Attached is potentially helpful documentationJust before [redacted] contacted the Revdex.com we had a verbal agreement that the Home would be complete by 3/31/but he released us from contract 2/22/(see “release”)There was a verbal agreement with the two realtors, seller and buyer because I refused to meet the demands for a contract extension from [redacted] and he at that time refused to sign a contract release (see “unaccepted extension”) We continued on and re-sold the home and had it substantially complete by 3/31/(see [redacted] email from his realtor)I emailed the potential Buyer / Customer see [redacted] email from me).Our contract has standard terms as below and we offered many times a release from contract and return of the $2,deposit but the potential customer wanted to continue on with the deal until finally released 02/when we were so close to completion“Builder estimates completion of construction within __working days from the start of construction, except for delays caused by changes or acts of Buyer, or persons employed by Buyer, acts of arbitration, failure of any subcontractor or materialman, fires, strikes, acts of public authority, inclement weather, allocation of materials priorities, delays or defaults by public or private carriers, shortages of materials or labor, acts of God, or other work stoppages, casualties, or other causes beyond the control of BuilderBuilder reserves the right to make changes and substitutions in the construction as may be necessary because of the unavailability of materials through Builder's ordinary and usual sources of supply or as may be required by law, provided the changes or substitutions are of equal or better quality.”1st Revdex.com response:This property is Builder owned and we have a construction & purchase contract in the amount of $245,with an ESTIMATED completion date except for delays caused by changes or acts of Buyer, or persons employed by Buyer, acts of arbitration, failure of any subcontractor or materialman, fires, strikes, acts of public authority, inclement weather, allocation of materials priorities, delays or defaults by public or private carriers, shortages of materials or labor, acts of God, or other work stoppages, casualties, or other causes beyond the control of BuilderThe Buyer [redacted] understood we were experiencing delays and were not going to meet his requested time of completion so we offered a full release of contract and his $2,deposit money back but he refused to sign the releaseA seller/ builder should always want a job complete ASAP in order to get away from the carrying cost and liability and suchIt does a seller/ builder no good to intentionally delay constructionI have suffered great losses when construction times take longer than expectedWe pay all contractors weekly and push everybody as hard as possible but there is definitely a shortage of quality and honest sub-contractorsWe have been in business for over Years and take pride in our work and I sincerely apologize for the delayWe have just come to realize a longer build time can now be expected in Simpsonville than in most other areas where we build.2nd Revdex.com Response:Contractors cannot control the weather and weather is a huge contributor to construction delays especially in winter monthsContractors and Inspectors are also very busy and often there are unexpected delays in constructionWe have just recovered from a huge economic down turn in the industry and now there are many labor issues due to the sudden massive recoveryWe had communicated with the potential customer regarding the delays but the potential customer made many unreasonable demands that we could not meet in regards to extending the contract to purchase therefore we offered all monies returned and a full release of contract but the potential customer refused to accept a release until just days before project completionI hate to lose any customer but I feel that in this case we were better off without this potential customerAll money returned to potential customer and a full release from contract was received Thanks, [redacted] Builder - Realtor - Developer Superior Builders Inc.P.OBOX 91483Louisville, KY[redacted]
I was worried about my a/c unit and after hearing commercials on the radio about getting it serviced I decided to call someone I used R & R Refrigeration because it's a local business where I live and I wanted to support local The service techfrom R & R arrived on Tuesday around am It turns out I knew the service techbecause he had worked at another job where I saw him Chuck, the service tech was very professional, he checked my a/c unit in the attic and found a defective transfer was not performing properly He recommended I replace it so I decided since he was there to go ahead and have it fixed Turned out it cost about dollars for the part He then cleaned my a/c unit with some solution and went down stairs to check the outside unit He cleaned the outside unit with some solution and checked the a/c level in the unit It was fine so it just needed a little cleaning Now my a/c unit runs nice and cool So far this year we've only had to run the a/c unit in the daytime because it's been cool at night I would recommend them to my family and friends if they want great service by a local business
Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.Mr [redacted] needs his memory refreshed as to trying to bully me and tell out right liesAttached is an email where Mr [redacted] told me specifically not to have ANY contact with him except through my lawyerNow if Mr [redacted] needs his memory further refreshed I have EVERY email, text message and phone conversations recorded with anyone I have spoken to that pertains to Mr [redacted] and Superior Builders.I have emails where Mr [redacted] was in communication [redacted] (realtor) [redacted] where Mr [redacted] specifically states the house was going to be completed no more than days from FebThis is third completion Mr [redacted] has given us, only to be let down when the house was not complete on those said days Now if Mr [redacted] does not remember such conversation I can post the contents of those emails to refresh his memorySo Mr [redacted] which is the truth and which is the lie, because you further stated that you told my realtor that you would be finished with the house by the end of this monthIf that is the caseThen why did you request for us to sign and addendum to the contract that stated you would be completed by the end of Feband we would have the certificate of occupancy by the March but never signed to addendumBefore you answer that be for warned that I have every email that was sent between Mr [redacted] and my realtor that concern you and I.What I find truly disturbing is that Mr [redacted] is still in business and that he continues to bully people and try to run off those who stand up to him and hold him accountableMy intentions now are to let everyone know how Mr [redacted] treats the potential homeownersFiling a complaint with the Revdex.com is but the beginningI intend to make everyone is aware of how Mr [redacted] operates his business and hopefully keep other unsuspecting people from having to deal with the same issues we did with Mr [redacted] .I have been involved in the construction industry on and off for the most part of my life and have never seen anyone treated like thisI find it disturbing that people allow Mr [redacted] to bully to get his way because people have entrusted him to build their dream homes Regards, [redacted]

