Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaintSpecifically, MrB [redacted] ’s response is unsatisfactory for the following three reasons: MrB [redacted] chose the wrong glue for the project, which means the problems with the glue have existed from March 18, when the project was completed At the time of the most recent repairs to the stones, Leeroy represented to my father, Larry, that MrB [redacted] had relied on the advice of a salesperson at Menards about which glue to use for the project Unfortunately for MrB [redacted] , the salesperson at Menards was wrong about which product to use MrB [redacted] should have known the proper glue to use for the project as a result of his experience and expertise, or at least should have done his research on the correct product rather than relying on the advice of the salesperson at Menards MrB [redacted] ’s lack of diligence in selecting the proper glue for the project is what created the problems we are having with the stones For these reasons, this is a workmanship issue As MrB [redacted] admits, he had notice that the glue was improper for the project at least as early as May (approximately months after construction had been completed) MrB [redacted] further admits in his response and in text messages to my husband that the glue was not working because it melts in heat As soon as MrB [redacted] knew that he used the wrong glue for the project, he should have repaired each and every stone on which the wrong glue had been used He did not Instead, he chose to repair them on an ongoing basis as the repairs became necessary MrB [redacted] has demonstrated his original intent to repair the stones on an ongoing basis—rather than all at one time—by continuing to repair the stones as they fell off both before and after any alleged warranty expired The statement that Leeroy made to my father at the time of the most recent repairs is consistent with that intent and course of conduct Specifically, Leeroy represented to my father that he had consulted with MrB [redacted] about future repairs and that MrB [redacted] had indicated that they would continue to make repairs as needed in the future Despite this representation, his prior representations, and his course of conduct, MrB [redacted] now has refused to repair the most recent set of stones that have fallen off our seating walls and columns as a result of MrB [redacted] ’s use of the wrong type of glue for this outdoor project.For these reasons, MrB [redacted] ’s representation that we are no longer entitled to “free repairs” is inaccurate and unacceptable As such, we continue to request that MrB [redacted] repair the new stones that have fallen off—at no cost to us—with the proper type of glue and that the repairs continue to be ongoing as the glue inevitably fails in other locations on the seating walls and columnsIn the alternative, we request complete repair of all remaining areas of the walls where the wrong glue was used, at no cost to us As we mentioned in our complaint, an estimate we have received of the cost for the repairs of all identified defects in the seating walls and columns exceeds $6,Regards, [redacted] ***
1.Work was comnplete on 03/18/Our warrentee is for workmanship only, Material Failure is under the Manufacturers warrentee. On 5/some of the Pavers were "sliding off as the temps got hot outside and ity was deemed glue failureHowever we repaired the loose pavers free of charge
several months later a few more came loose and were also fixed free of chargeNon of the pavers repaired with the new glue moved. I do think that merely gluing the stones back on the wall is going to fix the problem permanently. The stones will just fall off again. We need to come up with a better solution. I had a contractor look at my sitting walls and he advised me that the walls are shifting and moving, causing several stones to come loose, because there wasn't enough concrete poured in the ground to create a flat base. He advised me that the proper way to fix the sitting walls is by taking them down, pouring more concrete at least 7" into the ground to create a flat surface and prevent the walls from shifting, and then building the walls back up. He quoted a price of $2,to perform this service. In order to make the walls right, I am requesting that you pour concrete 7" into the ground and redo the sitting walls. Approximately stones have come loose from these walls over the past year, including approximately that are currently loose at this time. You have previously been out to fix the walls on separate occasions to glue the stones back on the walls. This has only been a temporary fix Please respond to this e-mail or contact me at *** *** to discuss a corrective action. Mr*** mentioned Leeroy ( sub contractor whom made the repairs for Wizard, mentioned he would fix any loose pavers down the road for freeI contacted Leeroy and he said no such statmement was made, Nor do I believe anyone would make such a promise as a sub cointractor, and not contacting ther company firs In summery, Wizard Construction has gone above and beyond its responcibility to correct the failing glue that is not workmanship relatedthe statement of Leeroy comming back for free forever and conformation from Leeroy of this staement did not persuade us to do any more free repairsThe glue is the only thing failing to hold these Pavers to the benchesthe footers are 8" thick with 1/2" rebar and the post bases are 32" deepoverkill from his "experts remidy to fix bad glue.Also the statement of repair cost seems to have gone up from 2,500.00! The repair cost above is recorded in my saved emailsall communication emails have been saved.It is aparent the truth is being bent to damage Wizard Construction for bad material failure that is not covered under warrentee to begin with. We have sent and repaired Mr***s pavers on seperate occations free of cost and at no fault of oursWe even repaired them after the warrentee expired at no cost.After the complaint and amounts not matching and inspecting the footings and bases again ( stil perfect) We are under no obligation to repair the Pavers for freeIf mr *** would like to have his Pavers repaired by us it will be at our cost to repairand definatly not close to the or as stated.
