The day before closing,lender emailed an invoice from *** for $. He stated this was interest for NOT closing on home on date he wanted.
The day before closing, my lender emailed an invoice from Mr. Dennis Walker for the amount of $3,167.16. He demanded this money for interest fees for not closing on our new home on August 28th, 2017. Please keep in mind, there was never a specific closing date listed on the contract, and therefore, this is invalid. Mr. Dennis Walker instructed the title company (*** in Lindale ,TX), not to provide keys until this invoice was paid. With less than 24hrs before closing, we didn't have much choice, so we paid him this money and signed. I was advised that if we didn't sign, we would have been put as default of the loan and lost our down payment; and the house. I find it very unprofessional and unethical to send an "invoice" the day before closing. This is fraud! After we signed, paid, and got our keys, we went to look at the home, and found it dirty, back door broken/damage, windows unlocked and no screens on, etc..... it looked like an abandoned home. This man needs to be reported and suit for his actions. I know of another client that he built for, and he robbed them too.
this interest has no validation but we were obligated to pay.
In response to Mrs., the original closing date was set and given to us for August 28, 2017 by Mrs.. Mrs. was also instructed that any and all additional work done at her and her husband's request not listed in original contract would be extra due from them at closing. They received the first invoice on August 3, 2017 for all the additional requested work and materials which had no interest listed at that time. We were told a day before closing that their funding (lender which is *** at *** responded that Mrs. hadn't turned in all her loan paper work) was being held up and she was at this time informed there would be interest added until closing since it was not going to close at the original closing date due to their funding being held up because of her lack of returning paper work to lender. The house was thoroughly cleaned for the original closing date. Everything was to be completed for the original closing date. However once we were informed that the funding was not going through at the time some things were left unfinished until closer to the new closing date. On the date they closed everything was completed before they took possession.

This is not TRUE,we were NEVER informed of any interest fees for not closing on August 28th.. Per ***, she was supposedly unaware of this, but as I told her,we feel like Dennis Walker and her are partnered to commit fraud. A similar incident happened with another client of Dennis Walker, his name is ***, but we found about this later. The lending office did NOT get any papers to close until Aug 3rd and per ***,closing takes 30-45 days anyways, so there was no way we could have closed on August 28th. Then, the appraisal took forever, I submitted everything to ***'s office, and blew up their phone almost every day. They dropped the ball and let time pass while Dennis accrued interest without us knowing. I have emails to prove everything I am saying. This invoice for interest,which is our argument,is invalid and this man needs to be held accountable for doing fraud. We had no choice but to pay, othewise we would have lost our downpayment and the house. In addition to Dennis Walker charging interest, the house was NOT ready, and I have pictures to prove it as well. We want our money back from this man.
