installed patio and waterproofed parents home and patio in Sept 2017. Home now for sale and observed patio slab is sloped and sinking as of 5/4/2019. *** came to house and looked at it and said he could do nothing abut it because it wasn't cracked. he has not attempted to rectify or correct matter at all. It is affecting sale of property.

We went over and did waterproofing we told them it had to sit for a couple days maybe a week. They said they wanted us to hurry up and do it. So we went ahead and this was in 2017. Now that is has settled. The patio didn't sink in 2018. We told her the dirt was going to settle. Now she wants us to replace it but if she would have waited a week we wouldn't have to replace it. I'm not responsible. She called me and I went over and looked at it two months ago.

*** put in a failed product. He is correct it needed to be done in timely manner because property was going up for sale and he knew time was of the essence. It took *** almost over two months to get project done. h told me when I signed contract ,it would take 2-3 weeks tops. His crew came on first scheduled day and then from that point on, they wouldn't come for two/three days or a week a time. When they did show, they would work an hour or two then leave. He may have put in several hours on this project only a couple of times. So when he installed patio (poured cement), he rushed it and even a admitted he should have waited for ground to settle. I would have waited but he booked himself with so many other projects he didn't want to lose money on and put this patio install on back burner. I called him, texted and sometimes would get response back while this project was going on. He usually had a very rude disposition. The waterproof job he did was acceptable but the patio was garbage. His attitude was terrible and I feel as a professional contractor, he should have tried to come up with some kind of a solution for a job he was pain $9500.00 to do. Every person who looked at that patio after it was installed said it would either crack or sink in two years and they were absolutely correct. It finally happened. I would like *** to pay back the money it took for me to replace the patio on the house (see photo attached). New patio stalled end of last week. Because of this situation, it added delay to property being acceptable for sale. Buyers expressed concern about ***'s patio and question integrity of property's structure- which is fine. It was just his very poorly done patio. *** is showing his greed and inability to provide customer service. he was paid in full and didn't have to chase to get paid, why do we have to be robbed of a functioning, beautiful patio that should have lasted for decades, if done right? If tables were turned and he had this patio installed I his home for this amount of money, he too would be rightly disgruntled. Thank you
