a deck directly in to the drainage swale that controlled the flow of storm water from other lots in the subdivision. (Even though it's my understanding that the [redacted]'s did not get HOA approval, the [redacted]'s failed to recognize the implications of blocking this swale (which was well defined) with their deck). As a result of this, the proper flow of water was not able to occur and any damage that may of resulted was the fault of the [redacted]'s for not recognizing the implications of building their deck in the flow line of the swale. After the fact, this was discussed with Ms. [redacted] and she could did not offer any explanation as to why the deck was built as it was.
