The Middlefield Banking Company Dedicated To Your Future East High Street July 21, 2017 Revdex.com 888/801-Serving Greater Cleveland Attn: Ms*** *** Euclid Ave., 4th Floor Cleveland, OH 44115-2408 Re: Complaint ID *** (the "Complaint') Ms***: The Middlefield Banking Company (the "Bank") advances payment of construction loan proceeds in accordance with standard industry practice of funding work that is completed and in place on a projectWhen borrowers act on their own behalf as the general contractor for a project, the Bank works closely to try and accommodate funding requests to pre-pay items when requested, despite work not being in place or a project that is over advanced in comparison to the work that has been completed. The Bank requires an inspection and title update to monitor the completion progress of each projectEach borrower prepays for five (5) property inspections and title updates during the construction periodThe third property inspection was completed on July 17, and the project was 37% completeThe Bank, however, has advanced to date 50% of the project fundsIncluded in this amount, as an accommodation to the borrower, is the prepayment of labor and materials for constructionThe Bank has been responsive to the borrower in its explanation of the importance of keeping a project on budget and within the available funding. The Bank has over-advanced on the project relative to the budget in order to reimburse the borrower for several out of pocket expensesThe project has not halted and continues to move forward to completionThe Bank and borrower have resolved the matter and the borrower has agreed that any further disbursements will be given following inspections and according to actual work completed. Respectfully, The Middlefield Banking Company
