To Whom It May...

Concern:                                    ... November 10, 2015      In response to our concern, On Sept 21, 2015 customer contacted me asking if the vehicle was still available. I advised customer that vehicle was still available. Due to customer not living locally I advised him that I would let him know up front of any issues the vehicle might have before drawing up any paperwork. I sent customer photos of the vehicle where the hail damage was, customer was ok with that to the point that he already had a hail damage repair shop appointment in Del Rio, TX as soon as he had possession of vehicle. Paperwork was drawn up on Sept 28, 2015, customers 1st attempt to take possession of the vehicle was on Oct 1, 2015 at Texas Certified Motors located at 1629 E. 8th St Odessa, TX 79761. When he arrived the vehicle was non drivable due to power steering pump malfunctioning. At that time I advised customer that he would not be able to take possession of vehicle until I would make sure the vehicle was drivable and safe. While customer was still in Odessa, TX we also agreed to meet half way in Sonora , TX once the vehicle was repaired. In the mean while the malfunctioning part was being replaced. On Oct 8, 2015 we attempted to deliver the vehicle to Sonora, TX upon arrival unfortunately the power steering pump malfunctioned at that time customer was advised that the compressor was making a whinny noise but was still fully functional, but he would need to replace later on with time. We decided to tow vehicle back to Odessa, TX as the vehicle was not drivable. At that time deal was killed until further notice, I also asked customer if there was another vehicle he might be interested in as the repair might take up to a couple of weeks. Customer stated that was the only vehicle he was interested in. On Oct 22, 2015 customer was advised that vehicle was ready and the only way we would continue the deal was that he had to come take delivery of vehicle in Odessa, TX, customer agreed to terms. Customer was dropped of Oct 24, 2015 at Texas Certified Motors located at 1629 E. 8th St Odessa, TX 79761, upon his arrival I made sure he test drove the vehicle and was fully satisfied with vehicle. I asked customer if he had any questions or concerns before his departure and customer stated "he did NOT".  I didn't hear from customer until a week later after taking possession of vehicle, advising me the repairs mentioned above, I advised him that what was promised in writing was successfully fulfilled. Customer also was aware that at no given time Texas Certified Motors would be responsible for his loss of time from work nor his expenses to travel to take delivery of vehicle. An "AS IS NO WARRANTY" document was initialed and signed by customer, as we as a "WE OWE" stating the repairs promised. If needed can provide documents as well as receipts pertaining to the repairs on the 2009 Dodge Ram 1500 Vin number: [redacted] said vehicle claim is on.  Thank You, [redacted] Finance/ Store Manager

I am rejecting this response because:
Most of what Texas certified motors response is correct. One fact left out was there was no negotiation of price on this vehicle. I was shown the car, then contracts landed in front of me. I am a first time car buyer and felt pressured. I was told the bank includes a fee into the price of my vehicle that I was buying. The ad for said car was priced at $9998. When I recieved contract the price was 15,311 with no paper trail of where this price came from, why it was there, or what it was. I did not like the deal after speaking to some more experienced car buyers and wanted to back out. But, when I asked questions I wasn't getting direct answers or I was getting attitude from the person I was speaking with. I feel I was being taken advantage of and it is not right.

Employees of the Texas Certified Motors business office have spoken on many occasions to [redacted] regarding her warranty cancellation. On the paperwork that [redacted] son filled out to start the refund process, he did not check the box that would cancel his GAP, the only box...

checked was to cancel the Warranty. After multiple calls between [redacted], Chase and EFG (warranty company), we have determined that EFG canceled the GAP policy the first week of August, at her son's request (by phone). Due to processing, in six to eight weeks from when EFG canceled the GAP, we will issue Chase a check for the refund amount of the GAP policy. On 8/20/15, a check was mailed to Chase for the refund amount of her Warranty cancellation. We understand how [redacted] could say this process takes too long and is demanding her refund immediately. But due to both her and her son calling the warranty company, finance company and Texas Certified Motors, wires have gotten crossed. We apologize for the six to eight weeks processing time for the rest of the refund, but Chase and EFG and Texas Certified Motors all have to process the request. Her check will be mailed when we receive the amount from EFG that is to be refunded to [redacted].

Mr Padgett traded in his 04 Chevy to us last week and has purchased a different vehicle from us. Customer is happy with the new vehicle.
