I agree, nothing has been accomplished nothing except continuing to waste timeThe day they had standing water the entire are was under flash flooding and that fact has been ignored continuouslyThere is no point in continuing, this has gone back and forth we have agreed to do the warranty work for what was damaged from the tractor and the tractor onlyThat will continue to be the answer

We are not trying to get something for nothing, we just want that section of the lawn to look as it did prior to their arrival We sent their quote and final bill It is obvious we were willing to pay for work doneThe problem is it was not done as they suggested, or as they confirmed in writing it was done Regards, [redacted] ***

Response to each individual statement in order; French drain was the initial suggestion discussed with ***The grass that was damaged by the tractor and in many occasions we have agreed to repair grass from tractor damageWe dug down only to the water level that was originally discussed with the customer to create better water flowWe dug 3" which was the required to create an even path for the water to flow.We did confirm that we would repair the grass as stated again again and again any damage done by tractorOn 6-27-there was heavy rain and flash flooding " [redacted] /" and the customer had been notified before that it would only aid in the flow of water that is WAS NOT A DRAINWe did dig down 3" if we didn't there would have just been a pile of rock laying there even there own pictures show a good 2.5-3" worth of stone being removed when they attempted to "dig deeper"Last year we repaired grass damage with out any issue from our end the problem occurred when they wanted grass repair turned into them wanting us to give them an entire new lawn in that area including dirt, re leveling, etc(which we did end of doing trying to make them happy even though it was well above what we agreed upon)These two things were never actually addressed or brought to our attention had they have been we would have repaired them no issue how are we supposed to correct the issue but there was no communication from the customer (much like now)All customers wants is continue to get something for free each time we explain clearly what we are going to do they agree than once the job is complete they are start adding things to the job and saying it was never doneWe received warnings from previous landscaper about there tendency to change the job after it had already been completed and try to get free workWe have never been dishonest in anyway shape or form, again being proven by the fact instead of calling as stated in emails exchanged they continue to only respond through a complaint with no intent of actually calling and discussing the issuesAt this point it has become a personal vendetta of the customer attempting to slander our name instead of actually trying to resolve the issueWe have been in business for over years with only positive experience on Revdex.com and no negatives at allWe hold ourselves to a high standard and quality in work we attempt to make every customer happy but unfortunately every once in a while you will get a customer that is more concerned with slander than of our virtually spotless complaint record

Customer was at home all day and talked to one of workers on 6/5/15.? Worker first suggested combining mulch beds.? Discussed swale.? Worked suggested stone pathway and talked to [redacted] when he showed up later.? He proceeded to draw lines with paint where stone path would be.? ? ? First pathway had a machine used to dig down.? The machine broke that first dayOn this day the tractor damaged grass in entire area behind drivewayThe second pathway was erroneously filled with mulch.? Customer notified [redacted] that eveing that it was discussed it was a swale and had to be a stone pathway.? He stated it would be fixed on Monday, 6/ ·? ? ? ? ? ? ? ? In haste to finish on 6/8/mulch was removed and a stone pathway constructed.? Customer assumed it would be dug down as the first, since that was the only way water would continue to flow ·? ? ? ? ? ? ? ? Prior to paying invoice, customer confirmed grass would be fixed.? Landscaper confirmed it would be.? Customer paid entire invoice with good faith follow up work on the grass would be performed ·? ? ? ? ? ? ? ? Rain on 6/27/was the first time customer could notice that second pathway was not dug down deep enough to allow water to follow swale and path into sewer ·? ? ? ? ? ? ? ? Text from [redacted] on 8-9-stated “we dug down three to four inches and we weren’t trying to turn this into a big project.”? Pictures of work done by customer show there was NOTHING dug down.? Customer dug about inches themselves ·? ? ? ? ? ? ? ? Landscaper refers to an incident two years ago, again when they were at fault.? 6/26/landscaper ruined grass (see attached email with pictures).? Work was done when Customer was on vacation and the front and side lawn were ruined.? Landscaper stated they did not do that, and even neighbors witnessed machinery on lawn.? All Cus***er wanted was grass repaired.? ·? ? ? ? ? ? ? ? when a small fir tree was removed from the front yard by Landscaper, the sprinkler hose was cut.? Customer did not even notify landscaper of this situation and took care of it themselves.? In addition, pole light cross bar was admittedly broken by landscaper, again, customer repaired that on their own ·? ? ? ? ? ? ? ? All Customer wants is to be made whole.? Pictures illustrate grass was green and healthy, but shows damage their machinery did.? As a result of not digging the path down, water pooled as indicated by the pictures.? Both components created? the loss of grass for customer.? We have asked that topsoil be replaced and grass replanted in that section.? Landscaper talks about large amounts of rain.? There was just as much rain prior to landscape work as after, and prior there was not a problem with grass area.? It did not pool water and was healthy ·? ? ? ? ? ? ? ? Customer confirms that a meeting was requested with [redacted] prior to work beginning, to assure problems in the past did not occur again.? Customer is only with Top Notch landscaping, since the prior landscaper, Just Joe, who they were extremely happy with, sold his business to Top Notch.? [redacted] confirmed that he was trying to run that business and another and it didn’t work well, and he would be on site and the same problems would not reoccur ·? ? ? ? ? ? ? ? The customer confirms that the yard did “look” nice after the work ·? ? ? ? ? ? ? ? Landscaper has been dishonest numerous times o? ? stated machinery not on lawn when neighbors and other employees noted it was o? ? stating the pathway was dug down three to four inches when it wasn’t ? ? ? ? ? o? ? stated a French drain was required to fix the problem on 6/5/15.? This was not mentioned until late July after we had emailed and texted several times ?

