Hello [redacted], This letter is in response to the complaint filed by a client against our company, Tehachapi Pest Control, Inc, received on December 8th through U.S. Postal. There are currently no outstanding issues and thus no resolution is necessary. The following is our account of the dealings with...
the client. Our company was first contacted to perform a termite inspection on the structure owned by the client located at [redacted] Valley Rd, Tehachapi, CA, as a second opinion because he was displeased with the price quoted by another pest control company for the work necessary for sale. We performed the inspection diligently during our very busy season on 7/12/2016, for which an invoice for payment and a report were provided. We completed this as quickly as possible because the client was very concerned about the time frame, and pressingly demanded quick service. Our inspection revealed that the client's home would require a fumigation and also had a particularly difficult area which needed to be treated for subterranean termites. We discussed for many hours to determine how we could complete this for the client without requiring a significant amount of money for excavation. Our company came up with a cost effective solution, and so the client contracted with our company to have a fumigation and the additional termite work and treating performed on his property. Our work for the client included the following: 1.Original Inspection and report dated July 12, 2016- Invoice and report provided to the client's real estate agent an escrow company at 12:39 PM on July 13,2016 and then resent at the request of the real estate agent at 3:46 PM on July 26, 2016. 2. A Supplemental Inspection and report dated July 22, 2016 completed at no charge as a courtesy, for which we would normally charge $65 - Report provided to the client's real estate agent and escrow company at 8:22 PM on July 22, 2016, and sent to the client directly at 10:43 AM on July 25,2016 at the request of his real estate agent.3. A second Supplemental Inspection and report dated August 11, 2016 also completed at no charge as a courtesy, for which we would normally charge $65 - Report provided to the client's real estate agent and the buyer's real estate agent at 5:29 PM on August 11,2016 and sent to the client directly at 10:35 AM on August 17, 2016.4. A reinspection and report of work performed by others dated August 29,2016 which was also completed at no charge as a courtesy, for which we would normally charge $45.- Report provided to the client's real estate agent and the buyer's real estate agent at 3:51 PM on August 30,2016.5. Completion of additional termite work, fumigation, and report dated August 29,2016. -Invoice and report provided to the client's real estate agent and the buyer's real estate agent at 3:51 PM on August 30,2016.Please see attached invoices sent (Attachment A). You will notice that each invoice includes a clear statement at "7% late fees [are] applied after 30 days".We completed all work on 8/29, and were out of pocket more than $2,000.00 for his fumigation. When we did not receive payment by October 20,2016 we followed up and, as is our general practice, we performed a title search as a beginning to our lien proceedings. We determined that the client did not have clear title of the property when he contracted with us for work and therefore knew that his escrow would not be able to close until that was taken care of. His court proceedings held up his ability to pay vendors from his escrow account, but the never contacted us to arrange for payment for the work we performed to avoid our %7 late fee. We sent a third invoice at 3:24 PM on October 20,2016 to the client's real estate agent and the escrow company including the 7% late fee, which made the client very angry. After much argument from the client, he ultimately agreed to pay for our work and the 7% late fee from escrow, and we finally received payment on 11/4/2016 (114 days from the date of the Original Inspection and report, and 66 days from the date of Completion and report).We do not feel that our company acted inappropriately in any way. In fact, we went beyond our obligation to try to come up with a plan to help the client complete the necessary work and save the client money in the process. Unfortunately, this client was very upset from the beginning about having to pay for any work to be done in order to complete the sale of his property.
