When the patient asked for her x-ray, I explained to her that the x-rays we take are hard copy film and cannot be duplicated. The x-rays belong to the medical practice, not the patient. They have to remain in our office as part of the...
patient's permanent medical file. When we are audited by insurance companies, they can ask to see the x-rays and we have to be able to produce them. It's the law. Just because the patient does not agree with this policy does not mean that we have done anything wrong.

The customer is allowed any information that relates to their medical. if this information is being sent to my insurance company for payment then I am allowed a copy. Its not a fair act to keep medical information that is done on a patient the patient does have rights.

We have not denied the patient a copy of her medical records. If she wants a copy she will need to come in, sign a medical release form and we will give her a copy of her records. This does not change the fact that the x-rays belong to the medical practice and cannot be removed from this office.

I have already gone to my appointment for a second opinion and no longer need the records. By law when a patient ask for their medical records the doctor office should provide this to the patient not be told that we need records in case the office is audited. So since the patient did not get a copy then they should not be paid. The x rays are in their office and that was all they were worried about so keep the x rays with no payment
