*** ***’s complaint is with the shipping company (*** *** *** ***), not Westfire nor ***. A claim was filed with the freight carrier on behalf of Mr*** by *** (3rd party broker). They re-opened the claim three times and three times New England rejected the
claim. We shipped the items in good faith. Once shipped the responsibility is between the freight company and the customer. I’ve explained this to Mr*** several times. The email exchange is attached (*** Email), along with correspondence from New England Freight Company. Mr*** had the company deliver materials while not presentThe BOL was marked for residential delivery with hour notification, which required someone present and sign for product upon delivery and securing said property. Mr*** opted to have this delivered “in the garage” with a New England dispatcher. The driver could not deliver into the garage, since it was a gravel driveway and a liftgate and the truck could not drive over it. So the driver opted to leave the material on the driveway before a thunder storm. As a result the material was damaged. Again, this dispute is between Mr*** and *** *** *** ***. Once shipped, Westfire no longer has a responsibility unless a warranty issue arises (product defect or wrong item shipped). The carrier has insurance for these type of claims, but if they violate the BOL, the claims are generally denied. ***Attachments redacted by Revdex.com staf*
