Review: Patry Building Company LLC contracted my business ([redacted] Custom Wood Working), to build a home theater. I bid and contracted the job with an original set of plans provided by Patry. During the process of construction, numerous changes orders were added to the original set of plans to which [redacted] complied and Patry honored by paying for most of them.
The change order in question involves ceiling panels that were re-designed "after" the contract was signed and "after" work began on the theater. This change increased the cost of building and finishing the project on my end by approximately $24,270, which Patry is refusing to pay. When [redacted] presented the invoice (#[redacted]) to Patry, the owner's immediate response was: "this ain't gonna fly!", indicating that they were not going to honor payment on the additional work, (change order).
In addition to this, Patry is holding back two more checks owed to [redacted] for work already completed to a Gym Room adjacent to the theater. The sum of one check is $5,057.50 (Invoice #[redacted]), the sum of the other is $1,000 (Invoice #[redacted]).
[redacted] reason for non-payment of the latter checks is because [redacted] owes a subcontractor money and wants to use this amount to pay the subcontractor off. [redacted] does owe more than one subcontractor because we have not received payment for our services from Patry Building Company LLC, thus making it difficult to pay out what is owed by [redacted].
[redacted] believes it is unethical for Patry to "dictate" how, who and when, [redacted] should pay its vendors, when Patry is in violation of the same business ethics they are trying to enforce against my company. [redacted] non-payment of my company created this ugly situation. To my shame, Patry basically pulled the same maneuver on another unrelated job [redacted] did for them a few years back.
In short, Patry Building Company LLC "owes" [redacted] Custom Wood Working approximately $30,327.50 for services rendered. Patry is refusing to honor payment for work completed on change orders and work completed in the Gym Room. Attempts to collect have been met with the response "sue us!"
Please advise as to how to proceed in this delicate matterDesired Settlement: Desired outcome is for Patry Building Company LLC to "pay" [redacted] Custom Wood Working for services rendered.
