Response:
Triad Toys is a retailer of action figures and dolls and accessories. We sell primarily on our website at triadtoys.com. On 7/26/2012, Mr. [redacted] placed an order on our website for 2 products. A copy of the invoice can be provided at your request. One product is a pair of doll boots ($6.99) and the second product is a set of 2 doll dresses ($19.99) and the total shipping charge was $2.95. The total of his order was $29.93. His order was promptly shipped out and received. On January 4th, 2013, (5 months after), Mr. [redacted] contacted us via email and stated that the doll boots were defective. We kindly responded that our warranty on the plastic toy boots was only for 30 days. However, we were willing to work with him, but the problem was that the doll boots were sold out and no longer available and we were willing to issue him a refund for those doll boots. We further offered to refund his total shipping charge for the entire order and a refund was made in the amount of $10 ($6.99 for product and $2.95 for shipping). After he received the refund, we did not receive any further communication from Mr. [redacted]. On June 26, 2014, we received another e-mail from him stating that he would file a complaint against us for another product. We responded and noted that we have no other orders on file from him. We can provide a copy of that email and response if needed. Mr. [redacted] has filed complaints against us through the Consumer Protection Board, the District Attorney of Santa Clara County, and virtually every law enforcement agency he can find. We have repeatedly asked Mr. [redacted] to give us a receipt or order number to show what other products he claims that he purchased that is defective. We have all of our orders documented through the website and Quickbooks and we have no other orders from this customer. The one product that he claims is defective – we have already issued a refund on so we are not sure what his complaint is.
