for a letter with an explanation, amount of settlement, amount paid, and a paid in full letter. I will address each request below:Explanation: The customer has an account with this office. The amount originally due on the account was$4,819.36 (please see attached a Final Account Statement - which has a break/explanation of the charges). A “salesperson',Mr. P[redacted], offered the customer a settlement offer of $2,200.00 to close the file/account in full. The customer agreed to the deal and promised to pay the settlement amount in two payments: $500.00 and $1,200.00 respectively. Those payments were, in fact, tendered to this office and the file was, in fact, closed. As a regular office policy, there is a waiting period after the money is received and before the “Debt Paid Letters” are mailed out. The reason for this waiting period is the ensure that the funds have been officially received in the office bank account and that the customer has not put a “stop payment” on a check or disputes a credit card charge (both of these events happen on a fairly regular basis in this industry). In the instant situation, the final payment was received and deposited in the office bank account on 4/27/16. Then, a Debt Paid Letter was drafted and signed on May 12, 2016. However, that Debt Paid Letter was not mailed to the customer until June 24, 2016. The explanation as to why that letter was not mailed out immediately on 5/12/16 is that this office made an error. After the Debt Paid Letter was signed on 5/12/16, the attorney gave the file to a clerk and instructed them to mail the letters and to put a copy of the letter in the file then to archive the file with other closed files. Apparently, the clerk misunderstood the instructions and put the original Debt Paid Letter back in the file without ever mailing a copy to the customer. It is worth noting that a few weeks ago that clerk was terminated from the office and no longer is employed here. This supervising attorney at this office first learned that the debt paid letter was not mailed to the debtor when they received this Revdex.com Complaint Letter on June 24, 2016. As soon as the supervising attorney discovered what had happened, he mailed the Debt Paid Letter to the customer. The Salesperson is not responsible for signing or mailing the Debt Paid Letters but can confirm whether an account/file has been paid-off, which is why he communicated to the customer, “you should receive the letter shortly.” The salesperson should have alerted the supervising attorney as soon as the customer informed the salesperson that they had not yet received the letter via email. This issue has been addressed and corrected. Finally, please note that this office did not engage in any collection activity after the account was paid and correctly credited the customer for all payments.
