Waterfall Gardens did not install our walkways and patio properly. The water runs towards our garage and house. There are puddles of water in the walkway and patio. The patio has low and high levels which looks awful and are tripping hazards. We have had 3 landscapers quote the cost to repair all of the problems and all 3 have suggested starting over since there are too many problems. We are very upset with this entire ordeal and just want it to be done properly.
I have copies of emails that correspond with ***'s wife since the week following completion of the project which includes a punch list of items that we were out and adjusted based on ***"s walk around after he was out of the hospital. We have made adjustments, repairs--to work affected by work *** had done himself and didn't glue fittings together since the beginning. The last direct contact with *** I talked to him when he called me because he couldn't make it home for an appointment to look at the lone low spot in the back patio. I felt this low spot was created when we plate tamped to "ride down a few pavers they were concered with having edges up." His wife and I looked at things and I told her I would come up and plate tamp the far edge of the patio to provide the flow off of the patio. She agreed and I went to other appointments. Then a few miles down the road *** called and said he didn't want me to plate anything and that he had other ideas and he and his "strip drain installer" were going to lift the header row and check things out along the bottom of the drain. He asked if I would reset the header row without geotextile and I told him I didn't think it would stay put if we set it without geotextile but to call me after he and his drain guy were finished with their part and I would come out and see what we could do.
That was how it was left that he would call me and I never heard from him again. Then a couple weeks ago I get a call from ***'s attorney about the low spot and I told him the same thing. I was told *** would call me and we would look at what could be done and he never called. When I found this claim filed with Revdex.com I called his attorney and he had no idea that *** had filed anything but was headed out of town and told me he would try to get *** to meet with him and I at the house to see if we can work out the problem. I can't address a problem if communication is going as is indicated to me. We are happy to make sure our projects do what we have designed them to do and do it according to specifications. We have one low area in the rear patio and can address that either by tamping out or checking the flow for sure and lifting and raising the area of brick. Nothing else was brought to my attention after we did multiple adjustments.
There was no call to us the day this complaint was made unless they never left a message or just hung up before talking to someone. The history through the emails and their times and dates show our response to questions and I will put it up against anyone. I am now waiting for ***'s attorney to get back to me this week so we can reslove this but the resolution is not going to be any refund as they have a 95% completed properly patio and walk.
Dear Revdex.com; We just received your response stating that our case has been closed. We had not heard back from you due to e-mail server problems until today, October 21st. This case needs to be reopened. Waterfall gardens has made such a mess of installing our patio, walkways, garage apron and a circle with pavers that we are very upset and feel that they can not redo all of the problems without removing everything. We recently met with the owners along with our lawyer on Tuesday October 17, to discuss all of our concerns. Our lawyer kept asking them if they could fix each of these concerns and they did not seem to respond confidently that they could. We plan to meet with them again to go over how they will fix these problems. We have had two other contractors provide estimates in repairing all of the slope issues, the puddles, the wavy patio, pavers that are tripping hazards, the pattern issues that look very unprofessional and both contractors came to the same conclusion that they would have to tear everything up and start over. Not only did they do a bad job of laying the pavers without planning the layout, leveling the patio and walkways correctly and determining the proper slopes that water would not run back into the garage and to the house but they caused damage to a water drain pipe and with excessive tamping against an existing structure caused seepage of water into that building. We would like to have you reopen this case because it has not been resolved and we feel that Waterfall Gardens should refund our money so that we can hire another contractor to do the job correctly. We believe that this matter will end up in court due to them refusing to pull everything out and doing it right. We thank you for your time and appreciate that your bureau can listen to customers that have had contractors provide poor quality workmanship and not stand behind their work. We honored our part of the contract by paying them and they have not honored ours by doing a good job. *** and

I am rejecting this response because:
While you and your brother were here with us and our attorney we addressed all of the issues that you received in the extensive list of problems and you admitted that the slopes were incorrect and now your saying that the problem does not exist. That was the list of problems you should have been taken notes on. What was the problem? The issue really is: HOW ARE YOU GOING TO FIX THESE PROBLEMS!
Tom boasts his credentials but why did you perform such poor quality on this job. Explain the reasons for the pitched pavers the wrong direction allowing water to flow back to the house, puddling on the patio and walkways, poor planning of the paver layout, uneven surface allowing tripping hazards and the wavy like a roller coaster patio. Does this show that this was done by a highly experienced craftsman? Other certified hardscapers agreed that all of the walkways and patio would need to be pulled out and redone to do it right. How are you going to resolve all of these issues? Why should we have to accept a poor quality job?
