In response to your letter of July 8, 2015, please be advised we are not in agreement with the facts as stated. Troika Stone & Surfaces, Inc. entered into a contract with the client on January 13, 2015. (see attached Estimate No. 526) Client came to our facility and laid out their...
respective countertop pieces and approved the soapstone and marble to be used. Perimeter countertops and Island were installed on March 25, 2015. Countertops were completed in accordance with the contract and customer approved the installation without any issues. Payment was made in full by Check No. 400 dated March 25, 2015. (see attached Installation Sign-Off Sheet and copy of check) After completing the installation, the client asked for an additional piece of soapstone which we provided at no cost. In addition, they brought to our attention about the gap behind one of the pieces of installed soapstone. (see attached email dated March 26, 2015) The job was satisfactorily installed as evidenced by the Installation Sign Off sheet dated March 25, 2015. Despite completing the project per the contract, Troika Stone had techs out to the property on two separate occasions to assist the client in addressing the gap behind the countertop, however the client has refused to allow us to add a piece of stone as an infill or skim the wall with plaster to make it true and plumb. Our firm has been in business for over 5 years without a single complaint filed against our firm. We are very proud of our reputation and the quality of our workmanship. The client approved the workmanship at the time of installation, we provided them an added piece of stone at no cost and offered to assist them with the existing field condition all in the interest of maintaining a positive customer relationship. For the client to file such an action at this juncture is completely unprofessional and borders on slander.
