In review of the complaint, we always look to conduct our business practices in a fair manner and strive to ensure that our tenants have a positive experience while at our properties.In determining what is fair, there are some assertions in the complaint that are incorrect First, the employee named in the complaint was not terminated for continually misleading tenants Second, this tenant signed an addendum before mothat acknowledges that he is receiving and un-renovated apartment at the time of move-in, and may later be moved to a renovated apartment Because the unit was not renovated at the time of move-in, the tenant is getting a rent reduction of $per month until a renovated apartment is ready.The issue of apartment condition will be investigated by senior management The condition, as described in the complaint, is not consistent with company standards Once the investigation has been completed, senior management will work with the tenant to arrive at a fair solution

Complaint: [redacted] I am rejecting this response because:I signed a lease for an apartment under the guise of misrepresentation and advertisingThere was no meeting of the mindsWhat was disclosed to me on 28th of May by The [redacted] ’s then Leasing Coordinator, [redacted] ***, and in the presence of both [redacted] and [redacted] ***, was not was fulfilled I specifically stated to [redacted] that I was not interested in the unrenovated apartment (most akin to that of room 203)I signed because I was told by [redacted] that I would be moved into the renovated room (similar to that of room 1011) by the end of summer As I have begun contacting my neighbors, I am now learning that this in not an isolated incident, but rather a pattern of dishonest behavior and conduct that has been going on for yearsSimilar promises of refurbished rooms have been made to other tenants back in 2014, and even beyond that Attached are photographs of the renovated apartment (room 1011) as well as the room which I am currently residingThe pictures don’t require a label to know which images belong to which roomI would have taken pictures of both apartments with the same Camera but The [redacted] refused to let me re-enter the model apartment I was previously shown to take picturesThese are the pictures that [redacted] (the property manager) supplied me withI believe they are adequate As you can see, the room I am in now has some serious habitability issuesApart from the obvious differences of the floors, cabinetry, paint, countertops, fixtures, floor coverings, etcwhich were supposed to have been “representative of the general quality, quantity and type of construction and materials which Landlord intends to use in the Apartment to be leased to Resident” (#Model Disclaimer in the lease agreement), the condition of the room is so terrible, it is boarding uninhabitable There is mold in the bathroomThere is a hole in the kitchen with open tubing and electrical pipe protrudingThe facet in the kitchen leaksThe broiler in the oven is brokenThe outsides of the windows are so dirty they are difficult to see out, even in the morningThere is exposed electrical for the A/C unit in both the bedroom and the living roomOne of the screens was repaired with duct tapeThere is deterioration along the frames of the windows as well as a serious build up dirt and residue (no doubt from the lack of maintenance)The room smellsI’ve had issues with bugs getting into the house because of the terrible screensThe bathroom door does not lockThe hot and cold shower nozzles don’t adjust properly (the showers are either boiling hot or freezing cold)I made a very light reporting of these issues in the form I was issued from The [redacted] (I don’t know the name of it, it’s just the condition of the apartment form), but I did not press any of them, because I was expecting to be moved up in a short timeThe truth is—the [redacted] has never had any intention of moving me into the refurbished apartment as promised—nor, apparently, have they with any of the other tenants that have lived here eitherOne of the only good things about my room is that it has brand new carpetIf the [redacted] really was going to renovate the place, as they told me they were going to, then why would they bother throwing money, hundreds if not thousands of dollars into new carpet into my room and others, if was only going to be ripped up and replaced with hardwood floors? I have asked for a reasonable compromise from The [redacted] and they have refusedNow I want justiceI want a termination of my contract, my full security deposit and a return of the money from the months I have already paidI never would have moved into this place if I had known I would be stuck in it Despite what they my claim, they knew that they had a lying, blatantly dishonest former employee (more than one, as it turns out) and I have come to suspect that they too conduct themselves in similar fashionIf [redacted] was not let go for the before mentioned reasons, then why was I told that he was by [redacted] on Saturday, September 1th 2016? What possible motive could he have had in divulging such information? I am beyond the point of simply being upsetI am now motivated to expose these racketeers for the crooks they areThis complex is schemeSomething must be done Sincerely, [redacted] ***

It is our understanding that the resident that issued the complaint received a rental concession and acknowledged in writing that the situation has been resolved

Since the last response, the Regional Management team that oversees our operations in Utah tried to address the concerns raised by the tenant. After several conversations it was clear that there was not a path that would satisfy the tenant other than being release from his lease. Ultimately we agreed to terminate the lease without penalty. While we don't agree with many of the facts as presented in this particular circumstance, the bottom line is that we want our tenant's to enjoy their time with us. The tenant who filed this complaint should know that we have every intention to transfer each existing tenant to an upgraded apartment. This has been a very difficult project as we have continued to encounter one obstacle after another related to bureaucratic red tape. If this were up to us it would have been completed two years ago. That being said, we continue to move forward and internalize the significant financial burden that these delays have created while attempting to do our best to create a positive environment for our tenants. I trust that this issue has now been resolved

In discussing with on-site staff, they acknowledged the issue and had a licensed exterminator perform multiple treatments to address the issue. The most recent report indicated that the issue has been resolved.The tenant skipped on the lease despite that fact that the issue was being actively
treated and is responsible for the term of the lease
