They don't want to give me back my deposit, my application is incomplete and I haven't see the apartment. I don't signed any contract, they don't want to give me back my deposit
They supposed to ask you for deposit after you see the property, when the application is complete, and when you are ready to signed a contract.

Ms. Sharp along with Alberto Valles, applied for an apartment on Friday, 01/24/20 by submitting an application and placing the application deposit of $350 as required to hold an apartment. The application signed by Ms. Sharp and Mr. Valles, states the application deposit will be credited towards the security deposit upon move-in or refunded if the application is not approved. The application deposit will be forfeited if applicant provides false information on the application or other documentation deemed necessary for eligibility, fail to respond to requests for information related to eligibility, or applicant cancels the application before a decision has been made by the property or after the application has been approved. Ms. Sharp reached out to management that same night of the application, via text at 6:50 P.M., after office hours, requesting to cancel and expecting the deposit to be returned. Management explained to Ms. Sharp the policy on the deposit. Because it was after business hours, Ms. Sharp was instructed to please stop by the office the following business day, Monday, 01/27/20 to show her an apartment and further discuss business in which she agreed she would do.
Ms. Sharp was a no show and no contact on Monday, 01/27/20.
On 01/30/20, Ms. Sharp's co-applicant, Alberto Valles, reached out to management via phone call to explain that it was bad timing for their move; requesting that the deposit be refunded. Again, the policy on the forfeited deposit was explained. A screen shot of the signed application explaining the policy with applicant signature was sent to Ms. Sharp's phone. However, in the attempt to provide satisfactory customer service, management requested a special permission from upper management to allow the deposit to refunded. On 01/31/20, the deposit of $350 in the form of a money order provided by applicants, was refunded and picked up by Alberto Valles, the co-applicant.
Ms. Sharp initiated complaints and bad reviews on Western Sunshine Pass/Geronimo Trails prior to completing the communication process with management.
