In August 2015, Mr. [redacted] was interested in a 2004 [redacted]
that was on our lot. Mr. [redacted] took the car for a test drive and he liked it
but wanted his mechanic to check it before he purchases it. We didn’t have any
problem with that at all. After coming back from his mechanic, Mr....

decided to buy the vehicle since his mechanic told him that it is in a good
shape and that he should be happy with it.
On August 20, 2015, Mr. [redacted] purchased the vehicle with
106,751 miles on it. The vehicle was sold to Mr. [redacted] with a Motor and
transmission warranty of 30 days or 1,250 miles whichever comes first. We,
also, offer third party extended warranties on all the cars we sell, but Mr.
[redacted] declined the extended warranty coverage on his vehicle.
On September 8, 2015, Mr. [redacted] brought the vehicle to our
service department since it would not start. The vehicle needed a battery and
we replaced it at no charge.
A couple of weeks later, Mr. [redacted] called and told us that
his car caught on fire while it was not running and that he wants his money
back. Mr. [redacted] had the vehicle towed to us. Our service department checked
the car and found signs of burns on the hood that seemed unrelated to any
possible mechanical issues. The car had close to 109,000 miles on it which puts
it over the warranty period, since it was driven over 1,250 miles that the
dealer is required to warranty under the used vehicle law.
Mr. [redacted] had his insurance company adjustor stop by our
shop to check the car. His insurance adjustor took pictures of the car and
recorded the odometer reading on the vehicle which shows close to 109,000
miles. The insurance adjustor, also, mentioned that the burn signs are on top
of the hood and not under the hood which seemed a little strange.
We advised Mr. [redacted] that we don’t do body work at our
place and that since his car is over the warranty period of 1,250 miles, it is
best for him to work with his insurance company and a body shop of his choice
to do the necessary repairs on his car.
Attached, please find a copy of the warranty statement along
with the Registration form (RMV-1) showing the mileage of 106,751 of when Mr.
[redacted] registered the car.
