The customer has received information in the past regarding the Bank's overdraft procedures and policies. That information has been provided both orally and in writing. The written disclosures provided to the customer included information about overdraft fees, customer options regarding
overdrafts (including information about refusing overdraft coverage. The "safeguards" to which the customer referred are account restrictions that the customer may request or may be implemented by the Bank in the event that a customer is making excessive use of the Bank's discretionary overdraft coverage. When there are insufficient funds to cover an item, in most cases a fee is charged whether the item is paid (an overdraft) or returned unpaid. If a customer were to write checks against an account with a negative balance, those checks are subject to a returned item/non-sufficient funds fee.The Bank believes it has acted in accordance with the law, as well as the Bank's policies and procedures regarding overdrafts. Customers are encouraged to review and balance their accounts frequently to ensure that there are funds available when checks are written or other debits are made
