completed all necessary paperwork and applications for *** *** in a timely mannerAt no point in time did our office guarantee an outcome for the case nor can attorneys ever guarantee the outcome of a caseA written retainer agreement was executedThe labor certification was approved thereby allowing for the next step to commence, that being the filing of the I-During the pendency of the I-140, evidence was requested pertaining to the company’s ability to pay *** ***The company was unable to provide these documents in a satisfactory mannerAs such, USCIS was convinced the company was unable to pay the wages offeredAlthough *** *** claims that she had no communication with our office for the last years, her case was denied on October **, and we haven’t heard from *** *** since December *, She is correct that the last communication was at the time of the denial of the case, at which time our services were discharged. In addition, *** *** is also claiming that USCIS requested information from us, we never notified her and as a result her case was deniedThis is absolutely incorrectSome documents were provided to us by the employer, which then documents were forwarded to USCIS*** *** is further claiming that her case was denied because of our office negligenceOur office can only use the tools provided to us from our clientsIf the proper tools are not provided, we do what we can to achieve a positive outcomeThe outcome of this matter was completely out of our control considering the company did not have the necessary documents to prove that it had the ability to pay her wagesThe first time we heard from her since the denial in was by the filing of this complaintIn response, our office called her and asked her for an explanation and encouraged her to come to our office for an appointmentShe stated she would give us a call but did not.
