before any other work it started we 100% stated that the warrantee was provided through our company and we were willing to do the work if they chose not to use us that would be on their terms and they would be responsible. I believe that our company offered every possibility to look into and to repair the problem again under the warranty that we provided not having another company do the work. Complaint: ***I am rejecting this response because: We are rejecting the company’s offer because they did not offer to repair the problem. Their “offer” was in April 2019 when Mark K stated that he would not rip out the shower unless we signed a contract that said we would pay him to rebuild it when he determined his company was not at fault. He simply refused to do anything further without us agreeing to pay him. That was and is unacceptable. In his emails in July 2019, he never offered to do the work. He asked to see the estimate from the new contractor. After he reviewed their estimate, he stated that his warranty was only through his company and that it was our choice to go to another company and we should do whatever we needed to do as far as reporting him to the Revdex.com. He did not offer to come out and do the work at that time. We have paid another company to correct the problem and Your Property Caregivers Ohio owes us reimbursement for the defective shower that they put in and failed to correct.
