This is Universal Technical Institute’s (“UTI”) response to the above-captioned complaint filed by [redacted] ***, ***, who was an applicant for enrollment at UTIMr [redacted] contends that in March 2015, he was denied enrollment because of his ethnicity and veteran statusUTI denies this allegationIn fact, Mr [redacted] was denied enrollment because of his lack of professionalism in his dealings with UTI and its staff as well as UTI’s concerns that he had not demonstrated the qualities necessary to complete a rigorous academic program at UTIBetween August and March 2015, Mr [redacted] repeatedly enrolled, canceled his enrollment, re-enrolled, failed to start his coursework, and exhibited other erratic behavior on numerous occasionsMoreover, from time to time, he was rude and used foul language with UTI staffIn late 2014, Mr [redacted] again re-enrolled at UTI for a January 20, startOn January 12, an admissions representative spoke with himDuring the conversation, he seemed confused about his start dateHe stated that he thought he was scheduled to start on February 20, not January When advised that UTI did not have a February start date, Mr [redacted] hung up on the admissions representativeBecause Mr [redacted] had made the admissions representative uncomfortable, the Campus Admissions Director took over communicating with himShe met with Mr [redacted] to discuss his planDuring this conversation, Mr [redacted] again seemed very confused and unable to focus on the conversationHaving made little headway with him and having learned that Mr [redacted] is a military veteran, the Admissions Director referred him to an admissions team know as MARC that specializes in working with military veterans, hoping that they would have more success in understanding Mr***’s academic plan, assisting him with overcoming barriers to implementing his plan, and then following through with his planUnfortunately, Mr***’s behavior with the MARC team over the next several weeks was equally confused and erraticFor example, the MARC team worked with Mr [redacted] to get him re-enrolled for a February start, but Mr [redacted] again canceled his enrollment on the first day of classes, explaining that he had gotten a job as a janitorThereafter, the MARC team tried to contact Mr [redacted] several times, but he did not return their callsMr [redacted] re-surfaced in mid-March 2015, stating that he wished to re-enrollAll who had dealt with Mr [redacted] at UTI agreed that, based on his past unprofessional behavior, he was unlikely to be successful at UTI and should be denied enrollment at that timeOn March 18, 2015, a member of the MARC team spoke to Mr [redacted] over the phone, stating that he was not confident that Mr [redacted] was in a position to start at UTI and persist through the academic programMr [redacted] argued with the admissions representative, and stated that he was going to go to campus that dayThe admissions representative asked him not to do soMr [redacted] rudely hung up on the admissions representativeDespite the admissions representative’s request that he not go to campus that day, Mr [redacted] went anywayThe Admissions Director agreed to meet with him, but arranged for a third person to be present, as Mr***’s erratic behavior and prior statements that he and his family were gang members caused the Admissions Director to be concerned for her own safetyFor the same reasons, she also notified UTI’s police resource officer of Mr***’s impending arrivalDuring their meeting, the Admissions Director told Mr [redacted] that UTI was denying his application for enrollment at that timeMr [redacted] asked whyThe Director explained that UTI believed that Mr [redacted] was not a good fit for UTI because his history of unprofessional behavior did not comport with UTI’s standards set forth in its student Code of ConductBy way of example, she referenced his behavior that day in coming to campus despite being asked not to and hanging up on the MARC team admissions representativeMr [redacted] responded that he thought UTI was discriminating against him because of his ethnicity, Mexican and FilipinoThe Admissions Director told him that was not the caseMr [redacted] then left campusMr [redacted] lacks any reasonable basis for his claim that his ethnicity or veteran status played a role in UTI’s decision to deny him enrollmentUTI is an equal opportunity educator that enrolls students of every ethnicityIndeed, it has a team of admission representatives who specialize in enrolling military veteransQualified military veterans and persons of all ethnicities are welcome and encouraged to enroll at UTI

When a student withdraws and or does not start a program we are required to do a full and complete refund of all fees irrespective of the items being returned.  We have already done a full and complete refund for this individual that was inclusive of his shirts and safety glasses.

Universal Technical Institute is in the process of attempting to resolve the claims made by the complainant in a mutually acceptable manner.  UTI will provide an update if the matter is in fact resolved.

Review: The [redacted] . U T I School leased 12 nice running driving cars from us, for one year, to be returned running driving and sale able. The 12 cars were returned late and destroyed. After months and months to get their final answer...the U T I legal office in [redacted] refuses to pay for the damages or even the lost rents.. PLEASE HELP !

Please see the entire 11 page package we faxed to you on 10/1014 recieved by [redacted], a nice lady in your office.Desired Settlement: If we do not have to file lawsuit, right now we will settle for JUST the fairly prorated lost rents....over $14,800.

Review: UTI #: [redacted] said arrived on buss 13. I walk and received a hair cut & HE call back and said Don't arrived. I walk over there anyway & SAC PD was there. I talk to [redacted] in person and some other person; they SAID: they were not going to accept A Mexican & Fillippino American Veteran. A 10% discount was not on The contract.And Sub Ways bath room did not work.Desired Settlement: That are going too sent mine transcrips & I have their shirts & safty glasses. [redacted] $/\~.THANKS
