Dispute regarding monies paid via credit card and services not rendered.
On February 2, 2017 I purchased 10 sessions for acupuncture with Dr Wes E,AP,DOM, who was working for The Salt Room. I paid $625.00 on a Chase Visa credit card. I had one session which left a balance of $562.50. Dr E no longer works with The Salt Room and the owner of The Salt Room, Rebecca J L, has indicated she will reimburse me 60% of the $562.50 balance I have with her company. L indicates that was the arrangement she had with Dr E.I do not choose to see a different acupuncturist and since I will not be having this work done at the Salt Room I don't feel she should be paid 40%. Levine claims these packages sold for acupuncture were posted , No Refunds. I did not see any postings nor was I informed or read or signed anywhere that supports her claim. Out of the 10 sessions I have had only 1session, since February, with the amount paid in full for 10 sessions with no further services rendered.
To be reimbursed the full amount of $562.50

When you and your husband came into The Salt Room the week of October 9th I explained to you both that we do not refund packages. This policy has been in place for over five years now and we have signs everywhere stating "All Sales Final". I did however explain the different options you had which are as follows: Return the money to your Salt Room account to use with Stephen H (our other Acupuncturist who has been with The Salt Room for over four years), use the money towards Massage, Skin Care, Salt Therapy, retail products or gift cards to friends or family. I also explained that I am more than happy to pay Wes E for the remainder of your package so that you can continue to see him. I am willing to pay him outright for the remainder of your package which was also discussed as long as I have your written authorization.
When Wes E decided to leave The Salt Room my agreement was that I would continue to pay him at the same rate of pay he would've received if he continued to provide services at The Salt Room in order to honor our clients wishes. I continue to stand by that agreement.
On the suggestion of my attorney I have attached a copy of the Cease and Desist Defamatory letter.

1. I'm a patient of Dr. Wes E.
2. I do not choose to use a different doctor.
3. I purchased the ten sessions with Dr. E not the Salt Room.
4.For whatever reason(s) Dr. E ended his contract with the Salt Room, these circumstances should not effect me. I'm owed $562.50 for nine acupuncture sessions.
5.Dr.E*** has his own facility now, therefor I see no reason the Salt Room should still be owed 40% of the package purchased, when I paid for Dr. E services, which will not be performed at the Salt Room.
6. In regards to the claim that "all sales are final", this was not a product sale, rather a procedure that is performed by a Dr. I choose. I saw no signs regarding the acupuncture sessions as a final sale, norwasi told this or read anything indicating such.

The Acupuncture package you purchased was at The Salt Room with The Salt Room staff and using The Salt Room computers and credit card processing. Please understand the package that you purchased was absolutely with The Salt Room not Wes Eades. The Salt Room handles all rents, employee salaries that run the front desk, credit processing fees, advertising for services and so on..... Many of our clients quite possibly yourself would not have met Wes E if it wasn't for The Salt Room. The fact that you just don't think The Salt Room deserves it's share of business from it's contractors and employees is quite frankly not for you to determine. For many reasons as mentioned it makes sense for the contractor and the business to enter into an agreement that is mutually beneficial especially when they are not paying rent. I understand Wes E decided to open his own location however, that does not give him the right to alter our agreement for packages that have been sold through my business.
Back in October you disputed the credit card charges from February and I received the statement that you were refunded your money back on October 30, 2017. I have attached the paperwork however, I do not understand why you are continuing to demand your money back when you have already received it?

First I need to clarify that the credit card co. reimbursement to me is not yet permanent. I may or may not receive my refund ( for which I have received no services for) until the credit card completes their investigation. This is still pending. As far as the service for acupuncture by the Salt Room, I had 1 session done by the Salt Room which the Salt Room was compensated for. Now the Salt Room, because they initially processed the original full payment for the acupuncture package, can now tell me what doctor to use to complete these procedures. im a patient of Dr E and choose to have him do the acupuncture. The Salt Room will have no further involvement in this requiring no further expenses on their part. Why can't I choose the doctor I want using the money that I originally charged for Dr E services. I disagree that the SaltRoom is entitled to these funds if I choose the Doctor I want to use and that doctor no longer works for the Salt Room.
