I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.
Essentially Superior Seal dug out a large hole and did NOT fill it in properly. The driveway does meet the garage and the road correctly I believe. But everything in between the top and bottom, the vast majority of the driveway, is way to low. BOTH sides of my driveway are now inches below the basic level of the lawn as it flows from the top of my driveway down to the road. In fact both sides of my driveway are now inches below the level of the DIRT the grass grows out of. My driveway prior to what they did followed the grade of the lawn on both sides from the garage down to the road. Yes the driveway was beat up terribly but both sides were up to the level of the lawn. Nor was my driveway wavy. It simply followed the general contour of the lawn. That is what the new driveway should have done as well. That is how they build all driveways except for what I currently have. Look at driveways on your block, your neighborhood, where you work, anywhere. Whether they are old or new, flat or raised up to accommodate a lawn that is actually a hill you will be hard pressed to find one that is inches below not only the level of the lawn but also the level of the ground which the grass is growing out of on BOTH sides of the driveway.
My solution means they did to correct the driveway. Build it up to where it should be, but it is also very important that the top is one continuous surface. It should not appear to be spliced or patched. Therefore the surface by the garage and road would have to be removed I believe with additional asphalt applied from top to bottom with much more asphalt applied between the top and bottom bringing the driveway up to the LEVEL OF THE LAWN BEST AS POSSIBLE. Which is what Superior Seal hand wrote onto the contract before I would sign it. Also they need to properly clean my siding where they left asphalt on it. I'll remove or correct the dirt they took off the side edge of the driveway and threw on top of the mulch.
Please note: I attempted to include some pictures to demonstrate what I was talking about. It appears I may have included one but I don't know how to verify that on your system. For that reason I will not try to attach others. However if anyone would like to see the work performed by Superior Seal the address is at [redacted]. If they knock on my door I'll show them the contract as well.

Below, please find my response to the complaint #[redacted]
After reading Mr. [redacted]...
statement, it confirms the fact that he is 100% wrong on his complaint. From the beginning, he has tried to change our contract (see enclosed) which states "Sometimes after dig out, the grade of the driveway may be higher or lower than that of the lawn. Superior Seal & Paving, Inc. is not responsible for any landscaping that may arise from this situation." That statement reflects decades of experience and thousands of dig outs that have resulted in the lawn being higher or lower than that of the old driveway. What Mr. [redacted] fails to tell you is that he extended the driveway 2feet to the right side (looking from the road). It happened to be that the right side elevated in height which caused the new driveway to be lower. We build driveways from the garage floor to the road. We do not build driveways to agrass line. In the contract, under "notes" we wrote "Keep level of final drive flush with lawn best as possible." We used the term "best as possible" to protect ourselves just in case this happened. In our opinion, we did itto the best of our ability. I, the owner and president, personally paved the driveway and explained to Mr. [redacted] time and time again that this was "as best as possible." That is our explanation to him. If we go to the contract, with alittle landscaping, he could have exactly what he wants which is the grass line to be level with the driveway. If you look at the pictures (see enclosed), you can see that Mr. [redacted] lawn goes up and down the whole way from the garage to the road. If we followed that grass line per Mr. [redacted] request, the driveway would be wavy, higher on one side than the other and then hewould becomplaining about that. We currently are taking Mr. [redacted] to small claims court. He is 100% wrong and if you notice, there is no complaint about theprofessionalism of the driveway that was topcoated. That is because the job is 100% perfect.
