Initial Business Response /* (1000, 5, 2015/11/23) */
All sales are finalThis is posted throughout the store and on every invoice printedIf a customer buys something then leaves it for however long it is left to its own devicesMr*** states that our employees loaded the furniture
without his consentMr*** was present the entire time and could have stopped this but chose to have the young men load while he watchedOur employees do not load things on their ownThey are directed by the customersI can assure you these young men were not looking for extra work or like loading furnitureThe alleged damage was to a leg on the couch and could easily been fixedAs I stated all sales are final and we will not be returning and moneyThe vendor has already been paid for the saleMr***' couch is still on our premisesWe will hold until December 15th and then it will be donated
Initial Consumer Rebuttal /* (3000, 7, 2015/11/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I did not give express consentWhen they began loading furniture I assumed it was store dutiesI also assumed the store would be responsible with my furniture, moreover, I had no reason to anticipate store would not compensate me for their neglegence toward my purchaseI informed the management that by breaking the furniture I no longer had a use for itManagement behaved insincere to me and accused me of neglegenceI do not believe this is a fair practice toward patrons
Final Business Response /* (4000, 9, 2015/11/25) */
Mr*** should have loaded this himselfAs he stated it was his and he did bring someone to help. The only one negligent was Mr *** for not taking care of his propertyThe items that we sell in our store are not oursWe sell them for individualsWe have no way of knowing what condition they are inAll items are sold as is and all sales finalI have spoken with the manager and she feels she was sincere but there was nothing she could do as all sales are finalI have spoken to the vendor whos furniture this was and they are not willing to give a refundWe sign a contract with the vendors and agree that we will not give refunds unless they approve the refundI would be willing replace the leg for him with someone of my choosing
Final Consumer Response /* (4200, 11, 2015/12/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This business is unfair and unreasonable to its patronsI have already stated my reasons for feeling this wayThey should hold some form of liability if merchandise is damaged while under their careWhile they have small signs in various parts of the store stating all sales are final, they should also have large signs posted everywhere that state the store is not liable for any damages to merchandise caused by the store so that customers and vendors can make informed decisions should they consider exchanging merchandise here
