In response to the tenant complaint - The tenant was notified verbally at the initial interior inspection when Top Notch took management conducted on April 12, that they had days to remove or make car operable This was a verbal discussion I made several attempts via email and
text and phone messages to have the car removed with no reply from the tenant I made several trips to the property to check to see if it was removed Finally on July 18, - months after the initial request, they were charged a $breach fee for non-compliance It was after receipt of this letter that they complied with the requirement to remove the inoperable vehicle Per the lease signed by them (see attached) on page 5, it notates that inoperable vehicles are not permitted on sight Additionally, Top Notch was within the lease perimeters to charge the breach fee for non-compliance, also noted in the lease on page As you can see my the attached communication log, there were several attempts made to communicate with the tenant to remove this vehicle They were not replying until I sent the letter with the charge *** called and expressed he was unhappy about that charge and as a courtesy and it being their first offense, I reduced the fee to $ I am unsure if the complaint here arrived before or after the reduction Top Notch Property Management was fair in giving ample time to comply with many verbal and written request to no avail and reduced the fee as a courtesy when contractually, we were not obligated to do so Top Notch would like to state that tenant was not communicating with our office to let us know the plans for the vehicle Ignoring requests caused the breach letter to be sent and a charge to be placed on their account. Top Notch has already made a concession on the fee Thank you
