Review: When we first agreed to this order we were told they could deliver with in a week as the items were in stock. After paying for the items in full, it took over 3 weeks for the first shipment to arrive. We found half the hardware was missing from this order and had to wait for the next delivery to fulfill the first order. The next shipment arrived 10 days late again and still no hardware was included to complete the previous order for our project. I had several promises from the owner [redacted] that our missing components would be delivered within a week. No deliveries were received so I had asked 2 different employees of Apex to contact Western States Garage Door Supply, and still no response back from anyone from the company. The owner was out of town as well as their customer service manager, but found out that the customer service manager would be back on Tuesday 10/14/2014 and would take care of our none delivery issue then. Contacted customer service manager, [redacted] on 10/14/2014, expressed our company concerns that our order had not been fulfilled and we have had a crew on the job site for 3 weeks waiting for delivery of missing hardware to install doors. Upon my conversation with customer service manager I was informed that only the [redacted] (Owner) could handle missing items from our order and he was out of the office for the remainder of the week. So, again I have a crew on site waiting to install garage doors that I have to wait another week without materials, because only the owner of Western States Garage Door Supply ([redacted]) can help me and he will not be back in the office until 10/20/2014. How can anyone stay in business this way I have no idea. I want other companies to know the issues that my company Apex USA has had with Western States Garage Door Supply so that hopefully they will choose to use another supplier the will delivery what was ordered right the first time and include all items ordered.Desired Settlement: All missing components delivered ASAP.

Apex USA opened an account with us in February 2013. Prior to opening
an account they ordered product on C.O.D. terms. After successfully opening an
account, we shipped product on the open credit account. This product was
shipped on November 20, 2013. Per the terms of their account, $7,627.15 became
due on December 30, 2013. It was not until April 30, 2014 that we received a
partial payment of $644.56. We received a subsequent payment of $1,000.00 on
May 5, 2014. Currently, Apex USA still owes $5,982.59 on an invoice that is
nearly a year past due.
Giving Apex USA the benefit of the doubt, we agreed to ship a third
order on September 16, 2014. However, due to their previous failure to pay,
Apex USA agreed to pay for the product in advance. Once we received the payment,
we shipped the order in full, via Old Dominion Freight Line. The order was
signed for by Apex USA, received in full, in good condition. Now, they claim
that parts of the order are missing. Having signed for the product as “received
in full, in good condition,” any freight claim filed on their behalf would be
denied.
Furthermore, in accordance to the signed Terms and Conditions of Sale that
they agreed to upon opening an account, any account with a past due balance
must be brought current, prior to our acceptance of any claim of warranty or replacement of any product under a freight
claim. We have reminded them of this, and they have failed to bring their account
current. Until the account is brought current, we will take no further action
on their behalf.
