I filed an application with this business to rent an apartment along with a roommate. When filling out the application at the end it stated an application fee was expected with submittal along with a $199 holding fee deposit. It did not allow us to fully submit the application without a $199 holding fee deposit but did EXPLICITY state, and the business later confirmed to me my reading was accurate, quote " holding fee deposit is fully refundable in the case of application denial or a refusal to sign the lease within three business days of approval." So we were called on Saturday morning, 9/21/19 , to let us know we were approved and could move it, however after doing further research into this complex that whole weekend we decided to look elsewhere for an apartment, knowing the $199 holding fee deposit could be refunded by Wednesday, 9/25/19, because that would be the third business day since we were notified of approval on Saturday,a non-business day. When I contacted management to request my refund on Tuesday, 9/24, they said we were not able to get our refund because it has to be "three days from the time you submit the application". That is NOT what their application says and after explaining everything on the phone the lady I was speaking to said "There's nothing I can do..that is what my manager says". When I asked to speak to the boss who was giving her this information she said I could wait because he was busy doing something else. I asked her if she could answer if it makes sense that some needs to request a refund for something they haven't even been approved for yet because they did not contact us back or let us know approval within the three days from submitting the application because the application was submitted on Sunday, 9/15 and when we were called for approval was on Saturday, 9/21, a whole six days later after submitting the application. I was not able to speak to the manager to confirm this was correct because he was never done being busy after 30 minutes of waiting. I think you would agree this is not at all proper business etiquette or how to treat potential residents. I believe this place is just trying to take money from people by changing their minds on what is their policy on the fly to suit their needs to make easy money.
Good afternoon ***, Sorry I didn’t get this back to you yesterday. I located their file. He signed our rental Criteria form on the 15th of September that states their holding deposit will be refunded if the applicant cancels within 3 business days from the date of this agreement. We are open 7 days a week. They cancelled their application on 9/24/2019 which was 9 days from the time they sign the rental criteria form. Let me know if you need anything else. Thank you
I am rejecting this response because:
Regardless of whether or not the business is open 7 days a week, Saturdays and Sundays are not considered "business" days. Also the 15th of September is when the application was submitted not approved, as stated in the complaint. The wording of the document I signed states 3 business days after application approval not submittal.
