Ryan ***, a realtor representing Park Co. Realtors, falsely advertised the square footage of *** West Fargo, ND 58078, a property he was representing for *** homes. Ryan advertised the square footage of the home both verbally and in written form as “4,071” square feet, touting “guys, you have over 3,000 sqft finished, PLUS an unfinished basement,” during his open house that he hosted. We offered full price in the home, solely due to the size of the home and the price, only to be shocked when our appraisal came back 2 weeks prior to closing with a square footage 625 feet short of what Ryan and *** had claimed! We asked for Ryan and *** to correct the price to reflect the proper square footage, but they refused and did not even attempt to rectify the lie they had been caught in. We requested our earnest money back, which was given, however, with the closing just days away, we were forced to find a rental property under duress as we had no place to live and were relocating from CO, almost 1,000 miles away. We are now locked into a lease, but our children are enrolled in the school district of the home Ryan falsely advertised, therefore, we have since tried to “be the better person” and have recently offered once again a full price offer on the same home, but asked that they take responsibility for the lease that we are locked into due to Ryan’s incorrect advertising. Ryan’s response to our offer was not only malicious, but he verbally insulted our realtor, telling her she should “counsel your clients,” and that “they can buy the house when their lease is up, if it’s still for sale.” Ryan knows he lied, he was caught in a lie and is behaving as a bully to try to avoid further legal actions or repurcussions by my husband and I. We have encountered thousands of dollars in extra expenses as a result of Ryan’s lie and he needs to be held accountable for his actions.
I want to address the question of sq footage on homes. the *** signed the attached sq footage disclaimer on July 20, 2017.
The *** stated many times to their agent and to Ryan at the open house that they loved the size of the home and rooms, the layout of the home, the size of the yard and many other compliments about the home. an offer was negotiated which included the builder adding numerous extras that the buyer wanted.
there were changes that were asked to be renegotiated because of the home sale issues the *** were experiencing on the sale of their home in CO. the builder did everything they could to accommodate those requested changes.
the appraisal came back, it was discovered that the sq footage was off by 625 sq ft. agents looked into what had happened, the information that the builder had passed onto the agent included the garage sq footage. the listing agent apologized to the buyer. It was not a malicious misrepresentation; it was an error.
the buyers at the time demanded the seller reduce the price $30,000 to compensate for the error. builder said that would not be possible. the *** asked to cancel the contract. The buyer's agent and I had a phone conversation with *** who proceeded to tell us about how she did not like the home, it was a dated plan with dated colors and did not want to buy it. *** was taken back since before this time she had always commented how she loved it. They have since come back with a different buyers agent and made an offer on the home. this time they were asking the builder to take over their lease on their rental. the builder is not willing to do that. My understanding is that they are renting from a builder that they were planning on building with and have since changed their mind on that home and the builder in not releasing them early from that lease. Again their decision.
I am rejecting this response because:The response is an absolute fabrication of the circumstances surrounding the conversation regarding the home purchase. *** and her boss tried to PUSH us into buying the home, even after we explained to them that the price of the home is not even close to competition, especially with the laminate flooring and fake countertops. We explained that *** homes has granite throughout their homes and beautiful finishes and actually ***’s homes are still priced LOWER than this home! Vicky’s boss did not want to hear this and repeatedly told us “it’s still the same house party that you loved.” To his repeated attempts to push us to follow through on the purchase my husband *** explained to him that it was NOT the same house and that our interest in the property was solely the advertised price per square foot and the possibility of building equity in the home by finishing the basement on our own and having an over 4,000 sq ft house for a purchase price of $355,000. However, we were simply ignored and talked over under we finally ended the conversation feeling completely bullied and lied to.
It should be noted that We FIRED *** as a result of her dishonesty and failure to keep our best interests in mind. Now, *** homes has been forced to lower the price of the same house by $15,000 and they still have little to no interest in the home! We recently made another offer on the home AFTER they reduced the price by this amount! And, ONLY because our children are enrolled in the school district this home is in and we do not wish to make them switch schools again and there are no other built homes in the development except *** homes, which are all sitting empty due to their overpricing! We are locked into a lease directly because of Park Company’s dishonesty.
