The document [redacted] presented as a "gift card" is not a gift card. The email sent to her was a reminder that if she downloaded our "VIP App" she would be entitled to a $5.00 discount at our store if she presented the VIP App on her cell phone. The document [redacted] calls a gift card and...

presented with her Revdex.com Complaint in fact states it is "$5.00 MYUNIQUE VIP Dollars" and clearly states it is "Eligible for VIP App members only." No where did the email to [redacted], nor the document [redacted] presented in her Revdex.com Complaint, was there a statement that, "they were to be printed out and cut out to be used at the store."

I am rejecting this response because: I already had the VIP app on my cell phone and it was not posted to same.  Many people I have spoken to had the same thing happen to them.  I sent you the ad that was sent to my e-mail address clearly indicated scissors around the coupons and no bar code that would be necessary if it were on a cell phone.  The Unique stores have very unstable business ethics.  But someone told me that I should snap a photo of the ad on my cell of the e-mail, and then they honor it.  WHATEVER!

I am responding to the Complaint made by [redacted] to the Revdex.com of New Jersey with respect our Unique Thrift Store located at [redacted] (Case ID No. [redacted]). Our company goes to great lengths to make sure that all customers are aware that our store sells...

second hand merchandise. Every customer who purchases electronics is encouraged to test the item before they purchase it, and are directed to electric outlets in that area of the store to do their own testing. Our employees are not able to make assurances to customers that an electronic item will work to their satisfaction. To make sure our customers are aware of the fact that we cannot provide them with that assurance, every electronic item in our store has a white label with red printing affixed to the cord stating, “THIS IS A USED ITEM ALL ITEMS ARE SOLD “AS IS” THERE ARE NO GUARANTEES. NO EXCHANGES NO REFUNDS ALL SALES ARE FINAL INSPECT THIS ITEM CAREFULLY”. This label would have been affixed to the cord of the monitor [redacted] purchased from our store on October 28, 2014. In addition, to ensure all of our customers are aware of our company policies, throughout the store there are very large signs stating “NO REFUNDS OR EXCHANGES” and “ALL SALES ARE FINAL”. Finally, when [redacted] selected this monitor for purchase he signed a Unique Thrift Store furniture ticket listing the item to be purchased (the monitor) and the price of that item. [redacted] signed that furniture ticket. [redacted] would have taken this furniture ticket to the cashier so the purchase could be finalized. Attached is a copy of the furniture ticket [redacted] signed. “EVERYTHING SOLD AS IS” appears above his signature; “ABSOLUTELY NO EXCHANGES OR REFUNDS” appears below his signature. When [redacted] purchased the monitor from our store, he was completely aware of our company policies of no exchanges or refunds. He was aware that he was purchasing a used, second hand item. He was aware that we could not give him any assurance that the monitor would work to his satisfaction. [redacted] purchased the monitor knowing he could not return it for a refund or exchange. [redacted] wants us to provide him with preferential treatment and give him a refund of $21.39. We will not treat one customer differently than any other customer by providing [redacted] with refund. [redacted] even tried to coerce our employees to ignore our company policy and refund his money by making false allegations about the personnel in our store and threatening to “contact immigration about their employees”. This is disreputable conduct on [redacted] part. Our company complies with all federal, state, and local employment law.
