Hello Mr. [redacted]: As a follow-up to our phone conversation, here are the additional details to my original claim...
(#[redacted]):1. There has been no communication from the business Wildhorse Gallery.2. The original notice for demand letter sent by certified mail on 1/18/17 is still in their mailbox, according to the post office on 2/11/17.3. I was told by my lawyer to send a second demand letter by [redacted] so that it would be delivered to their street address. (Steamboat residents and bisinesses receive mail in post office boxes.) That second demand letter should be there early in week of 2/13/17.4. On Saturday I was told the owners, S[redacted] and G[redacted], had talked to the artist about this situation.5. On Sunday, 2/12/17, I called my credit card company and was told the owners of Wildhorse had debited my account on 1/14/17, the date of purchase and then credited my account on 1/20/17. They did that against my express verbal wishes to not have my card reimbursed and at the same time I told them I would not pat the additional $1000.00 for the painting. They made a unilateral decision to reimburse yet they did not communicate this action to me. I have not received this credit card statement for the month.I'm furious that there has been no communication whatsoever from Wildhorse, no receipt of reimbursement. And that is not my wish. I paid for the painting, I have the receipt and I want what is rightfully my property. Ms. S[redacted] told me on Jan 16th that she would need my card to reimburse me. I told her no and then she goes ahead and does just that however I did not know she did that on 1/20/17 until 2/12/17!! I did not think businesses could do that. I suspect she may have even feel she has the right to sell the painting and the painting may have been sold.I now feel I have to expedite a small claims court filing if appropriate or contact the Consumer Protection Bureau with the Colorado Attorney General's Office (Colorado Revised Statute 6-1-101 and the following statutes) . I also plan to talk to the artist directly.
