Review: West Coast Servicing Inc. Trust has mailed me a bill for $5,727. The bill is dated 3/5/2014 and is for a 2nd trust deed, at an interest rate of 5%, and monthly payments of $856.18, with the first payment due on 4/1/2014. I do not have a 2nd trust deed on my home. I have tried calling numerous days/times in an effort to find out more about the bill, but no one ever answers the phone. I called my mortgage company, Bank of America to ask if they knew anything about this company or about the bill or about a 2nd trust deed, but they did not and could not help me other than to confirm I have only the 1st trust deed with them. I have reason to believe that I am the victim of a potential scam by West Coast Servicing Inc. Trust. Today I called the Huntington Beach Police but they said they could not help; they said since I have not paid any money, a crime has not been committed; that scams like this happen all the time.Desired Settlement: Information available on the internet has allowed me to research West Coast Servicing Inc. Trust and its owner Steve Kramer; research indicates this company is shady and has victimized many people. I urge you to investigate this company and stop them from continuing to abuse people.

In response to the complaint filed by Ms. [redacted] and the letter sent by your
office, West Coast Servicing, Inc., would like to advise that the statement that the
borrower received was just an informational statement, as required by Regulation X &
Regulation Z. These Regulations require us, as a mortgage servicer to provide the
borrower with informational statements whether they are making payments or not.
West Coast Servicing, Inc., does own and service the second mortgage for Ms. [redacted]’
property, located at: [redacted]. I have included a
copy of the Deed of Trust and the Note for your reference. Should you need color,
certified copies of the originals, those can be sent upon request.
At this time, Ms. [redacted] does not have any payments that are due; however, the balance
of her loan will be due per the terms of the attached note.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I have spoken with the woman who wrote the letter to the Revdex.com. She said a RESPA letter was sent to me in 2006 to advise they had bought the 2nd trust deed on my home from Countrywide. I never received such letter; had I received it, I would not have such a grave concern about this situation being a scam. I have been in contact with Bank of America and they have confirmed to me that I have only one mortgage loan with them. They also confirmed that they bought/took over ALL the mortgage loans from Countrywide. This includes my 1st and 2nd trust deeds (both were to Countrywide). I truly never knew West Coast existed until I received their March 2014 statement (see copy attached). Unlike Bank of America, West Coast Servicing never sent me any communication whatsoever to advise they were/are the new owner of my 2nd trust deed. The letter to the Revdex.com also states that the statement they sent to me is informational, but once you are able to review it you will see it is not - this is a real statement requesting I make a payment by a certain due date. The woman I spoke with says my account has a "big red flag" across it denoting that no payments are due on the account, and that the statement was sent to me for informational purposes only, as required by law. Sending a bill/statement/invoice without any explanation whatsoever attached is an extremely misleading business practice. A simple notation anywhere on the statement such as "for informational purposes only - no payment due per terms of loan" would have been very useful and would have saved a lot of time and trouble. If their system has the ability to "red flag" an account, it is logical to expect their system can generate a customer's statement reflecting "for informational purposes'. For all these reasons, I continue to believe West Coast Servicing tried to get me to send them money when no money is due. Until I receive verifiable proof from West Coast Servicing that they are owner of the 2nd trust deed on my home, it is reasonable for me to continue to believe that I am the victim of a scam.
