On March 7, 2020 *** of Veracruz Auto Sales sold me a 2008 orange Dodge ram 1500 truck on the premise that if I replace the O2 sensors that it would be able to pass inspection. Upon driving it for a day and a half I realized that it was losing coolant into the exhaust and emitting smoke which meant that there was more wrong with it than just the 02 sensors. So it would not pass inspection. I tried contacting him on March 9 but he did not return my calls so on March 10 returned the truck and requested to cancel the sale and have my $2000 down payment returned to me. He refused and told me he was going to hang me with the truck and all financial repair responsibilities or I could pick another vehicle. I told him I do not want to do business with him anymore because of his business practice and his treatment to me. I told him I want my money back but he refused again. I left the truck at his shop. He now has the truck (that won’t pass inspection) and my $2000. My wife and I have tried multiple times to get our $2000 back but he has been very demeaning and aggressive to us both and refuses to give us our money back.
Mr. purchased our truck. He saw the advertisement on Craigslist, where it was offer for sale as a clearance item, where it was represented that the check engine light was on and it needing mechanical repairs before inspections would pass. Mr. represented that he works as a mechanic and that he could do the work himself. He used his own mechanics' OBD2 scanner, which he had brought with him, to look up the check engine codes and he clearly told us that it was O2 sensors and that he was satisfied that he could fix it. Mr. conducted two lengthy test drives of the truck that same day. We gave Mr. a $1000 price discount in Lieu of any and all repairs which might have been needed. Thus the sale price of the truck was $3950 and not $4950 as Mr. claims.
We had intended for the truck to be sold as cash only, but Mr. insisted that he wished for us to finance the truck for him and we did that for him at the same discounted cash price. He paid us $2000 upfront and the remainder would be paid in payments.
Mr. kept calling us and spoke with our employees. Mr. only wished to speak to the *** and would act very uncooperative and hostile to our employees. On march 10th, I reached out to him and told him that although he had purchased the truck "AS IS" that we would do all we could to help him in the interest of customer service. The only option he wanted was to get his money back. We offered him alternatives since we have a no-refund policy. He told us that "you are going to hang me with this truck?" and I told him I would like to help him fix his truck. He then made a lengthy phone call to someone and came back seriously angry and uncontrollable. He threw out all his personal belongings, threw the truck key at me and then walked out very angry down the highway. I offered to give him a ride but he just told me to keep the "*** truck and his money". I told him that we did not wish for him to lose money and that he should work with us. His one and only position is that we are crooks and he does not trust us. His father in law called us the next day and told us that Mr. is a disturbed man and that it was a mistake for his daughter to marry him.
During this entire episode no-one including myself was demeaning or hostile to them despite several calls from the Mr., his wife and his father in-law calling us every name in the book.
We stand to do all that is reasonable to help this customer, but he insists on spitting in our eye every time we reach out to help. In

I am rejecting this response because: *** still has my $2000 and the truck. I do not want the truck as it was falsely advertised. I told him I was a boat mechanic. And for him to use that as an excuse to sell me a lemon is downright wrong. I don’t understand all these accusations he is making about my wife, father in law and myself. All I want is my $2000 back. He will not have any problem selling the truck because while I was there he received multiple phone calls for it. He also stated that he would return my $2000 once he sold the truck. *** return my $2000 and we can be don’t with this. Thank you.
