[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Flat out LIES!!!I DID NOT CALL a few WEEKS later! I called business days DAYS later. I called on June 30th! I would NEVER say I know vehicles! I would be the FIRST to admit I DO NOT!! If I said this is the one I want, as a consumer if I am not satisfied with my purchase I have the RIGHT to RETURN it and NOT at LESSER VALUE! If I buy a pair of jeans at Walmart it is because they are the ones I want. It doesn't mean they will fit when I take them home, and if they don't I can RETURN them, and NOT for less money. I believe this was the dealerships BIGGEST mistake. They did not let me return the Kia and get something else. They DID give me a return price over the phone. They said at trade in value it was roughly 12,500 they KNEW what they vehicle was worth. The hail claim and rebuilt title are right there on the autocheck. They responded a LOT in regards to the mileage. First I had ZERO idea I could do ANYTHING about this after calling the first time wanting to return it and them saying NO, only at trade in value. This WHOLE THING STINKS and in my opinion there is NO WAY ANY BUSINESS should be allowed to operate this way in todays world. What happened to the consumer is ALWAYS RIGHT!!!!!!!!!!!!!!!! Swant Graber DESERVES to buy this Kia back from me at the loan balance (12,000)

The first issue I would like to address is the Carfax. We do display Carfax posters and decals all around the dealership that say "If you would like to see a Carfax ask"! I have looked at the Carfax and found the vehicle was involved in an accident 1/16/12. The vehicle apparently side swiped a...
guardrail. That doesn't make it a bad vehicle. The vehicles airbags didn't deploy and the person drove it home after the accident. No hail damage ever reported. No rebuilt title.Mr. [redacted] came into the dealership on 6/25/15 to test drive the vehicle. Went for a very short test drive, told the salesman "I've driven it enough I know vehicles and this is the one I wont lets go back". Mr. [redacted] had a trade in that he still owed money on and had no cash to put down and choose to purchase an extended warranty and wanted to be at a certain payment amount. In order to get to his desired payment we had to arrange a 72 month payment contract. There is a point to this paragraph which I will get to later.Mr. [redacted] did call to ask to trade it in a few weeks later but never came in or got trade in figures from us. Mr. [redacted] did call us late July of 2016 (Over 1 year later and almost 20,000 additional miles on his vehicle. We did tell him at that time we estimate his vehicle trade value to us to be around $9000). He wasn't willing to come in to let us give him firm dollar numbers. Since that time I have tried to work out a fair trade with Mr. [redacted], but (here's where the previous paragraph comes in) 18 month's later over 20'000 miles (well over 100,000 miles) and having financed for 72 months to get to his payment, he owes more than the vehicle is worth! We can't help what the market is on his vehicle, we don't set the market the public does. The fact is a 2011 Kia with well over 100,000 miles and 18 months later is worth what it is. Any major mechanical issues he has had has been fixed under his extended warranty.We have fulfilled our obligation and done our best to help Mr. [redacted].