I have replied previously by email to the BBB on 8/17/2015 to [redacted] ***. Please refer to that previous email as well as email attachments regarding this complaint. Pre Closing punch list items that were agreed upon by buyer and seller are all complete. Warranty claims will be honored per written warranty given to purchaser at time of closing. I have gone above and beyond and dealt with defamation and slander by the purchaser's son. I have an attorney representing me regarding these issue as I will pursue litigation. However I still have tried my best to resolve my customers concerns but when we meet the purchaser in person she seems to not even understand her complaints thus leading me to believe these are more issues brought about by her Son? #2- Not on pre closing punch list, separate written acceptance received by builder, recorded verbal approval by buyers son as well. #4- Not on pre closing punch list, observed by builder rep. and functions properly. #5- Replaced at day of sale and witnessed by multiple contractors, suspected either homeowner tore weather stripping during moving or maliciously damaged by other than Builder #6- Not on pre closing punch list, 8/04/2015 carpenter was back on site again but buyer refused to sign off on repair "until all items were complete". This is unfair to the builder and representatives as we can't keep coming back. Either a repair is done or it is not. Just because something was done differently than the way someone else may do it, that it doesn't make it incorrect. #7- Not on pre closing punch list, per licensed HVAC contractor plates are intentially left off to allow furnace to function properly, #10- Not on pre closing punch list. #11- Not on pre closing punch list. Passed all local building inspections. #12- Not on pre closing punch list. Passed all local building inspections. #13-Not on pre closing punch list. Brick was chemically pressure wash cleaned and exterior once again pressure washed down prior to closing. #14- Not on pre closing punch list. Just because something was done differently than the way someone else may do it, that it doesn't make it incorrect. #16- Not on pre closing punch list, just because something was done differently than the way someone else may do it, that it doesn't make it incorrect. #17- Not on pre closing punch list, 8/04/2015 written acceptance received by builder from Buyer. #18- Not on pre closing punch list, 8/04/2015 carpenter was back on site again but buyer refused to sign off on repair "until all items were complete". This is unfair to the builder and representatives as we can't keep coming back. Either a repair is done or it is not. Just because something was done differently than the way someone else may do it, that it doesn't make it incorrect. #20- Not on pre closing punch list, separate written acceptance received by builder, recorded verbal approval by buyers son as well. #21- Not on pre closing punch list and within warranty guidelines. Home passed all local building inspections. #23- Not on pre closing punch list. Not noticed by buyer, realtors or anyone that I am aware of prior to home purchase. #24- Not on pre closing punch, Builder personally removed factory protective wrap in front of Buyer and other witness. Buyer inspected at that time and there was no dent. #25- Fixed and accepted by buyer pre-punch list. Carpet does not get "sealed" by builder. Response to paragraph 1: Builder representatives always immediately responded to Ms ***. The siding issue was not on pre closing punch list, separate written acceptance received by builder that she was not "forced" to sign, recorded verbal approval by buyers son as well. Son was notified he was being recorded and was complimenting siding / aluminum contractor. Caulking is a normal practice at seams and where two different materials meet. Response to paragraph 2: Home was completed and inspected by local building officials as well as a certificate of occupancy was issued. All items on the pre-closing punch list are complete. This home was built as a contingency that purchaser must sell previous home before purchasing home from builder. Buyer never gave a deposit binding the contract and once buyers existing home sold the builder timely completed the new home. Builder actually refused to go to closing because of issues with buyer's son. At time closing was to occur the Realtors and closing attorneys begged builder to sell the property to Ms. [redacted] so finally the Builder gave in. After closing harassment by the buyers son began. I offered to refund purchasers money and buy the home back but the purchaser refused. Warm regards, [redacted]
Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, [redacted] I have read the response from the builder which is not trueThe builder himself has not contacted me and the original list hasn't been completedThe poor workmanship and failure to complete the home as some of the photos clearly represent has nothing to do with my son nor his advice given to meI had several professional individuals perform a walk through all reaching the same consensusI have stated nothing less than the factsThe builders comments are based on hearsay and an attempt to slander the integrity of my son who was cursed by [redacted] himself and witnessed by other parties of the community via telephone conversationI did in fact pay a deposit, given by me to the realtor [redacted] *** [redacted] of Superior Builders has obviously chosen not to finish my house in accordance with the contractHis first and only walk through of this house was conducted on the day of and approximately one hour prior to the initial closingHe has not nor subsequently became involved in resolution of the outstanding issues that currently stem from his efforts as a home builderHe has chosen to avoid the many construction issues which he has created rather than face them and resolve the items once and for all I only want what I paid for and that is a dwelling constructed per the contract free of workmanship defects and un-finished projectsPictures tell most everything that of which I haveOne of the many examples of what I have dealt with from Superior Builders is for instance the front door lock which would not engage as the door was shut (deadbolt only) - the builders crew leader [redacted] told me to slam the door as a fix This is one of many examples that doesn't take an experienced trades person to recognize as a means to pacify my valid concernsAgain the builder has not called nor has he attempted to call me in effort to resolve these issuesReading his response would only make me believe he is attempting to avoid ownership on the single family house I paid him to constructI request that the case remain open and that the builder make an attempt to get this resolved without delay, thank you much [redacted] ***
