In October 2018 and 6/3/19, I had emergency room visits due to a strong intermittent refrigerant smell coming from the refrigerator. I have loss work wages, finances from deductibles paid from Emergency room visits and have loss more than $300 in grocery because I had to discard the food after tasting the chemical taste in some items. This amount is including this incident. I was only reimbursed $100. In May 2019, the refrigerator was replaced with a different refrigerator that was in a display apartment for many years. I notified the apartment manager *** on 6/4/19 via email message of the emergency room visit I had on 6/3/19 and sent a voice recorder of the sound of the refrigerator engine , which is intermittently loud. I also informed *** of the intermittent refrigerant smell and the fact that the freezer was over cooling and the only issue addressed was the cooling problem. I was told I could not use the recommended temperature selection because I didn’t have much food in the refrigerator. I had enough food for the recommended cooling temperature.

I am rejecting this response because: I met with the manager of Polo Downs Apartments *** on 6/19/19. During our conversation she admitted to smelling the chemical smell but in her narrative in response to the complaint she didn’t smell anything. She also sent documentation stating that maintenance smelled nothing but that’s false. The maintenance worker Artice said he smelled something, which is why the *** warranty repairman was called out twice. The information forwarded to you from the fire department is also false. When the firefighters came out the supervisor said he didn’t smell anything but a firefighter walked in and said it smelled like paint thinner and then the supervisor recanted. As I told the leasing manager ***, I’m at a disadvantage because of my race. It’s interesting that I’m the only one being effected by this issue and the only African American in the entire section of the complex. The municipality also lacks diversity, which also contributes to the level of discrimination or bias I’m experiencing. My request was to be reimbursed for the food I loss, medical expenses and loss wages but the manager declined those terms. I’ve been without a suitable refrigerator since 6/4/19. Maintenance hasn’t come by to check the refrigerator and closed the work order. I was told that I would receive one today but it hasn’t been delivered. What was offered was to get out of the lease with a 30 days notice and the termination fees waived and I agreed to those terms and waiting to here back from management. I asked for my locks to be changed because the office staff couldn’t find my apartment keys during move-in and I was given the master key. A copy of the keys were copied and given to me but the lock wasn’t changed. Unfortunately, I didn’t ask for the change during that time and should have because the vendors receive the key to get the apartment ready for move-in. I’m not sure if someone unauthorized has access to my apartment. I’m disappointed in this situation. This is a modern day form of harassment. I have complied to the terms of the lease but *** hasn’t. Please disregard the picture attached I will send pictures and receipts over to ***.

I rented an apartment here in September and shortly after that realized that the smell of cigarette smoke permeated the apartment. I went to the manager and complained and was told yes, it was a smoking apartment complex. I explained that I was not informed of this prior to my rental. I had cancer surgery in December and I decided that I needed to move because the smoke and smell just kept coming into my unit. I went to management and was told tough. They did offer to move me to another building however if it is a smoking complex I feel I would have the same problem. On 4/30/2017, I moved out of this apartment however I had to pay nearly $4,000 to do so. This included a penalty, last month's rent and they also withheld my security deposit. I do not feel this is better business especially since I was never told this was a smoking complex and they admitted that other people had the same complaint. I had to suffer with second hand smoke on a daily basis. My clothes even smelled like smoke and I don't even smoke. This business could care less.

I am rejecting this response because:
The apartment that I occupied was almost constantly with second hand smoke. Every visit to the leasing office with that complaint was met with there is nothing we can do. After about the fifth visit I said to the manager, "other people must have had this problem". She admitted that was true and said the smoke was coming in where the plumbing was. When they offered their "solution" of moving to another apartment, it was clear that I would probably have the same problem. I told the manager that I had cancer surgery in December and did not want to have the added stress to my body with all this second hand smoke. There was never any visit to the apartment to experience the problem or attempt to fix it. That is why I feel they should refund all my money.
