Top Trip Rentals refuses to refund $5,700.00 for short term rental after cancellation due to Covid-19 travel restrictions and despite never signing or agreeing to a cancellation policy. Legal action is being taken.
Thank you for your follow up email. I rarely click on unknown links sent by unexpected or unknown emailers due to all the fraud on the web and the cleaver methods used to make site and links look legitimate. I finally clicked after this guest mentioned reaching out to the Revdex.com. This guest booked a furnished vacation rental home on February 3, 2020 for Memorial Day Weekend 2020 who wanted to cancel around the beginning of April due to the wedding that was planned and reason for traveling to Austin was rescheduled due to COVID-19. This home is non-refundable upon booking and the guest has been provided the documentation from *** and our company that the boxes for the House Rules and Cancellation Policy were check as "I agree" which is a requirement prior to even being able to book this home. The guest has even emailed screenshots of the reservation for other reasons but their own screenshots show "non-refundable upon booking".
While the reservation is non-refundable and the guest did agree to these terms, we understand COVID-19 has dramatically impacted people's travel plans and offered this group 100% credit towards future days prior to March 2021. This guest refuses the travel credit and continues to demand a 100% cash refund which we are not offering.
As of last week, after weeks and weeks of nasty emails of "I'm contacting my credit card company, ***, Revdex.com, State Attorney General, and legal council and we will see you in court", the group is interested in the travel credit. I guess all of these other entities also told them the reservation clearly states non-refundable so best to work with Top Trip Rentals. We have a second call set for this evening around 5:30pm.However, their continued refusal to cancel their reservation for next weekend has prevented me from booking Memorial Day Weekend to another paying guests which was the intent behind future travel credit - let your current dates go at the time your travel plans changed and transfer to new dates asap. This guest reached out at the end of March/beginning of April and still has next weekend's dates booked. By them holding on to the original dates this long and also wanting to take advantage of the 100% travel credit now has them taking 2 weekends for the price of 1 which was never my intent. But it is always our goal to work with our guests so the 100% credit is still being offered with a deadline of 5PM today, May 15th, to make a decision. Kindly

I am rejecting this response because:
Top Trip Rentals made multiple requests for additional rental terms shortly after booking the trip via *** to which I have not signed or agreed to as requested. The only cancellation policy agreed to at the time of booking states “cancelled bookings will not be refunded” and makes no mention of the additional terms at the time of booking. The request for additional terms nullifies any perceived agreement Top Trip Rentals and I have at the time of booking this trip via *** and a thus a full refund is not just the ethical course of action but a legal obligation.
I have made several attempts to work out a reasonable agreement with to Top Trip Rentals yet they have refused my request for a full refund and are leaving no options other than legal action to which I had hoped to avoid.
Further more Top Trip Rentals has not offered to reschedule the dates for a time that works for the original group of people that intended to travel. Offering winter dates of travel verse the summer holiday dates which we booked and paid for at summer holiday rates. This is does not constitute a good faith offer.
While I’m truly empathetic to the position Top Trip Rentals is in, the failure to cancel the trip and refund my money in full has resulted in a missed opportunity on their part to rent the home to people within the state of Texas and not impacted by the travel restrictions placed on those traveling from California. Which Texas mandates a 14 day of self quarantine.
While I hope to avoid court it has become more apparent to me that Top Trip Rentals has left me no choice.

The guest has been offered an exception to his/her non-refundable reservation with a travel credit. The guest has declined the travel credit. The guest has not cancelled his/her reservation. The current reservation remains in place with an arrival date in 7 days on May 22, 2020. We will honor the reservation as booked unless the guest cancels the reservation or transfers dates as offered. The offer to transfer dates expires at 5pm CST on May 15, 2020.
