Company was hired to install glass stove top which was broken during the installation due to admitted negligence of the company owner/operator
On March 7, 2014, this company was hired to install a glass stovetop at my residence.
[redacted], owner/operator of the company, agreed to perform the work for $90. Homeowner provided a brand new, BRAND NEW GXXXXXXX, XXXXXX-XXX Viking Designer 30" Top Assembly - DECU105-4BSB which was still contained in the original box with the original protective plastic wrap attached to the unit. The purchase price was $450.00 on Ebay.
During the installation, Mr. [redacted] called homeowner and informed her that he had cracked the stovetop. As a result, the stovetop was unusable and he was unable to finish the installation. Due to the negligence of Mr. [redacted], the stovetop is no longer a usable part and must be replaced in its entirety. Mr. [redacted] informed homeowner that it was his fault and he apologized for breaking the unit. Homeowner informed him that she paid $450 for the unit. Mr. [redacted] informed homeowner that he had already called Viking for a replacement part and the cost was $550 plus shipping.
Mr. [redacted] then told homeowner that he would pay for half of the new replacement part and would waive his $90 payment fee for the installation. Homeowner informed him that this was an unacceptable arrangement. When Mr. [redacted] failed to convince homeowner that she would be responsible to pay for half of the replacement cost for a new unit, he informed her that he would only pay $450, the amount that she paid for the unit. Homeowner informed him that there was no available replacement unit for $450. Mr. [redacted] then repeatedly refused to pay the full amount required for replacement of the unit.
On March 11, 2014, homeowner purchased a replacement for the unit which cost of $578.78 from the Viking Company. Home owner sent Mr. [redacted] a text message informing him of the replacement cost of the unit. Mr. [redacted] refused to pay $578.78. Mr. [redacted] insisted that he was only responsible for $450 which was the actual cost of the unit NOT the replacement cost of the unit.
According to TapCo Insurance Company, Triple C Appliance Repair LLC company does not have "Work Product" insurance coverage with Tapco. Therefore, Tapco insurance company will not cover the claim. Homeowner has requested from Mr. [redacted] his license number and bond insurance information. Mr. [redacted] refused to give this information to Homeowner.
On March 11, Homeowner sent Triple C Appliance Repair LLC a certified letter documenting the incident and requesting payment for the replacement unit in full in the amount of $578.78 and also requesting Mr. [redacted]'s business license numbers and bond insurance information.
