At the time of the show he was informed that there would be an application fee and an admin fee applied to the account. This is to run the application, and for the time it takes for our team to proceed with the next steps in his application process. Knowing this information *** proceeded with the application process. While applying online, the paperwork on the application states, “All application fees or other holding fees, also referred to as earnest money, that are collected are non-refundable.” *** signed the document clearly stating that this would not be refundable. This was listed before the money was taken from his account as he must sign the documentation in order to proceed with the processing. Upon approval, our system automatically withdrawals the money from the same account that he has listed and agreed to paying the remainder of the fees to secure the apartment for rental.This earnest money is to ensure that if we take the apartment off the market, said applicant will move in. This being why the money is non-refundable until after the initial lease term is competed, successful move out of the apartment has been completed, and no damages have been made to the apartment. *** then called and demanded that this money be returned to him, at which time I explained to him what was listed above.