We will not drop off materials, customer continues to try to persuade the situation for own personal gainWe will agree repair grass that was damaged by the tractor as we said we will have several times? Again these are only attempts to prolong the situation without the attempted resolution previously statedWe will not give in the unreasonable demands, we agreed to repair the damage created by the tractor, if the customer says that "we can't be trusted to perform work on the property" than we will consider the matter closedCustomer needs to agree in the next response one of two waysYes come out and repair damage No we refuse to let the landscaper do the tractor repair work that they said they would do from the beginning

Customer continues to make accusations, will repair what was damaged by tractor.?

We agree that we are getting no where even with several clearly stated attempts to resolve the issueWe will fix exactly what we said we would which was grass damaged from the use of the tractorThe two main facts of this entire dispute stay the same Lack of any communication from the customer after several attempts We always have and continue to agree that we will fix the grass areas damaged by tractor use

Top Notch Landscaping Inc has tried to resolve the issue with the complainant, *** [redacted] , the office manager, has been working half days in preparation for her maternity leaveThe owner of the company, [redacted] ***, has been out of town on personal matters during the short duration of this quickly escalated complaint [redacted] did direct the crewmen to go out to the property and address the damage, and use what materials we had readily available to fix the damageOur crewmen did lay down seed, and found it a better option to use [redacted] mulch, as opposed to typical straw, due to its ability to adapt to any soil, and it's starter fertilizer properties to ensure proper nutrients to said seedDuring the time that the customer contacted us, the crew men addressed the situation, and the follow up complaints (weeks time), we here in North East Ohio have had adverse weather, not ideal to rapid seed growthAs previously stated to the complainant, it does take time and proper weather conditions to nurture the re-growth of the grassTop Notch Landscaping can not control the weather, or how and/or where nature moves our work( ie floating down her driveway due to excess rain and snow)It did seem as if the complainant was looking for a high end sod to be placed immediately to cover up exposed soil, and that simply is not how we address our repairs In the attached file, you will see the clause regarding our contract policy on property staking Please note that the property was not requested to be staked by Top Notch Landscaping, nor did the customer stake the property themselves [redacted] was alerted of the situation and is going to further investigate the situation that occurred in his absence upon his return on 4/9/We thought the [redacted] mulch would be a sufficient fix to the problem, but the complainant still is disgruntledPlease also note, that our customer, the neighbor homeowner, did originally reach out to us, told us of the damage, accepted our resolution and has not complained about the repairsThe complaints are coming from a person who has stated they are not in contract nor in any business relationship with our company

Revdex.com:Contrary, to what my neighbor believes, according to the Cuyahoga County Auditor and the City of North Olmsted my property line runs up to and abuts my neighbor's drivewayThis was determined by the City of North Olmsted when a permit was issued in the Spring of for the erection of a fenceThe contractor suggested leaving a foot between neighbor's driveway and the fence to allow neighbor easier access to neighbor's garage and for protection of damage to fence.The city also required a "Good Neighbor"policy which enforced the contractor to install fence with the good side facing neighborA sketch of the property line is in my possessionMight I also add that current neighbor was not the owner at that time so may not be knowledgeable of this factTop Notch Landscaping can view the property line information at the Cuyahoga County Auditor's website if chooses to do so.I have always maintained the garden bed next to the house with installation of shrubs, mulch, gravel and have maintained the lawn as wellI really don’t care much about of all the rhetoric this has caused but I do care about continuing to have a good relationship with neighborI find it very rude and unprofessional to go to the neighbor with my complaintNeighbor knew of damage, photographed and reported such damage to Top Notch LandscapingNeighbor assured me that they were made aware of and will take care of the damage.To offer additional repair as good will is simply an insult.As for the resolution to this complaint, I agree, however, have doubts based on the company's continuous rebuttals when a fix is so very simpleIf this resolution remains unresolved or unprofessional then neighbor can assume maintenance of garden bed, leaf removal and lawn care in the futureI simply refuse to repair any damage that I did not cause in the first place [redacted] I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to me Regards, [redacted]
