Refusal to assist in fixing my financed vehicle after months of trying. My Nissan has a cracked head and they have been so difficult that the Nissan dealership didn't even want to look at my truck. I have been without a car since April and my truck has been sitting at the Nissan dealership since then. I have lost jobs and almost my home. I have maxed out every credit card in my name to stay afloat and no one has been willing to help me. I have contacted the finance company without resolution. I have 4 kids and I am so desperate for resolution. Before this happened I paid every car not on time and had repaired my credit to almost 700 score and now my score has fell to 552.

To whom it may concern:

This letter is written in response to Ms. complaint filed with your office regarding herWynn's Extended Care, Inc. 's ("Wynn's") Wynn's Plus extended vehicle service contract, bearingthe above-identified number ("Contract"). The following shall provide you with the relevantclaim history as well as provide Wynn's position on this matter.

Under the Contract's terms and conditions, Wynn's is obligated to pay for a "Covered Breakdown"when "a Covered Part has a Breakdown during the term of this Contract." A "Breakdown" isdefined as "the total failure of any Covered Part to perform its function due solely to defect inworkmanship." A "Covered Part" is "an item listed as a Covered Part in the 'Covered Parts'section below," meaning that if a part is not specifically named in the Contract then it is not acovered component.

Further, under the "Your Obligations" section, it states that for a claim Ms. is "responsiblefor authorizing and paying for any teardown costs and diagnostic time to determine if the Vehiclehas a Covered Breakdown. If Administrator determines that there is a Covered Breakdown, thenWe will pay for the reasonable cost ofthe teardown and diagnostic time."

There have been three distinct claims made under the Contract.

On July 19, 2018, Paddock Auto Sales & Service ("Paddock") initiated a claim under the Contractwith a complaint that the Vehicle had an engine noise. Paddock reported that the Vehicle'salternator failed and needed to be replaced. Wynn's approved and paid for the cost to replace thealternator.

On June 10, 2019, Paddock initiated a new claim under the Contract with a complaint that theVehicle was overheating. Paddock reported that the Vehicle's radiator failed and needed to bereplaced. Wynn's approved and paid the cost to replace the Vehicle's radiator.

On July 19,2019, Columbus Nissan filed the third claim that has been made under the Contract.Columbus Nissan reported to Wynn's that the Vehicle was overheating and that there was coolant

Wynn'sadvised Columbus Nissan of the contractually required diagnosis procedures and that it mustdetermine the cause of failure to the engine in order for Wynn's to properly adjudicate the claim.On July 26, 2019, Columbus Nissan advised Wynn's that it would not perform any diagnosis tothe Vehicle and would have Ms. relocate the Vehicle to a new shop. Since that time,Wynn's has not heard further from Columbus Nissan and no other claim has been initiated by anyother repair facility.

As per your request, Wynn's has again reviewed this Contract and its claim history. It is clear, assummarized above, that Wynn's has fully and properly adhered to its contractual obligations ineach of the three claims. Wynn's approved the first two claims filed under the Contract. For thethird claim, Wynn's did not deny the claim, merely requested that the repair facility perform thenecessary diagnosis in order to proceed with the claim and that repair facility refused. Wynn'swill happily revisit this claim should Columbus Nissan or another repair facility be willing todiagnose the Vehicle and determine what failed so that Wynn's can adjudicate the claim. Untilsuch time, Wynn's cannot determine if there is a Covered Breakdown as defined by the Contractand cannot proceed with the claim.

So, it doesn't seem as though they are saying "NO". The repairs that are from 2019 look to be close to the same if not the same issue both times. So, them asking for a full diagnostic test to be done so they aren't having to pay for a 3rd repair later on for the same issue.
