reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that he was misled by a Vivint representative regarding contract and cancellation terms, and now is unable to cancel his agreement. Mr. [redacted] desires cancellation of the Agreement without penalty.Vivint’s records indicate that Mr. [redacted] signed a System Purchase and Services Agreement on September 9, 2016 with an initial term of forty-two (42) months, a monthly services fee of $49.99, plus any applicable taxes, during that term, and a total equipment fee of $689.99. Vivint provides a Right of Rescission period immediately following installation of the equipment, during which time a customer may cancel the Agreement for any reason. Section 4 of this Agreement states: YOU MAY CANCEL THIS AGREEMENT AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION.Vivint’s records further indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on September 9, 2016.During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty-two (42) months. He also represented that he would pay a monthly monitoring fee of $49.99 each month during that term. Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement. Cancellation of Mr. [redacted]’s agreement without penalty is not warranted at this time. A representative from Vivint has recently attempted to contact Mr. [redacted], in an effort to resolve these concerns. Should Mr. [redacted] wish to cancel his agreement prematurely, his payoff amount would be $1449.71; however, in an effort to assist Mr. [redacted], Vivint is willing to lower his payoff amount by 40%, bringing the total payoff amount to $869.82. Alternately, Mr. [redacted] has been offered a reduced monthly rate by 40% bringing his monthly monitoring fee to $29.99 for the remainder of his initial term. I am rejecting this response because: Thank you for updating me on this this issue. The Business' (Vivint) response is unacceptable to me. Below, I have stated my reasoning. I would gladly offer the $75. for arbitration; but, because they sold my contract to a collection agency, I don't know if arbitration is possible. Perhaps, you could let me know if it would do any good. I do thank you for you help.In response to the email you sent me dated Dec.15:I acknowledge that I signed this contract, thinking it would protect me and my property. However, there are several misstatements by Vivint. 1) " ... did not inform Vivint there was a problem." I did from the first week when the front door alarm no longer worked. I was told to buy new batteries, which I did. Still didn't work longer than a day. 2) " that I ALLEGE technical difficulties,... and a break-in, and the window alarm did not go off." How can it go off, if the windows, according to the contract, were never wired? The window is still broken. I have pictures. Nor is the shed, which was also included in the contract. I told them this several times in letters after I stopped the bank draft. They NEVER addressed the issues I had with the contract to give me what I signed on the dotted line for. All Vivint had to do was send a tech out to check all this out. I told them in a letter I would gladly reinstate my service if they would comply with what was in the contract.SO, Vivint sells my account to a collection agency, clearing them from any wrongdoing--failure to install what was in my contract. This is so wrong. I have learned, even at this old age, never to use a company or service without first verifying with the Revdex.com.

In his complaint, Mr. [redacted] states he was experiencing equipment issues which Vivint did not resolve. Mr. [redacted] further states he has requested cancellation of the account, but Vivint denied this request sighting an Agreement with a five (5) year term. Mr. [redacted] does not recall agreeing to that term. As such Mr. [redacted] desires cancellation of her agreement without penalty.A representative from Vivint has recently attempted to contact Mr. [redacted] in an effort to resolve his concerns. At this time, Vivint is willing to remove the account from collections and close the account without penalty. Vivint’s records show that Mr. [redacted] signed a Purchase and Services Agreement upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of sixty (60) months. He also represented that he would pay a monthly monitoring fee of $68.99 each month, plus applicable taxes, during that term. Vivint contacted Mr. [redacted] on July 10, 2017, regarding his request to request to upgrade the cameras in his home to outdoor cameras. Given Mr. [redacted] would need an upgraded panel in order for outdoor cameras to be added to their account, the representative directed Mr. [redacted] to the Customer Loyalty department. Additionality this representative offered to cover the cost of one outdoor camera. Vivint’s records further show that Mr. [redacted] stopped making his monthly payments after June 2017. As such, the account was cancelled for non-payment on November 29, 2017. Despite the above information, in resolution to this matter, Mr. [redacted] has no further obligation to Vivint. He may contact Vivint’s representative if he has any further questions or concerns. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that when a security camera in his home ceased functioning a replacement was sent by Vivint. He further explains that he was not instructed to return the old camera and is now being charged by Vivint for the full price of the replacement. Mr. [redacted] requests that he not be charged for this camera.Vivint’s records indicate that a replacement camera was mailed to Mr. [redacted]. When this camera was shipped on September 20, 2017 an email was sent to Mr. [redacted] at [redacted] containing instructions for the return of his nonfunctioning camera, a return shipping label, and instructed that if he did not return the old camera within thirty (30) days he would be charged full price. The faulty camera was not returned by Mr. [redacted] as instructed and he was charged for the product. A Vivint representative has contacted Mr. [redacted] in an effort to resolve his complaint. I am rejecting this response because:Complaint #[redacted] My response is the same as it was a week ago,I have yet to be givin an appt. time when I am home the only times they offered were between 8:00am-12:00,& an adult 18+ must be present+ I want to me present & Vivint already was a NO SHOW on the 1st service repair visit& I made arrangements & took off a day of work & lost 1 days pay to be present on Fri. Sept. 2nd between 8:00-11:00am I did NOT receive no phone call to inform me they were not going to make it! I will not miss work again waiting around for a tech to show up& then waste 4 hrs for a no show! Last week the Vivint technician came out swapped out both cameras(the issue for Revdex.com complaint) & gave my wife&i his mobile #,and stated to call him for any issues we have,since he is the tech. In our area who would be coming out& I left a message with him this past Monday-9/26/16& have NOT heard back from him! I simply want a set of cameras that work as described per Vivint & per what my monthly cost is& if they can provide me with a system that works I will stay with them,HOWEVER if they cannot & im willing to give them 1 last attempt at installing new cameras or fixing the 3rd set so that they do function & if not then please be informed I want all equipment removed & made whole! I have the original boxes that all equipment came in,still sitting in same spot from original day of installation,so simple give me a properly working system or remove the whole system & return any monies lost,thank you sincerely [redacted]

Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint Mr. [redacted] states that he did not renew his System Purchase and Services Agreement (“Agreement”) for an additional forty-two (42) months and that Vivint has a fabricated phone call of him agreeing to extend his Agreement. Mr. [redacted] desires cancellation without penalty. Vivint agrees to cancel Mr. [redacted]’s account without penalty as an act of goodwill. As of the date of this letter Mr. [redacted]’s Agreement has been closed and he has no further obligation to Vivint. Vivint’s records indicate that Mr. [redacted] called into Vivint on January 19, 2013 to reschedule an appointment that was intended to have a technician replace batteries in his equipment. During this phone conversation a representative offered Mr. [redacted] a $5 discount to his monthly service fee, an upgrade of his account to Premium Service and an additional door sensor for his home at no charge to Mr. [redacted]. In exchange Mr. [redacted] agreed to extend the term of his Agreement by forty-two (42) months. Vivint read the following statement to Mr. [redacted] to which he responded affirmatively. “You understand that this call is being recorded, and you agree to extend the term of your Agreement forty-two (42) months from today. No other provisions of your Agreement have been changed and this amendment constitutes the new Agreement between you and Vivint.”Despite Mr. [redacted]’s representations during his extension phone call Vivint agrees to the above resolution. She further explains that she has moved from her home and can no longer utilize her system. She requests cancellation of her account with no penalty.Vivint’s records indicate that following the installation of the equipment, Ms. [redacted] completed a telephonic Post-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Post-Installation Survey, to verify certain information regarding use of the system and other important details. Our records show that Ms. [redacted] completed the required Post-Installation Survey on July 1, 2015. During the recorded Post-Installation Survey, Ms. [redacted] represented that she was satisfied with the installation of her system. In addition, Ms. [redacted]’s signed Purchase and Services Agreement explains that it is the customer’s duty to notify Vivint if there is a problem with the system, and that she may request a service visit (Sections 5, 12). Vivint has no record of Ms. [redacted] requesting a service visit, or notifying Vivint of her equipment concerns. As such, cancellation of her account without penalty is not warranted at this time.Vivint is willing and able to relocate services to Ms. [redacted]’s new residence. Vivint is willing to waive the usual $99 fee to move these services. Alternatively, should Ms. [redacted] wish to cancel her Agreement prematurely, her payoff amount would be $2144.67; however, in an effort to assist Ms. [redacted], Vivint is willing to lower her payoff amount by 50%, bringing the total payoff amount to $1072.33. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
My family cannot express enough gratitude for all efforts made to resolve all issues with Vivint. We thank you so much for your timely response and services.A legal assistant with Vivint stated by telephone on November 30, 2017, that not only will I be reimbursed for the damages created by a Vivint technician, by a contractor of my choice, but that we are finally allowed to cancel all services with Vivint, without paying a penalty, which we will hold Vivint accountable for. Effective immediately, our Vivint contract has been terminated, and all Vivint equipment will be removed on December 17, 2017. We are incredibly thankful to no longer be paying for Vivint services that we are not receiving.The Vivint legal assistant was very clear, understanding, and submitted documentation regarding my damaged front door frame and cancellation agreement. In section 17D of Ms. [redacted] agreement it states, “Alarm systems and monitoring service may not always operate properly for various reasons”. Vivint has and appointment scheduled for Ms. [redacted] to resolve the concern with her doorbell camera on February 15, 2016. Cancellation without penalty is not warranted at this time. Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted]. Alternatively, should Ms. [redacted] wish to continue services, Vivint is willing to credit Ms. [redacted]’s account $[redacted]; three months of Ms. [redacted]’s service fee. Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] signed a System Purchase and Service Agreement (“Agreement”). Every customer must sign this Agreement, and if a customer does not sign the Agreement, Vivint will not install any equipment in the customer’s home. Our records show that Mr. [redacted] signed his Agreement on February 26, 2015. By signing his Agreement Mr. [redacted] represented that he understood and agreed to the initial term of sixty (60) months. He also represented that he would pay a monthly monitoring fee of $69.99 each month during that term. In addition, Mr. [redacted]’s Agreement explains that it is the customer’s duty to notify Vivint if there is a problem with the system, and that he may request a service visit (Sections 5, 12).Despite the above information, Vivint has cancelled Mr. [redacted]’s account and he has no further obligation to Vivint. have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted]’ complaint she explains that she had issues with the sales representative as well as her mother’s name being on the account. As such, Ms. [redacted] requested that her mother’s name be removed from the account and for Vivint to clear the balance on her account as well as shortening her contract length.A representative from Vivint has recently contacted Ms. [redacted] over the phone in an effort to resolve her concerns. Vivint’s records indicate that this matter is being resolved to Ms. [redacted]’ satisfaction.
