Car got repossessed by dealer after he bought off the loan from bank that was financing me without my consent. When I contact dealer he stated that “he thought” we were 30 days late, and that he was forced by the car financed bank to buy off the loan.
The customer financed a 2011 Chevrolet Traverse. The loan company was ***, they offer high-risk subprime loans with recourse with a network of participating dealers. The recourse offed by the bank is in an event the customer pays the 1st payment late they have the legal right to repossess the vehicle, after multiple attempts to contact the customer to advise the payment hasn't been made. No communication was returned by the purchasing party. *** contracted a repo company for payment default, it was then the customer had finally returned the phone calls due to the vehicle being taken away. By law, any money given toward will be forfeited when a contract becomes defaulted with no payments and or late payments.
I am rejecting this response because: I want to apologozed for the miss information the dealership is giving. I have attached a copy of the letter I got from the bank stating they had re-assigned the contract back to the selling dealership. So therefore the car was repossessed by the dealership as I had original stated. This is the same roundaround we got from the dealership when we contact them of why they had repossessed the car. *** the sells man told us he "wasn't aware" but after we called the bank (after hanging up eith him) *** told us the dealership had bought out our loan in January 6. When we contacted *** again after talking to *** he was very nervous and started stuttering and when we ask why they repossessed the car he said "the only reason why was because (the payment) it was 16 days late, but to be honest I thought it was 30 days". The bank has nothing to do with the repossession.
The bank which is *** has a 1 pay recourse if the customer doesn’t send the first payment the dealership is forced to buy it back. We are in business to sell vehicles not to buy back repos from the bank we just sold a car to. We had to pay for a new key made and for the repo. Mr. can ask the bank himself why the vehicle was repo from him. After all fees we ended up paying close to $6700. If he wants the vehicle he can have it for less amount we always hold the vehicle for 30 days in case the customer wants it back. When we were forced to buy back the vehicle from *** because of the customers 1st non payment we don’t know how long it has been that they haven’t gave a payment because we can no longer get exact information we can call a representative from *** and try to see if they can give us info but sometimes they will give us info and sometimes they won’t. With that being said if customer wants the vehicle back he can buy it back for $5000 plus tax and license cash. I’m willing to take a loss for the rest so he can see we are not trying to take advantage of anyone and it was not our decision to void his loan with the bank.
